AN ORDINANCE AMENDING ORDINANCE NO. 1999-229 (ZONING
ORDINANCE) OF THE MUNICIPAL CODE OF TIFFIN,IOWA REINSTATING
SECOND FLOOR APARTMENTS IN Cl
BE IT ORDAINED BY THE CITY COUNCIL OF TIFFIN, IOWA:
Section 1. Purpose: The purpose of this Ordinance is to amend City of Tiffin Ordinance
No. 1998-219 Section 5.07 regarding apartments in Zone Cl.
Section 2. Amendment. City of Tiffin Ordinance no. 1998-219, Section 5.07. F.1 and
Section 5.07.G.1 and 5.07.H.1. regarding second floor and first floor apartments in
compliance with Section 5.10 M in zone Cl is hereby amended by revising the following
subsection(a) as follows:
(a) Scction 5.07.F.1 (a) Second floor apartments and first floor apartment
permitted if in compliance With Section 5.10.M.
(a) Section 5.07.G. 1 (a) Second floor apartments and first floor apartments as
permitted in Section 5.10.M
(a) Section 5.07.1.1 (a) First floor apartments permitted if in compliance with
Section 5.10.M.
Section 3. Amendment: City of Tiffin Ordinance No. 1998-291 Section 5.07.F.1 (a)and
Section 5.07.G.1 are hereby deleted and replaced with the above as submitted above in
lieu thereof.
Section 4. Repealer. All ordinance or parts of ordinances in conflict with the provision
of this ordinance are hereby repealed.
Section 5. Severability. If any section,provision or part of this ordinance shall be
adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity
of the ordinance as a whole, or any section,provision, or part thereof not adjudged
invalid or unconstitutional.
Section 6. Effective Date. This ordinance shall be in effect after its final passage
approval and posting as provided by law.

On the 10th day of March, 1999, at a regular meeting of the Tiffin City Council, Tiffin,
Iowa, Councilperson Bartels introduced Ordinance No. 1999-229, entitled, AN
ORDINANCE A RENTAL CODE FOR PROPERTIES WITHIN THE CORPORATE
LIMITS OF THE CITY OF TIFFIN, IOWA, and moved that it be given its first reading.
The motion was seconded by Councilperson Walls. Ayes: Walls, Bartels, Kern, and
and Gericke. Nays: None. Absent: Ryan.
Four members of the council being present and having voted"Aye", Mayor Glenn R.
Potter declared the motion carried, and Ordinance No. 1999-229, was read the first time
and discussed and placed on record.
On the 10th day of March, 1999, at a regular meeting of the Tiffin City Council, Tiffin, ,
Iowa, Councilperson Kern moved that an Ordinance No. 1999-229, AN ORDINANCE
AMENDING THE ZONING ORDINANCE NO.219 AND ALLOWING APARTMENT
WITHIN COMMERCIAL ZONE Cl Second by Gericke to read the second and third
time and waive and suspend the rules requiring an ordinance to be read three times and
on three separate dates. Whereupon Mayor Glenn R. Potter read the ordinance the
second and third time. Ayes: Bartels, Gericke, Walls, and Kern. Nays: None. Absent:
Ryan.
Councilmember Bartels moved and Gericke seconded that Ordinance No. 1999-229,AN
ORDINANCE AMENDING THE ZONING ORDINANCE AND ALLOWING
APARTMENTS WITHIN COMMERCIAL ZONING Cl having been read and placed on
record be finally placed on upon its final passage and adopted. Roll Call: Ayes: Walls,
Ryan, Kern, and Bartels. Nays: None. Absent: Gericke. Motion carried.
Four members of the council being present and having voted "Aye", Mayor Glenn R.
Potter declared the motion carried, and the ordinance#199-229, AN ORDINANCE
AMENDING THE ZONING ORDINANCE AND ALLOWING APARTMENT
WITHIN COMMERCIAL ZONING Cl was passed and adopted.
Whereupon Mayor Glenn R. Potter declared that Ordinance No. 1999-229 on the 10th day
of March, 199 and be adopted and signified his approval of same by fixing his signature
thereto.

Passed by the council on the 10th day of March 1999 and approved by the mayor on the
10th day of March 1999.
