HomeMy Public PortalAbout1997/05/01 The Regular Meeting of the Mayor and Council of the Borough of Carteret was called to order by Mayor Peter J. Sica on Thursday, May 1, 1997 at 7:30 P.M., in the Municipal CourtlPolice Facility, 230 Roosevelt Avenue, Carteret, New Jersey. Upon individual roll call, the following were noted present: Councilmember John DuPont " James Failace " Stanley Gutowski Noted absent were Councilmembers Deborah Bialowarczuk, Jack Fazekas, William Feingold and Borough Attorney Craig J. Coughlin. The meeting was opened with a minute of silent prayer and the pledge of allegiance led by Mayor Peter J. Sica. The Clerk stated that on April 25, 1997, in full compliance with the Open Public Meetings Act, a notice of tonight's meeting was sent to The Home News and Tribune, The Star Ledger and posted on the bulletin board. Upon MMS&C, by Councilmembers Gutowski and DuPont and unanimous affirmative vote of the three (3) Councilmembers present, the minutes of March 3 & 5, 1997 were approved as transcribed and engrossed by the Clerk. At approximately 7:32 P.M, Borough Attorney Craig J. Coughlin was noted present. 1 Tlus was the night advertised to receive bids for Improvements to Lefferts Street and the Mayor called for all bids. The Ordinance was posted on the bulletin board and copies were made available to the general public and according to law, she read the Ordinance by title. ORDINANCE #97-11 Amending Code Chapter 109 Re: Construction Codes - Flat Fees Upon MMS&C, by Councilmembers Gutowski and Failace and unanimous affirmative vote of the three (3) Councilmembers present, the Mayor declared the Public Hearing to be open: Public Hearing There being no comments or objections to the Ordinance, the Mayor declared the Public Hearing to be closed upon MMS&C, by Councilmembers Failace and DuPont and unanimous affirmative vote of the three (3) Councilmembers present. The Mayor and Council wanted to make sure that we know we are getting a quality product. He voted yes. COMMUNICATION Township of Edison, Woodbridge & Highland Park Borough The Clerk stated that she was in receipt of a Resolution from the Township of Edison concerning prohibiting use of property taxes for school funding. Upon MMS&C, by Councilmembers Failace and DuPont and unanimous affirmative vote of the three members present, it was ordered to be received and placed on file. COMMUNICATION Township of Edison The Clerk stated that she was in receipt of a Resolution ITom the Middlesex Planning Board concerning opposing FY1998-2002 State Capital Construction Program. COMMUNICATION Middlesex County Planning Board The Clerk stated that she was in receipt of the following reports: REPORTS Departments Board of Health - March 1997 Clerk's Office - April 1997; To Treasurer $249.80. Upon MMS&C, by Councilmembers Failace and DuPont and unanimous affirmative vote of the three members present, all reports were ordered to be received and placed on file. 11 BUILDING & GROUNDS: Mayor Sica reported Progress. Mayor Sica said it had come to his attention and he discussed it with Council the other night, that the building across the street, the old Foodtown Building, there's a possibility it can be purchased at a fairly reasonable price. He would like to suggest to the Council that he would like Mr. DuPont, Mr. Gutowski and himself to serve as a committee to get access to that building and see if there is something we can do with it. We're not committed to buy anything. We're just going to look at it. STANDING COMMITIEES '.'i· MAY 1, 1997 STANDING cottMITIEES (Con't.) If the price is reasonable enough. It's his understanding thatìrhas ] 4,000 square feet on one single floor and then the cellar. It may be feasible to incorporate that into the Borough's plans for the future. He said he is appointing Councilmembers DuPont, Gutowski and himself to the committee because they are the three who have a little knowledge regarding construction. They are going to look into it. FINANCE & ADMINISTRATION: Committee Chairman Failace said he sat with Patrick DeBlasio today and unfortunately they still have no numbers from the State on the Discretionary Aid. It's been quite a while. He hopes the numbers that come in will be favorable. The budget is on target and not over extended or over budgeted in any area at this moment. He reported Progress. EIRE: Committee Member DuPont reported Progress. POLICE: Committee Chairman DuPont said they had the Senior Photo I. D. Program last week. Over two-hundred fifty people were there. Obviously, it's definitely a needed service. We were only able to give out one-hundred fifty 1. D.'s. There will be a second day. He will let them know when it will be. Committee Chairman DuPont said there is a need for radios. We have a potentially dangerous situation with the portable radios. Today they received the first batch of new radios Six. Weare replacing the old ones and hope to continue doing so. He reported Progress. PARKS & RECREATION: Committee Chairman Gutowski said the Baseball and Softball seasons are in full swing. Mr. Kolibas has the fields in good shape. Sign-up for the Recreational Basketball Program is going to take place next week., May 6th & 7th, by the Tennis Courts. Applications for summer workers for the playgrounds are still being accepted until the end of the school year. Committee Chairman Gutowski said Mr. Kolibas brought something to his attention today about the trees. It seems there was a problem last year with the trees we purchased fi'om a certain nursery. We will have to remove all the trees out of the ground. Rest assured, that we will go after the nursery that supplied the trees and make sure they make good on the trees that are removed. Mr. Kolibas will be notifYing the people who received trees. They are going to have to come out of the ground. With that, the Parks are functioning well. PUJiLICJ,VORKS: Committee Chairman Fr.ilace said he was with Mr. Surick today They are out filling potholes. Nobody is calling them about potholes. He tells them when he sees one and tells them how potentially dangerous it is. He asked if anyone has potholes on their block, give them a call at the garage. He said he has received a list on all the streets that need work. There are many of them and they are prioritizing that list. 12 Committee Chairman Failace said PSE&G and other utilities that have dug up our streets and left them a mess, we are definitely going after them. He asked Borough Attorney Coughlin to send a letter. We will do whatever we have to get them done. They have a right to come in here, but they don't have a right to leave them like they do. .- ------ Committee Chairman Failace said he was down the sewer plant today and things are going well except for one thing. We have to do something about that building. Mayor Sica said we have to tear it down. Committee Chairman Failace said we would have to bring a trailer or something in there. It's a mess. It has long outlived its life. Mayor Sica said they should sit down with Borough Engineer Parmar and see what we have to do to get a state permit to tear it down. There's a wet well in there. That could cause a problem. They may allow us to fill the wet well in. He said he will tear it down for tree. Committee Chairman Failace said Saturday was the Special Olympics at Carteret High School It was a phenomenal event. It was moving, fun, touching and it was everything you would like to see a sporting event be. He had fun. Stan Gutowski and John DuPont were there. He said he would have like to see more people there and if they have an opportunity to attend, they should. A fun time was had by everyone. He reported Progress. MUNIClP AL GARAGE: Comnuttee Member Gutowski said he saw Vic Kazio today and everything is moving along at the garage. We took delivery of our new bus today. It's beautiful It has thirty seats, fully air- conditioned with a nice stereo system. The Seniors and the Specials will really like it. It's really nice. KATHLEEN M. BARNEY and to all Municipal Clerks for the vital services they perform and their exemplary dedication to the communities they represent. PROCLAMATION "LETTER CARRIER FOOD DRIVE DAY' WHEREAS, for four consecutive years, the National Association of Letter Carriers (AFL-CIO), in partnership with the United States Postal Service and the United Way, has conducted a nationwide food drive on the second Saturday of May; and WHEREAS, postal patrons are being asked to leave non-perishable food by their mailboxes for pick-up by their letter carrier when he/she delivers that day's mail; and WHEREAS, the Campbell's Soup Company is joining this worthwhile effort and is donating 100 million printed postcards publicizing the food drive; and WHEREAS, by reason of this cooperating between the NALC and the Campbell's Soup Company, food will be donated to local pantries and social service agencies in order to reach citizens in the community where the donation is received; and WHEREAS, this goal of helping others is being undertaken by NALC Branch #38 and the Campbell's Soup Company who are asking that May 10, 1997 be declared Letter Carrier Food Drive Day in Carteret; NOW, THEREFORE, I, PETER J SICA, MAYOR OF THE BOROUGH OF CARTERET proclaim that May 10, 1997 be and is hereby declared "Letter Carrier Food Drive Day" and that all citizens and interested parties help out their local letter carriers in making this worthwhile event a successful one. PROCLAMATION "NATIONAL BIKE MONTH" 14 WHEREAS, the bicycle is an environmentally sound method of transportation which produces no air pollution; and WHEREAS, Americans in record numbers are turning to bicycling for recreation, exercise and transportation; and hl~': 1, 1997 WHEREAS, the State of New Jersey actively encourages bicycling as a means of recreation and personal transportation and seeks to improve conditions for bicyclists in New Jersey; and PROCUJ>IATION (Con't.) WHEREAS, the National Nonprofit Bicycling Safety and Education Association, the League of American Bicyclists, has declared the month of May to be "National Bike Month", for each of the last forty-one years and has done so again in 1997; and WHEREAS, bicycle clubs, schools, Parks and Recreation Departments, Police Departments, hospitals, companies and civic groups throughout the state will be promoting bicycling as a wholesome, leisurely activity as well as an environmentally-mendly alternative to the automobile during the month of May 1997; NOW, THEREFORE, I, PETER J. An unidentified man said he was here to submit a bid for Lefferts Street. He asked ifhe was too late. ~1EETING OPENED - 5 Minute Limit Public Discussion Upon MMS&C, by Councilmembers Failace and Gutowski and unanimous affirn1ative vote of the three members present, the meeting was opened for public discussion. Mayor Sica said yes. The man stated that the envelope and the book said to submit it to 61 Cooke Avenue. He was there at 7: 10 and no one was there. Borough Attorney Craig Coughlin said the Notice to Bidders indicates 7:30 P.M. at the Municipal Court, 230 Roosevelt Avenue. 15 Mayor Sica said the address is right on the bid itself. We only had one bidder. We are going to look at it and maybe we will reject it and maybe we won't. Unfortunately, this man was late. The man asked if there was only one bidder? Mayor Sica said yes. The man asked how much the bid was for? ,,- MAY 1, 1997 ,··;ó ,<.·.. PUBLIC DISCUSSION (Con't.) Mayor Sica said $18,823.00. The man said that he didn't think the law allowed them to award it if there's only one bidder. Mayor Sica said yes it does. Ifwe want to, but we are going to look at it. Sophie Cherepon said on Tuesday three from Carteret, the same three ladies that go to everything, ended up at the Turnpike Authority Meeting. No one from Carteret was there. Guy Molinari from Staten Island sends an Aide. The Mayor of Linden sends an Aide. She said when she went to speak, they rejected her plea to speak. They told her to wait until after the vote because she is not the authorized person from the Borough. Nobody ever shows up. She has fought these battles for over a decade. She goes to Linden, no one shows She said we had tyranny without representation and now we just have tyranny. She's tired oftrying to fight to keep this town clean. 19,500 people and only three show up. Ms. Cherepon said they didn't have a letter from the Mayor and Council appointing her a representative. Therefore, she could not speak. She would like to see this corrected in the future. Mayor Sica said she should have asked for a letter and they would have given it to her. Sophie Cherepon said she was told that two people would be there. This was the second time there was no show. Mayor Sica said the next time to ask him for one and he will give it to her. Sophie Cherepon said she didn't care if he gave it to her, but give it to someone. Staten Island has more interest than we do and we are right here. That's ludicrous. Mayor Sica said he has made his position known years ago against that. His position and statements are well known. Sophie Cherepon said Molinari's attorney told them they are going to court in Elizabeth. They anticipate losing because the judge has always been biased against these cases. They will pursue it further. That's New York's attitude. We're right here and we don't have an attitude. Mrs. Cherepon said she overheard people griping about the taxes. They were talking about Frank Raia and the grant he is getting. She asked why the seniors that are getting help have to sign a paper. He doesn't even live here and he's getting a grant. Councilmember Failace said Ms. Cherepon knows his position on incineration. He tries to make every meeting, but unfortunately he can't. He stated they passed a resolution against this incinerator. He personally called (inaudible) after that to speak to him and tell him to let him know if there is anything we can do. He said he is afraid of what kind of deal this could be. 16 Sophie Cherepon said she overheard that the judge always goes against towns and goes for the companies. Councilmember Failace said it isn't that they are doing nothing. '~,>_.q¡~;lJi ' Mrs. Cherepon said they are if they don't show and don't delegate. Mayor Sica said he is not against incineration. He had explained his position on certain types of incineration. He thinks that particular facility, although it may not be dangerous, it's probably the safest way to get rid of that kind of material, the fallacy is where it is being put and getting the material to and ffom it. He read the article in the paper where it states all the trucks will have to exit the turnpike and go there. The full truck isn't the dangerous one. It's the empty one that is the bad one. They are going to be allowed to go through the towns. Sophie Cherepon said she has seen Roosevelt Avenue when there are tie- ups and they come through and you can't get across because they are going to Port Reading and Rahway. She asked them if a full truck is diverted through our town and have an accident? James Mancuso said the department (Streets and Roads) should go around to see the potholes. Councilmember Failace said they have gone around and they are filling them He has been told that no one is calling concerning potholes. Mr. Mancuso said on Jackson Avenue cars are speeding. He has timed them doing 50 miles per hour. He asked if they could put a speed bump there. Mayor Sica said we can't put speed bumps. That's against the law. He will have radar out there within the next couple of days. An unidentified lady said she lived on Daniel Street and lately there have been a lot of burglaries in the area. In her area alone there have been eight in the past two weeks. She wanted to know why it isn't in the papers? Mayor Sica said they don't like to put a lot of police things in the paper because we have already taken some steps in that area. It seems they are concentrating there. He said if you put things in the paper, it's like telling the crooks where they are at. The woman said a lot of people aren't aware of everything that is going on in town. Mayor Sica said they try to make everyone aware by having a "Night Out" and all the police programs that we do have. We don't want to put it in that paper that we are concerting a lot of effort on Daniel Street because lhere are a lot of burglaries. Then the burglars will go somewhere else. We would rather, on the quiet, put in a conce¡1ed effort and we will catch them. 1.7 An unidentified woman said the person that robbed her house on ¡".1arion Street wasn't caught. Mayor Sica said they aren't going to catch everyone. We have a low crime rate in Carteret because we do catch a lot of them. tiAY 1, 1997 PUBLIC DISCUSSION (Con'c.) MAY 1, 1997 PUBLIC DISCUSSION (Con 't.) Mr. Ferracio, 53 Marion Street, said it took ten days for detectives to come. Mr. Ferracio said they were robbed on March 25, 1997. Mayor Sica asked how long did they wait for a detective. Mr. Ferracio said ten days. The guy around the comer waited a week more than that. Mayor Sica said he would check it out and have an answer for them. Mrs. Ferracio said a detective did come. They are trying to say the house was robbed on the 25th. The Police Officer told them a detective would be calling them the next day. Tomorrow came and nothing. Mayor Sica said he will find out tomorrow why it wasn't followed up the very next day. He very seldom hears that. He will check it out. If something fell through the cracks, he wants to know why. Mrs. Ferracio said she would like to know the answer also. Mayor Sica told her to call him tomorrow and he will have an answer. Mr. Ferracio said he asked about fingerprints, but none were taken. When the detective did arrive he gave them a long speech on all the reasons he couldn't take fingerprints. One of which was they probably couldn't trace it anyway. They did eventually come up with a suspect, who is not a kid. Had they taken the fingerprints they could have compared them with this person. Mayor Sica asked if they knew the Detective's name. Mrs. Ferracio said yes. Mayor Sica asked her to give it to him after the meeting He said they should take fingerprints because if they catch someone they can compare. He is going to check it out, maybe he won't be a Detective tomorrow. Mrs. Ferracio said she is not looking to suspend anyone. Mayor Sica said she is a taxpayer and she is entitled to certain rights. She is entitled to safety in her home. Our Police Department has to do all in their power to make sure that happens. When they mess up on something, he wants to know why. Mr. F erracio said if there is a problem with the procedure, let's correct the procedure. Mayor Sica said that is why he is asking for that information. 18 Councilmember Failace said the same thing happened at this lady's home. ,;_10<-.,; The lady from 85 Daniel Street said they didn't take prints at her house either. Mayor Sica said he is sure when they catch the guy that's doing the burglaries, he is probably the guy that's been caught three or fourtimes. He said they think they know who's doing it. He will not tolerate what is going on and he will find out about it tomorrow. Mrs Ferracio said until it happens to you, you have no idea what it feels like. She said she has her house locked up like Fort Knox. She has eighteen locks. She said everyone is afraid. Mayor Sica said the unfortunate thing is people see things and won't even call the police Department because they don't want to be involved. He knows how they feel. He said someone broke into his house and threw gallons of paint over everything His wife is still nervous about going in the house alone. Mrs. Ferracio said she was terrified, also. Mayor Sica said he would have a meeting tomorrow with the Chief and head of the Detective Division and he will get to the bottom of this. Another woman, 8'7 Daluel Street, in 1983 her home was robbed. She has an alann system, but she is alTaid. It's happening during the daytime when everyone works. They seem to know tlllS. She would like more patrols. She asked the Mayor to help them Mayor Sica said there are extra patrols in that area. He will get to the bottom of this tomoiroW. Unfortunately, it's a mess out there. Not just in Carteret. He said three months ago they caught a guy that had one of the biggest burglary rings around Not just in Carteret. It's usually the same select people. He will check on it first thing in the morning.
