CALL TO ORDER The meeting of the Riverside County Transportation Commission (RCTC) Technical Advisory Committee (TAC) was called to order at 10:08 a.m. at Riverside County Transportation Commission, 4080 Lemon Street, Riverside, CA 92501. 2. APPROVAL OF MINUTES M/S/C (WassilBarakian) to approve the minutes of October 18, 2010, meeting as submitted. 4. PUBLIC COMMENTS There were no public comments. 5. STATE AND FEDERAL OUTLOOK FOR 2011 and 6. 2010 STIP UPDATE — IMPACTS OF PROPOSITIONS 22 AND 26 Aaron Hake, RCTC, who joined the meeting via teleconference, reported that the current functions of the federal government are funded through mid -December and Congress is expected to extend current year transportation funding and make a decision of whether they will continue resolutions for the remainder of the fiscal year or pass a new multi- year transportation bill. An extension is probable and the term is not known. If Congress does a continuing resolution for the remainder of the year, there will be no earmarks. If a bill is passed, there may be earmarks. Regarding the full six -year authorization bill, which is a year overdue, it appears if there will be a reauthorization next year it will happen early, most likely before summer recess. Regarding the state budget, the governor has called a special session of the legislature to fix the current year shortfall. Proposition 26 may have an impact on the gas tax law. It may undo the gas tax law. Proposition 22 was approved by voters and will prevent loans of transportation money to the state's general fund. 7. SB 821 Proposed Revisions to the SB 821 Bicycle and Pedestrian Facilities Program Adopted Policies _Tinian Edmiston, RCTC, provided a brief summary of SB 821 from its inception to today and explained that the changes staff is proposing are necessary to comply with audit findings and to streamline the process. She stated that Article 3 of the Transportation Development Act establishes that 2% of Local Transportation Funds are to be allocated to bicycle/pedestrian projects. Every year the Commission releases a call for projects to allocate the funds. Over the past several years few changes have been made to the adopted policies by the Commission. In an effort to comply with audit findings, streamline existing policies, and to update the adopted policies Ms. Edmiston briefly • • " " " Technical Advisory Committee Meeting November 15, 2010 Page 3 summarized six recommendations for the adopted policies and responded to various questions. Ms. Edmiston pointed out that in this recommendation the only change would be to delete the two policies from 1986 that indicate there are 12 months allowed to complete a project. There was much discussion regarding Item No. 3, Recipients Have 24 Months. The following modification was recommended: "Also, projects that have been delayed beyond the agency's control where substantial progress can be demonstrated may receive one 12-month extension if necessary." Under Item No. 6, No Funding for Overruns, Existing Policies to Maintain, add "c" to indicate "same or similar scope and/or contiguous to the approved project." M/S/C (Perez/Wassil) to make the above changes. Rancho Mirage opposed "c." Proposed Revisions to the SB 821 Bicycle and Pedestrian Facilities Program Evaluation Criteria Ms. Edmiston briefly summarized nine recommendations for the SB 821 Bicycle and Pedestrian Facilities Program Evaluation Criteria and responded to various questions. In response to a question that was raised regarding the methodology used to calculate the population equity points every year during the evaluation portion of the SB 821 Call for Projects, Ms. Edmiston stated she will e-mail the information to the TAC. (The information was e-mailed the afternoon of the November 15 TAC meeting.) In response to a concern that there are too many changes to the evaluation criteria, a suggestion was made to organize a sub committee to review the changes. Subcommittee volunteers were: Juan Perez, county of Riverside Dave Barakian, city of Palm Springs Bruce Harry, city of Rancho Mirage Eric Lewis, city of Moreno Valley Chris Sunde, cities of Canyon Lake, Perris, San Jacinto Kevin Hughes, city of Beaumont 8. 2008 FEDERAL TRANSPORTATION IMPROVEMENT PROGRAM (FTIP) AND 2008 REGIONAL TRANSPORTATION PLAN (RTP) AMENDMENT No. 4 Grace Alvarez, RCTC, stated that this is the last report on the 2008 FTIP as the two-year life cycle of the 2008 FTIP is concluded, which included a total of 35 amendments for Technical Advisory Committee Meeting November 15, 2010 Page 4 Riverside County and 545 project changes. The last formal amendment, Amendment No. 50, was approved by the FHWA and FTA on October 27, 2010. The final 2008 FTIP listings for local highways, state highways, and transit projects are available through RCTC's fundtrack under links and resources, as well as in SCAG's website. Regarding the 2008 RTP Amendment No. 4, SCAG's Transportation Committee, Energy and Environment Committee, and Regional Council approved Amendment No. 4 to the 2008 RTP on November 4, and directed staff to transmit Amendment No. 4 to the federal agencies for approval. Approval is anticipated by the federal agencies in mid -December 2010. Riverside County has one project for the city of Rancho Mirage in this amendment, which is the widening of SB Monterey Avenue from Gerald Ford Drive to Dinah Shore Drive. 9. 2011 FEDERAL TRANSPORTATION IMPROVEMENT PROGRAM (FTIP) UPDATE — 2010/11 THROUGH 2O15/16 Ms. Alvarez reported that the 2011 FTIP document has been forwarded to the federal agencies for approval, which is believed to be on target for December 14. The first amendment to the 2011 FTIP was submitted to SCAG on November 2. Amendment No. 1 to the 2011 FTIP included 62 projects; the anticipated approval is late January 2011. • The second amendment to the 2011 FTIP would be an administrative modification and is scheduled for submittal to SCAG on December 1. Approval of Administrative Modification No. 2 is anticipated by mid -January 2011. 10. CALTRANS LOCAL ASSISTANCE REPORT Savat Khamphou, Caltrans, stated that the "No Right of Way Certification" will be effective by Caltrans on December 1. Certification 1, 2, or 3 will have to be used. FHWA's letter is being interpreted by headquarters. The South Tehachapi meeting will be at District 8 Thursday, January 27. Mr. Khamphou reported there are staff changes at District 8. Nivine Georges is leaving December 1, and other changes will be made. 11. NOVEMBER COMMISSION MEETING HIGHLIGHTS The November 10 Commission agenda was provided to the TAC. Grace Alvarez reported that the resolution of necessity for the acquisition of property to complete the last piece related to the State Route 91 High Occupancy Vehicle lanes from Adams Street to the 60/91/215 interchange was approved by the Commission. • • • " " " Technical Advisory Committee Meeting November 15, 2010 Page 5 She further reported that the agreement with VRPA Technologies for the provision of congestion management program (CMP) services for a two-year term, and three one-year options to extend the agreement was also approved by the Commission. Local guidelines for implementing the California Environmental Quality Act were also approved. Approval was also granted for the city of Riverside to receive rail Local Transportation Funds (LTF) to provide a local match for the Magnolia Avenue grade separation project. For the Coachella Valley, CVAG and the city of Coachella requested substitution of Avenue 66 grade separation for Avenue 52 transferring Trade Corridor Improvement Funds to stay within the Proposition 1B timeline for completion of the grade separation project. Robert Yates, RCTC, reported that the Commission also approved the use of unallocated and unprogrammed State Transit Assistance (STA) funds solely for transit capital project financing purposes and for the provision of matching funds to federal capital grants, and it approved the use of unallocated and unprogrammed STA for transit operations only in a circumstance of extreme emergency. Grace Alvarez also reported that the Commission reaffirmed its formal support for implementation and expansion of intercity Amtrak rail service to the Coachella Valley. 12. OTHER BUSINESS In response to a question regarding the Commission's bond cap, it was reported that the bond cap (Measure K) was passed per the results of the November election, which raises the bond cap to $975 million. The 2011 TAC meeting schedule was provided in the agenda. 13. GovaRQL Through the 2010 Budget Act, sighed on October 8, 2010, the Department of Transportation's (Department) Project Initiation Document (PID) Program budget was reduced. This reduction was made trough the Governor's line -item veto authority.. Flex your power! Be energy efficient! PIDs are critical to project delivery*ecause they enable project sponsors to appropriately develop the scope, cost, andschedulefor transportation improvements. The Department understands that this reduction in PID resources disproportionaliy impacts local and regional agencies across California and theirility to deliver critical projects on the state highway system. We also recognize that local and regionalagencies have historically invested a significant portion of their transportation funds on the state highway system. These investments address critical issues srieh as traffic congestion, air quality conformity, and efficient movement of people and goods. The Department views this year's reduction to; its PID Program as a temporary setback and hopes to pursue reinstatement of res+burces through the budget process: In the meantime, the Department will continue to work ill partnership with local and regional agencies to streamline the development of PIDsi Given the current budget environment, streamlining PIDs enables the Department to reduce costs and delays associated with the development of PIDs. In order to obtain the necessary resources to develop PIDs and provide oversight for locally -developed PIDs, the Department and local and regional agencies must demonstrate that we are developing the appropriate number of PIDs for fundable projects. Over the past two years, the Department's PID Program has sustained cuts of 45 percent in staffing and currently has no funding for operating expenses. Due to these reductions, the Department must prioritize its workload to deliver critically needed State Highway Operation and Protection Program (SHOPP) PIDs. Consistent with the Governor's veto message, local and regional agency PID work must be a lower priority for the Department for fiscal year (FY) 2010-11 and may be delayed. To improve your agency's PID project priority, your local or regional agency may reimburse the Department for PM -related services. If reimbursing the Department is desirable by your agency, please contact your Caltrans District representatives to determine the potential for contracting. BACKGROUND INFORMATION: This item serves as a notification to agencies that Project Milestone Reports are required to be updated online by January 21, 2011. These reports provide critical information for development of the FY 2010/11 obligation delivery plan that will be submitted to Caltrans. Annually, each region or county has a target amount of federal funds that needs to be obligated (also referred to as OA). It is crucial that project schedules incorporate potential issues such as the time required for environmental review and right of way certification to ensure that the schedules are realistic. Having access to accurate information regarding project schedules helps staff to develop contingency plans, such as OA loans between regions or project substitution, based on the availability of OA. Likewise, the obligation delivery plan helps Caltrans to develop contingency plans for the state as well as anticipate workload for District staff. Regions have until May 1st each year to obligate their annual OA target, after which the OA becomes available for use by other regions within the state. The State has established this deadline in an effort to reduce the impact of the fourth quarter "rush" for obligations while also increasing the opportunity for the State to receive OA from other states that have low delivery, referred to as "August Redistribution". Therefore, while some projects simply cannot obligate earlier than the schedule allows because of issues such as environmental or right of way certification requirements, staff encourages agencies to obligate as early as possible to increase the likelihood that there will be OA available for the project. The final FY2010/11 obligation delivery plan will be presented at the February TAC meeting after the milestone reports have been completed. As always, RCTC staff is available as a resource to local agencies when navigating the federal process. Included as attachments to the December 15, 2010 e-mail were the federal approval letters, the 2008 RTP Modeling List through Amendment No. 4, and the 2011 FTIP approved listings for local highways, state highways, and transit projects. • The 2008 RTP Modeling List reflects the project changes approved through the 2011 FTIP. This document will guide you through the changes that can be made through the 2011 FTIP amendments. Only changes that do not change modeled elements or result in the completion date (open to traffic date) being pushed into a new model year will be allowed to be changed in the 2011 FTIP. Model changes or delays/advancements that require the completion date to cross over model years will need to be included in the 2012 RTP update, which is scheduled to start in the upcoming months. Two formal amendments (Amendment No's 1 and 3) and an administrative modification (Amendment No. 2) have been submitted to SCAG since the adoption of the 2011 FTIP. The 2011 FTIP Amendment No. 1 totaled 61 projects and included changes that took place after the 2011 FTIP submittal and that needed to be incorporated into the new 2011 FTIP, as well as the addition of the new 2010/2011 Short Range Transit Plan projects approved by the Commission on July 14, 2010 and the incorporation of the 2010 STIP adopted by the California Transportation Commission on May 20, 2010. The 2011 FTIP Amendment No. 1 was approved by FHWA/FTA on December 30, 2010. The 2011 FTIP Administrative Modification No. 2 included 28 projects with minor changes meeting the administrative modification criteria, such as schedule delays for exempt projects or projects not crossing the modeling years, utilization of toll credits, and minor cost changes._ The 2011 FTIP Administrative Modification No. 2 received Caltrans approval on December 21, 2010. The 2011 FTIP Formal Amendment No. 3 includes approximately 19 projects encompassing funding updates for the Highway Bridge Program, five new local highway projects for the City of Moreno Valley, and reprogramming of funds from FFY 2009/2010 to FFY 2010/2011. The anticipated approval of Amendment No. 3 is early March 2011. In addition to the 2011 FTIP amendment submittals so far, SCAG has established the 2011 FTIP amendment schedule from now until April 2011. SCAG will be accepting alternating formal amendments/administrative modification on a monthly basis.
