HomeMy Public PortalAbout2023 0509 Council Packet RIVERDALE CITY COUNCIL AGENDA PLACE: Riverdale City Hall, 110 Manor Drive, Riverdale, Iowa DATE: May 9, 2023 TIME: 7:00 p.m. A regular meeting of the City Council of Riverdale, Iowa, will be conducted according to the following order and actions will be considered on the items listed. The notice of this meeting is not considered final until 24 hours prior to the meeting and may be further modified if 24 hours’ notice is impossible or impractical for good cause. In compliance with the Americans with Disabilities Act (ADA) and other applicable federal and state laws, all public hearings and meetings held or sponsored by the City of Riverdale, Iowa, will be accessible to individuals with disabilities. Persons requiring auxiliary aids and services should contact City Hall at (563) 355-2511 five days prior to the hearing or meeting to advise of their anticipated attendance. The requirement that an Ordinance be read three times before passage may be waived by council upon an affirmative vote of four (4) of the five (5) council members. The public is advised to take note of this process and be prepared to speak either for or against any ordinance at the time of the first reading. Per Chapter 21 of the Iowa Code, more specifically described in sections 21.3 and 21.8, a member of the Council may attend the meeting either in-person or by electronic means, as defined in said sections. 1. PUBLIC COMMENT Per Iowa Code 21.7, this governmental body makes and enforces reasonable rules for the conduct of its meetings to assure meetings are orderly and free from interference or interruption by spectators. The public is encouraged to provide insights on the proposed agenda and other items of concern. Public comment time is limited to three (3) minutes per speaker. Speakers will introduce themselves, their topic(s) concern, and provide their address for the record. Public comments do not need to be in support of proposed actions but are to be constructive and respectful. A lack of decorum will result in the end of the comment period and possible removal from the meeting. All members of council, the public, and staff are encouraged to find ways to effect positive change in their comments and their actions for the betterment of our community. 3. WHEREAS CP is party to the Surface Transportation Board (“STB”) proceedings, Docket No. FD 36500, through which it sought to acquire Kansas City Southern Railway (“KCS”) and its operating subsidiaries (“CP/KCS Transaction”), and in which the STB issued its decision to approve the CP/KCS Transaction, with conditions, on March 15, 2023. This decision is effective on April 14, 2023. AND WHEREAS until CP exercises control pursuant to the STB decision of March 15, 2023 and the Voting Trust is dissolved, CP and KCS will continue to ope rate independently. AND WHEREAS this Settlement Agreement sets out terms and commitments by the parties in resolution of any objections or demands in connection with the proceedings in Docket No. FD 36500. IN CONSIDERATION of the mutual covenants and agreements contained herein, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, and intending to be legally binding, the parties agree as follows: 1. Community Investment. As a voluntary community investment, CP agrees to contribute ONE HUNDRED THOUSAND DOLLARS ($ 100,000.00 USD) (“Community Investment”) to Riverdale. In addition to the Community Investment, CP agrees to contribute the following additional amounts (“Additional Community Investment”), such payment to be made as mutually agreed by the parties after the execution of agreements for the closure of the Fenno Road at-grade crossing and construction of an overhead bridge taking the place of the Fenno Road at-grade crossing,: a. ONE HUNDRED THOUSAND DOLLARS ($ 100,000.00 USD) for the closure of Fenno Road crossing in Riverdale, Iowa, crossing No.865631R, and b. TWO HUNDRED AND FIFTY THOUSAND DOLLARS ($ 250,000.00 USD) for the construction of a grade-separated crossing at Fenno Road. 3. Community Commitment. In exchange for this Community Investment and Additional Community Investment, Riverdale agrees that: a. Riverdale will, concurrent with the closure of the Fenno Road crossing, close the following three private crossings: i. Private crossing immediately to the west of Fenno Road leading to Riverside Generating Station (865632X). ii. Easternmost private crossing leading to Arconic plant (865550R). SUBJECT TO SETTLEMENT PRIVILEGE (Rule 408) PRIVILEGED & CONFIDENTIAL iii. Next private Arconic crossing to the west (865633E). b. Riverdale will not seek any mitigation conditions before the STB as part of the proceedings in Docket No. FD 36500 and Riverdale further agrees that it will not oppose CP’s acquisition of KCS before the STB in Docket No. FD 36500 or in any other forum. 4. Final Surface Transportation Board approval. CP’s commitments under this Settlement Agreement will not take effect unless and until the STB gives final approval to CP’s acquisition of KCS in Docket No. FD 36500 and CP in fact acquires control of KCS pursuant to that approval. 5. Sole Remedy. CP and Riverdale intend that the STB require compliance with this Settlement Agreement instead of any other mitigation that might be imposed within Riverdale as part of the CP/KCS Transaction. 6. Confidentiality. This Settlement Agreement and its terms shall be confidential except to the extent disclosure is necessary for Riverdale to approve the agreement, for review by federal or state government officials, or as otherwise required by law. Notwithstanding the foregoing, CP may disclose to the Surface Transportation Board that it has entered into this Settlement Agreement, without disclosing the particular terms and conditions, or as may be necessary in response to a request for submission in Docket No. FD 36500, or as otherwise relevant thereto. 7. Governing Law. This Settlement Agreement is governed by, and construed in accordance with, the laws of the state of Minnesota and applicable federal laws, excluding any conflict of laws rules that may apply therein. 8. Entire Agreement. This Settlement Agreement constitutes the entire agreement of the parties concerning its subject matter and no other proposals, representations, warranties or other documents or agreements, either oral or written, shall be binding upon the parties. Notwithstanding the foregoing, the parties shall undertake to execute any agreement and take all other actions necessary to give effect to this Settlement Agreement. No provision of this Settlement Agreement may be amended, modified, waived or changed unless made in writing and signed by the Parties. 9. Counterparts. The parties may execute this Settlement Agreement by facsimile or other electronic means and in separate counterparts each of which when so executed and delivered shall be an original, and all such counterparts taken together shall constitute one instrument. We will assess late fees on Monday (yesterday at the time this council meeting occurs). We are very interested to see the results of that report. Shred Event: Collectively as an office, we prepared for our first shred event. The records in our storage/record closet area have been meticulously kept…so meticulous that there were many that are already in our Laserfiche storage or duplicates in the drawers. We were able to shred a large amount of paper and clear out space for current documents needing storage. We had roughly 20 cars of residents who used this service. I also received some feedback that people were unaware that this was for the community. Our next shred event, scheduled in October, will have some signage on the road the week leading up to the event. This will hopefully help bring more awareness. Career Fair: Kelly and I attended the Scott Community College Career Fair to bring awareness to the seasonal worker positions that we currently have. We met a lot of other community businesses. This was a good networking event for me personally. I was able to chat with a few students from SCC about this position, but I am not certain that those people applied. Sewer Zoning: I investigated a potential issue with business sewer classifications and how they were billed. I spoke to the former zoning inspector, Scott County assessors’ office, Riverdale clerk, and impacted businesses. What we found was that this is a non-issue, and these businesses are correctly classified in our billing system. Letters were sent to impacted businesses. Sewer overpayments: Due to the change from Iowa American regarding how new meters are measuring usage (gallons instead of cubic feet), we found that there were 2 residents who overpaid. I calculated their overpayment amount and composed letters to these residents. I asked them if they would prefer a credit or refund. I gave a date of May 26, 2023, to contact the office. If no contact by that time, we will apply a credit to the account. Apparel: I am waiting for one set of quotes. My hope is that you are reading this with the completed document in hand. My personal choice would be Source1 based on our interactions. Normal/ Other Tasks: Accounts payable/cutting checks, assisting residents with any needs they bring to my attention, room rentals, working on the newsletter, disassembling council packets after the meeting, and other tasks delegated to me. MSA also acted as the City's agent in working with Kline Sewer and Drain to resolve a plugged sanitary sewer line at 1055 Valley Drive. In addition, MSA will remain available to assist the City staff in other matters, including continued regular participation in City Council Meetings. The aforementioned work was not anticipated when the Professional Services Agreement and the associated Amendments were prepared. To cover these additional costs, plus to provide for the authorization to provide future unanticipated work, MSA is requesting an authorization to modify the maximum not to exceed amount of our agreement from $22,800 to $28,000.00. Therefore, MSA is requesting an increase of as about $5,200.00 in authorized work. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RIVERDALE, IOWA: SECTION 1: The City Council directs the City Clerk to create the following new funds for the purposes designated below: a. 145- LMI TIF - for purposes of separately accounting for tax increment financing funds received that are legally required to be set aside and any additional funds that the Council determines should be set aside for the benefit of low to moderate income households. b. 305- TIF Capital Projects - for purposes of paying eligible tax increment financing expenditures that will later be certified with the County Auditor for repayment with TIF funds. Said TIF funds will first be receipted to the appropriate TIF fund and then transferred to Fund 305 to repay the debt. SECTION 2: The City Council hereby authorizes the renaming of the following funds: a. 125 - From “TIF” to “State Street TIF” b. 126 - From “TIF 2” to “Welch Farm TIF” c. 127 - From “TIF 3” to “Fenno TIF” SECTION 3: The City Council hereby authorizes staff to renumber the City’s revenue accounts to better conform with the Iowa Uniform Chart of Accounts. SECTION MODIFIED. The purpose of this chapter is to facilitate the enjoyment of park facilities by the general public by establishing rules and regulations governing the use of park facilities. (Code of Iowa, Sec. 364.12) 47.02 DEFINITIONS. For use within this chapter the following terms are defined: 1. “City park” means any publicly owned outdoor park, playground, trail, seating area, shelter gazebo, or other structure, and any restroom or parking areas associated with these areas. 2. “Electronic smoking device” means any device, including but not limited to, e-cigarettes, e- pens, e-hookah, e-cigars, and vape pens used to vaporize plant material, liquids, oils, nicotine, or other chemicals that may be inhaled by users. 3. “Motor vehicle” means a snowmobile, minibike, motorized skateboards, motorbikes, motorcycles, all-terrain vehicles (ATVs), utility-terrain vehicles (UTVs), cars, trucks, golf carts, or similar type transportation equipment. 4. “Smoking” means inhaling or exhaling from any lighted or heater pipe, cigar, cigarette, or any other lighted or heated tobacco, plant material, liquid, oils, nicotine, or other chemicals that may be inhaled or exhaled by the user. 5. “Vapor product” means any noncombustible product, which may or may not contain nicotine, that employs a heating element, power source, electronic circuit, or other electronic, chemical, or mechanical means, regardless of shape or size, that can be used to produce vapor from a solution or other substance, including an electronic cigarette, electronic cigar, electronic cigarillo, electronic pipe, or similar product or device, and any cartridge or other container of a solution or Ordinance No. 03-2023 - Page 2 of 4 other substance, which may or may not contain nicotine, that is intended to be used with or in an electronic cigarette, electronic cigar, electronic cigarillo, electronic pipe, or similar product or device. (Code of Iowa, Sec. 453A.1(29)) 47.03 USE OF MOTOR VEHICLES. The following regulations shall apply to the use of vehicles within the City parks: 1. Operation. Motor vehicles shall not be operated on trails, paths, or park grounds not specifically dedicated for and authorized for use by motor vehicles with the following exceptions: A. Motor vehicles shall be allowed to operate in designated park parking areas and park driveways designed for and provided for motor vehicle use. B. This section shall not apply to motor vehicles owned and operated by City staff and authorized City contractors. 2. Parking of Motor Vehicles. A. Motor vehicles shall not be parked in areas of a City park except in designated parking lots or areas. Motor vehicles that are parked in a location other than a designated parking lor or area may be ticketed or towed and the cost of which shall be the responsibility of the motor vehicle owner prior to the release of the motor vehicle. B. Motor vehicles shall not be left parked in designed areas of the park after the City park is closed. Motor vehicles left in violation of this paragraph may be ticketed or towed and the cost of which shall be the responsibility of the motor vehicle owner prior to the release of the motor vehicle. C. Overnight Parking. No motor vehicle shall be allowed to be left in designated parking areas or within a City park overnight. Motor vehicles left in a City park overnight may be ticketed or towed and the cost of which shall be the responsibility of the motor vehicle owner prior to the release of the motor vehicle. D. The City may approve temporary parking areas within the City parks for special events or programs. In cases where special temporary parking is approved the area shall be appropriately signed. 3. Speed Limit. No motor vehicle shall travel in excess of 15 MPH on any City park road or parking area. The speed limit for City parks shall be posted at each park entrance that includes a roadway. 47.04 BICYCLES. No bicycle shall be ridden or parked on any playground safety surface area within a City park. 47.05 FIRES. 1. No fires shall be built, for any purpose, except in designated receptacles provided therefor, and such fire shall be extinguished before leaving the area unless it is to be immediately used by some other party. 2. A fire shall be considered “extinguished” the ashes, residue, coals, and unburned substances are cold to the human touch. 3. No fire shall be left unattended. Ordinance No. 03-2023 - Page 3 of 4 4. The City may, by written permission only, allow a controlled burn of any forest, brushland, grassland, meadow, prairie, marsh, refuse, container, or structure by an authorized and trained individual or group. 47.06 TRASH DISPOSAL. 1. No person shall place, deposit, or throw any waste, refuse, litter or foreign substance in any area or receptacle except those provided for that purpose. 2. Littering. No person shall throw or deposit on any City park grounds any glass bottles, glass, nails, tacks, wires, cans, trash, garbage, rubbish, litter, or any other debris or substance likely to inure any person, animal, or vehicle. 3. Yard Waste. No person shall place in any trash receptacle or in any City park, yard waste as defined in Section 105.06 of this Code of Ordinances. 47.07 PARK HOURS. All parks shall be open from sunrise to sunset each day and shall be closed from sunset to sunrise, unless an activity is a regularly scheduled activity or otherwise approved by the City in writing. No person shall remain in a City park except with the permission of the City when a park is closed. 47.08 RESTRICTED ACTIVITIES. The following activities are restricted or prohibited within the City parks unless expressly granted permission by the City: 1. Camping. 2. Golfing. 3. Trapping wild animals. 4. Swimming. 5. Fishing. 6. Carrying of a firearm, air gun, or bow and arrow. 47.09 ANIMALS. The following regulations apply to the us of City parks by person with pets and other animals: 1. All pets must be on a leash while in the City parks. 2. Every person owning or having custody of an animal in the City parks shall immediately clean up and remove feces deposited by such animals and dispose of in a sanitary manner. 3. No person shall taunt, injure, hunt, pursue, or take any wild animal, bird, or game. 4. No person shall ride any horse, mule, or any other animal in any City park unless granted specific written permission by the City. 47.10 USE OF AIR SPACE. 1. Drones and Model Aircraft. No person shall fly, operate, use, or control any power-driven model aircraft or drone except when authorized by the City. 2. Hot Air Balloons, Airplanes, Gliders, and Helicopters. No person shall operate, land, or launch a hot air balloon, airplane, glider, hang glider, or helicopter from a City park unless expressly permitted by the City. Ordinance No. 03-2023 - Page 4 of 4 47.11 FIREWORKS. The use of fireworks within a City park is expressly prohibited. 47.12 VANDALISM. No person shall damage, destroy, deface, or remove any signage, equipment, building, structure, tree, vegetation, or machines owned or under the control of the City. 47.13 ALCOHOLIC BEVERAGES. No consumption of any alcohol or alcoholic beverages shall be allowed with the City parks. 47.14 SMOKING AND VAPING. Smoking and the use of any electronic smoking device or vapor product by any person in any City park is prohibited at all times. The use of FDA approved products for the purpose of tobacco cessation are exempted from this section. 47.15 COMMERCIAL AND PROMTIONAL ACTIVITY. It is unlawful for any person to conduct any promotional or commercial activity on any City park property without first obtaining permission from the City and only in compliance with Chapter 122 of this Code of Ordinances. It is unlawful for any person to place or cause to be placed advertising material on or in any structure, playground, pole, or other location within a City park without the express permission of the City. SECTION 2. SEVERABILITY CLAUSE.
