Hansen The newest addition to the Sierra Azul open space preserve(Rincon Canyon) has very few residents in this area.Because of this the area has been wide open to gun use including hunting and target practice usaully on road signs,native trees and domestic animals . It also attracts alcohol and drug abuse and drug cultivation because of its lack of any kind of patrols sheriff or rangers. The most devasting disregard for this natural area is the use of offroad vehicles which have damaged public and private property. We have personally become involved in these incidents because of the frequency of these incidents and the close proximaty of our property to these problem areas. This area cannot be left open to indiscrimate use and must be patrolled at least 4 to 5 times per day especially heavy in the 12PM to 6 PM time frame. We have worked closely with county road department, sheriffs department , and county parks department and we look forward to working with the board to further improve this area. Although the present trail along the creek crosses the creek several times in the ^ length of our common boundary, it is on the north side of the creek for � the majority of its length. Thus any public use of the present trail � would clearly be mostly on private property. Guadalupe Land Company supports the concept of opening this trail to public use at some time in the future but we do not support opening of this trail at this time. Gundert, Associate Open Space Planner SUBJECT : Final Adoption of the Interim Use and Management Plan for the Baldwin-Wallace College Property Addition to the Sierra Azul Open Space Preserve , Mt. Umunhum Area Introduction: At your November 13 , 1985 meeting you approved the acquisition of the Baldwin-Wallace College property addition to the Sierra Azul Open Space Preserve, Mt. Umunhum Area (see report R-85-53 , dated November 8 , 1985) . You also tentatively adopted the Interim Use and Management Plan recommendations outlined in the report and indicated your intention to withhold the property from dedication. Discussion: At your November 13 meeting, a discussion regarding patrol and caretaking of this property ensued. Neighbors attending the meetinq told of the area' s problems : drug use, late night parties, four-wheel-drive vehicle use, and the use of firearms . At your request, District staff has outlined a section for management and caretaking of the acquisition property as follows: Short Term Plan: At present, Sierra Azul is quite low in the patrol priority spectrum. It is envisioned that District Rangers initially will make 1-2 visits to the area per week , or respond to problems as requested. This has generally been the patrol pattern for all existing District properties in the Mt. Umunhum and Kennedy Road Areas. As the Baldwin-Wallace properties were loosely maintained under the previous ownership, any District Ranger presence now will be of help in the area especially along the Hicks Road corridor where the bulk of the problems occur. However, the Rangers will not have the ability to respond to the more high risk incidents which occur on District lands in the area, since they are not public safety officers and any high risk response must wait for sufficient back-up from the Santa Clara County sheriff ' s department. Any outside sources of help will be of help in site patrol and surveillance at the current time. This could include assistance from neighbors or pursuit of a patrol contract with another law enforcement agency. Staff will be pursuing these options and has a meeting with site neighbors from both Hicks Road and Mt. Umunhum Area planned for January 1986 to discuss law enforcement and planning and management of District lands in the area. Long Term Plan: The present Ranger job description and its orientation in terms of visitor services and resource protection is currently under review, as is the overall scheme of field staff deployment District-wide. The one to three year scenario calls for a separate patrol and maintenance team assigned to the southern region of the District, which includes the Sierra Azul area. Overall District long term law enforcement needs are also being considered, and whether to contract for these needs or develop an in-house program has not as yet been determined. A recommendation will be forthcoming in the Open Space Management Staffing Study. Another long term site protec- tion option being pursued is the siting of Ranger residences in the east of Highway 17 area. Responses again , however, to the high risk or dangerous episodes in the area will be limited to the law enforcment capabilities of the Rangers at that time. The following Use and Management recommendations should be added to the Plan contained in the acquisition report. E . Interim Use and Management Recommendations 3. Staff will investigate , with the Santa Clara County Transporta- tion Department , the feasibility of posting "No Parking Dusk to Dawn" signs at some of the roadside pullouts along Hicks Road adjacent to the property. 4 . Staff will explore the feasibility of a variety of cooperative management arrangements both for the long and short term including voluntary surveillance by responsible neighbors , a possible caretaker located at the Mt. Umunhum facility, and the costs and desirability of hiring contract patrol services from the County Sheriff. Staff will then return with recommenations for this patrol help during the period of budget deliberations for the 1986-87 fiscal year. In accordance with the Land Acquisition Public Notification Procedures (see memorandum M-83-106 dated August 31, 1983) , final adoption of the Interim Use and Management Plan was deferred until close of escrow on the property to allow for public comment. Close of escrow was recorded on November 27 , 1985 . To date, staff has received two letters of public comment (see copies attached) on the project and has met with one of the senders , Mr. Charles Dwyre , the President of the Guadalupe Land Company which is the owner of the land to the north including Rincon Creek. Staff will again be meeting with Mr. Dwyer to discuss his concerns . A reply is attached to the other letter from Mr. Fronk regarding his request . Recommendation : I recommend that you adopt the Interim Use and Management Plan as contained in report R-85-53 and amended herein for the Baldwin- Wallace College property addition to the Seirra Azul Open Space Preserve , Mt. The Midpeninsula Regional Open Space District has just acquired the lands you refer to from Baldwin- Wallace College , and yes , you may enter the property to pick up trash along the creek as the land is open to the public with access off Hicks Road. I have enclosed a map showing the boundaries of the land we acquired from the college and also All-Site and Basic Policy brochures which explain the District goals and how we function to preserve and manage land. We are ver y ha to y happy encourage any volunteer efforts such as your proposed trash clean-up to reach our goal in protecting the natural beauty of the land we acquire. Gundert, Associate Open Space Planner SUBJECT: Proposed Atwood Property Addition to the El Sereno Open Space Preserve Introduction: The Midpeninsula Regional Open Space District has been offered the opportunity to purchase 29.95 acres of land adjacent to the El Sereno Open Space Preserve. The heavily wooded property is located within the sphere of influence of the Town of Monte Sereno, in unincorporated Santa Clara County. A. Description of the Site 1. Size, Location and Boundaries This 29. 95 acre parcel is contiguous to the western boundary of the El Sereno Open Space Preserve. Private property adjoins the site to the north, south and west. The town of Saratoga is located northeast of the subject property. 2. Topography, Geology and Natural Landscape The property is located on a northeast facing slope. The terrain is generally very steep; however, several moderately steep slopes originally anticipated for homesites do exist on the property. For the most art the site is densely wooded with a forest of P Y Douglas fir, tanoak and bay laurel trees . A small area of chaparral is located in the northernmost area of the property. Several _year-round springs are located on the property. The springs and other seasonal drainage on the property feed into tributaries of the San Tomas Aquinas Creek. Views from the property into the creek canyon and of the prominent ridge on the El Sereno Open Space Preserve help to create a remote feeling in the otherwise developed hillside neighborhood of Bohlman Road. i R-85-57 Page 2 The site, like much of the El Sereno Open Space Preserve, is valuable scenic backdrop for the communities of Monte Sereno, Saratoga and Los Gatos and wildlife values are also considered very high for this densely wooded land. B. Planning Considerations The property is zoned rural residential by the County of Santa Clara. The property received the highest rating on the District's Master Plan map, a composite rating system of the suitability of land for open space acquisition. C. Current Use and Development Access to the property is provided by a 50 foot driveway easement off Bohlman Road, which passes within 30 feet of an existing house. The easement area also serves as the driveway to the house. Beyond the house, the easement passes over three parcels, for a distance of approximately 1400 feet, prior to entering the subject property. The easement is not passable by vehicle at this time as it is over- grown with Scotch broom. The road enters the property from the west, turning southeasterly through the property. Springs have triggered a small landslide in the southern section of the site, thus blocking the road at that point. A second road, which is also overgrown, branches from the main road in the center of the site to enter the northern part of the property. Both roads appear to dead-end on the property. There are no structures on the property. D. Potential Use and Management The existing road system on the site may at some time lend itself to a connection to the existing trail system for the El Sereno Open Space Preserve. However, access to this property at present is such that a connection is not currently possible. Trail connections between El Sereno and Villa Montalvo could also be accommodated on site. Views from the property do make this an attractive addition to the existing Preserve , and the proximity to the Bohlman Road area creates the potential for a neighborhood access point to the Preserve. E. Interim Use and Management Recommendations Boundary plaques will be installed as necessary. F. Name The property should become an addition to the El Sereno Open Space Preserve and become known by that name. G. Dedication This property should be withheld from dedication as public open space at this time until a final determination of the Preserve ' s boundaries can be made. R-85-57 Page 3 H. Terms The total purchase price as stipulated in the attached Purchase Agreement would be $100 ,000 payable in cash at the close of escrow (an average of $3 ,300/acre) . Funds for this purchase would come from the New Land Commitments budget category and specifically from the proceeds of the District' s 1985 note issue. The Board of Directors of the Midpeninsula Regional Open Space District does hereby accept the offer contained in that certain Purchase Agreement between Stanford H. Atwood, Jr. et al . , and the Midpeninsula Regional Open Space District, a copy of which is attached hereto and by reference made a part hereof, and authorizes the President or appropriate officers to execute the Agree- ment on behalf of the District. Section Two. The President of the Board of Directors or other appropriate officer is authorized to execute a Certificate of Acceptance to any deed (s) granting title to said property. Section Three. The General Manager of the District shall cause to be given appropriate notice of acceptance to the seller. The General Manager further is authorized to execute any and all other documents in escrow necessary or appropriate to the closing of the transaction. Section Four. The General Manager of the District is authorized to expend up to $2 ,000 to cover the cost of title insur- ance, escrow fees , and other miscellaneous costs related to this transaction. Section Five. The sum of $100,000 is hereby ordered to be withdrawn from the Midpeninsula Regional Open Space District 1985 Promissory Note Fund for this purchase. i PURCHASE AGREEMENT THIS AGREEMENT is made and entered into by and between Stanford H. Atwood, Jr. and W. Donald Head , as Joint Tenants , hereinafter called "SELLER" and the Midpeninsula Regional open Space District, hereinafter called "DISTRICT. " 1 . PURCHASED PROPERTY SELLER agrees to sell to DISTRICT, and DISTRICT agrees to purchase from SELLER, SELLER'S real property located within an unincorporated area of Santa Clara County, State Of California , consisting of thirty acres (30 . 0) , more or less, and co,Tlillorily referred to as Santa C'Lar,t County Assessor' s Parcel No. 517-17-057; said property being more Particularly described in Preliminary Title Report No. 255784, dated November 1 , 1984 , from First American Title Guaranty Company, said Report being designated Exhibit "A" I as attached hereto and by this reference incorporated herein and made a part hereof. Said property being acquired together with any easement, rights of way , or rights of use which may be appurtenant or attributable to the afore- said lands, and any and all improvements attached or affixed thereto. 2. PURCHASE PRICE AND MANNER OF PAYMENT The total purchase price shall be One Hundred Thousand and No/100 Dollars ($100 ,000. 00)* payable in cash at such time as escrow may be closed and title conveyed to the DISTRICT under the terms and conditions set forth herein . 3. TITLE AND POSSESSION Title and possession of the subject property shall be con- veyed to DISTRICT at the close of escrow by Grant Deed, free and clear of all liens, encumbrances, judgments, ease- ments, taxes, assessments, covenants, restrictions, rights, and conditions of record except: A. Taxes for the fiscal year in which this escrow closes shall be pro-rated as of the close. B. Typewritten Exceptions Numbered 3 and 4 listed in said Preliminary Title Report (Exhibit "A") . C. Woods , Open Space Planner SUBJECT: Annual Review of Relative Site Emphasis Plan and Use and Management Plan Review Schedule Introduction : The Relative Site Emphasis Plan was last reviewed on December 19 , 1984 and received final approval on January 9 , 1985 (see reports R-84-55 , dated December 13 , 1984 and M-85-02 , dated January 3 , 1985) . The 1985 Use and Management Plan Review Schedule was included in those reports and was amended on August 28 , 1985 (see memorandum M-85-181 , dated August 20 , 1985) . The Relative Site Emphasis Plan is reviewed each year to provide an oppor- tunity to update the existing plan in order to reflect changes in various factors which influence any of the individual preserve 's use and develop- ment potential. This Relative Site Emphasis Plan is a comprehensive plan used to determine where planning and budgetary efforts should be empha- sized in the coming fiscal year. The Plan serves as a guideline and is recognized to be a list of tasks above and beyond those that can reasonably be accomplished by current Land Management staffing and funding levels . A Land Management staffing study, which is near completion and will be presented to you early in 1986 , will relate considerably to the goals presented in this plan. The Use and Management Plan Review Schedule indicates target dates when the Use and Management Plan of each preserve or area is to be reviewed by the Board. It relates to the Relative Site Emphasis Plan in that sites which are relatively more emphasized are generally reviewed more frequently. In addition, the schedule responds to the need to review those sites where significant use issues , planning or development projects will require Board consideration. To date , the goal has been to review every site at least once within a two year period. Discussion: There have been three major acquisitions and one significant site improvement project this past year which have been carefully eval- uated for the new Relative Site Emphasis Plan. The acquisitions include large additions to the Sierra Azul and La Honda Creek Preserves , and the establishment of a new site - the El Corte de Madera Creek Preserve. The aforementioned site improvement project refers to the development of extensive new trails and signing at the Long Ridge Preserve . The acquisition of the Baldwin-Wallace College property, an addition to the Mt. Umunhum, Area of the Sierra Azul Preserve , dramatically changes the acreage and boundaries of the Preserve but does not significantly change the potential for long term development at this time. The Mt. Umunhum area is still comprised of a number of non-contiguous parcels with poor access and trail use opportunities , and therefore remains relatively low R-85-56 Page Two on the list for long term development opportunities until other potential acquisitions consolidate the land holdings and make a more usable config- uration. The acquisition of the Darling property, an addition to the La Honda Creek Preserve , has significantly increased the potential for better access to the site , but the accessibility factor still remains relatively low com- pared to most sites. The Preserve 's position on the list has been moved slightly upward as a result of the addition. The acquisition of the El Corte de Madera Creek Preserve increases the number of separate preserve areas to twenty-seven, where its position has been placed 19th on the list. This position has been determined according to the established criteria for site analysis . It scores particularly high in attractiveness and public need but relatively low in accessibility, manageability, geographic location, and regional significance. The lower scores relate to the site 's current limited parking and access potential (which will be significantly improved in later phases of the acquisition) , inherent trespass problems, its location next to the already more empha- sized Purisima Creek Redwoods Preserve, and existing non-contiguous location to other public lands . The position of the Long Ridge Preserve has been elevated. This is attri- buted to the fact that there is an increased public interest as a result of publicity and stepped-up development of trails and signing. Existing trail and road user conflicts dictated immediate action which resulted in a project that went beyond the scope of what was originally planned in last year 's Relative Site Emphasis Plan and thereby diverted money and staff time away from other previously higher priority projects. The new trails and publicity has markedly increased the site 's use and now puts pressure on the District to provide improved staging facilities . This attributes to the Preserve being moved upward to position number 11. This year 's planning projects represent a significant increase over last year. Large scale planning projects may include master plans for the Hassler property, the Mt. Umunhum. Area, the San Mateo County Baylands Pre- serve, and Los Gatos Creek Park. More specific site planning related to access projects will occur at Purisima Creek Redwoods , Kennedy Road Area, and Skyline Ridge. Special planning projects of note will include trails planning and structure improvements at Rancho San Antonio Open Space Pre- serve. The focus on actual development of access facilities will be at Purisima Creek Redwoods , Skyline Ridge, and Kennedy Road Area. As the District 's land holdings spread further to the extremes of the District 's boundaries , the planning, development, and management programs have become significantly impacted. It has become increasingly apparent that it may be necessary to modify the approach to the Relative Site Em- phasis Plan perhaps by decreasing site development, depending on public sentiment, to avoid serious impacts on the District 's acquisition program. One approach that might be examined is the manner in which we conduct planning, development, and management programs on those preserves which fall towards the bottom of the site emphasis list. These preserves gener- ally have major drawbacks relating to potential access and circulation. In an effort to achieve the goal of having all the lands open to the pub- lic , a significant amount of time and cost is associated with accommodating access to relatively few people. In addition, unstructured access sometimes tends to create undesirable use patterns which present problems for neigh- bors and a burden for the District 's Land Management staff. An alternative approach may be to create a site emphasis category for mini- mal use and management which encompasses those sites that are relatively R-85-56 Page Three low on the list. These preserves then, because of their access and circu- lation limitations , would receive minimal attention in regards to planning and development, and public use would be discouraged. This could mean that improvements are limited to site protection, signing is not directed to recreation, and brochures or maps are not prepared for general public use. This category would not interfere with existing compatible use of the property but would curtail increased general use. If this appears to be an acceptable approach to reducing the overall manage- ment burden that relatively unemphasized sites now pose , then it is sugges- ted that we return at the time of second reading with an addendum to the existing policy statements which reflects the establishment of a minimal use and management category for site emphasis. (See Policy and Plan for Relative Site Emphasis of Use , Development and Publicity of District Sites , dated May 12 , 1982 . ) It is also recommended that policy statement 5 be considered for revision to provide for a longer review interval for sites which fall in the minimal use and management category. During the past few years , increased use conflicts and public interest in development projects have dictated an in- crease in the number of public workshops which are needed prior to Use and Management Plan reviews . This has significantly lengthened the planning process for many sites and has made it difficult to meet the proposed sched- ules . It is suggested that an alternative approach to be considered is the possibility of placing those sites on the minimal use and management cate- gory into a three year maximum interval. Staff feels that the suggested approaches to modifying the Relative Site Emphasis Plan (developing a minimal use and management category) and leng- thening the review process for the sites that are relatively unemphasized, should be incorporated into the planning process at this time. These ap- proaches are considered to be consistent with the current Land Management staffing study which projects a steady increase in planning projects over the next few years . An anticipated increase in planning staff is being explored as a way to accommodate the planning and development needs above and beyond those normally associated with the use and management planning process . Recommendation: I recommend that you tentatively adopt the attached revised Plan for Relative Emphasis of District Sites and the 1986 Use and Management Plan Review Schedule and that you direct staff to return with the aforementioned proposed revisions to the planning process for your further consideration.
