HomeMy Public PortalAbout93-072 (06-15-93)RESOLUTION N0. 93-72 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, CALLING AND (~ GIVING NOTICE OF A MEASURE TO BE VOTED ON It AT THE NEXT GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, NOVEMBER 2, 1993 FOR THE SUBMISSION TO THE QUALIFIED ELECTORS OF SAID CITY AN ORDINANCE RELATING TO THE DEVELOPMENT AND OPERATION OF A CARD CLUB WITHIN SAID CITY r r WHEREAS, pursuant to authority provided by statute a petition has been filed with the legislative body of the City of Lynwood signed by more than ten (10) percent of the number of qualified registered voters of said city supporting a proposed initiative ordinance that would allow the development and operation of a card club project in said City. WHEREAS, the City Clerk of said City has duly examined the petition and from the records of registration ascertained that the petition is signed by the requisite number of voters, and has so certified; and WHEREAS, the City Council of said city is thereupon authorized and directed by statute to submit the Ordinance to the qualified voters; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOW: SECTION 1. That pursuant to the requirements of the laws of the State of California relating to General Law Cities within said State, there shall be placed on the ballot for the general municipal election of the qualified electors of said City to be held in the City of Lynwood, County of Los Angeles, State of California on Tuesday, November 2, 1993, for the purpose of submitting the following proposed ordinance, to wit: / Shall card clubs in which any games permitted/ / by law, such as draw poker, low-ball poker /YES-~ / and panguinge (pan) are played be allowed / J in the City of Lynwood? /No-~ SECTION 2. The proposed ordinance submitted to the voters is as follows: An Ordinance of the people of the City of Lynwood amending the Lynwood Municipal Code to allow for the development and operation of a CARD CLUB PROJECT in said City provided that not less than 16~ of the gross revenues from the operation of said CARD CLUB PROJECT (exclusive of other businesses within the CARD CLUB PROJECT) be allocated to and spent for the following purposes: a. 10~ to the City to be used for any lawful purpose; b. 2~ for educational services, equipment and personnel for the Lynwood Unified School District and the private and parochial schools within the City; c. Z~ for facilities, services, equipment and personnel required for the completion and operation of the Hilton Center for child and senior citizen care; and d. 2~ for social and recreational services offered by the established churches and locally organized clubs within the City. SECTION 3. That the ballots to be used at said election shall be, both as to form and matter contained therein, such as may be required by law to be used thereat. rte- SECTION 4. That in all particulars not recited in this Resolution, said election shall be held and conducted as provided by law for holding municipal elections in said City. SECTION 5. That notice of the time and place of holding said election is hereby given and the City Clerk is hereby authorized, instructed an directed to give such further or additional notice of said election in time, form and manner as required by law. SECTION 6. That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter same in the book of original Resolutions of the said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.
