AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE MUNICIPAL CODE'OF TIFFIN, IOWA, FOR CERTAIN PROPERTY OWNED BY MELVIN REEVE AND HAZEL REEVE AS DESCRIBED IN ATTACHED EXHIBIT "A" BELOW. BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA: Section 1. Purpose. The purpose of this ordinance is to amend the official zoning map of the Municipal Code of Tiffin, Iowa, concerning the property as described on the attached "Exhibit A". Section 2. Amendment. The following legally described property: SEE ATTACHED EXHIBIT "A", hereby incorporated herein, shall be changed from zoning classification: AG Agricultural to classification:RS 2.5 Medium-density Single-Family Residential. AND FURTHER,that the official zoning map of the City be amended to reflect the change described herein. Section 3. Penalty Provision. The city may elect, at its sole discretion, to prosecution any violation either as simple misdemeanor or a municipal infraction. Section 4. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. Section 5. Severability. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole, or any section,provision, or part thereof not adjudged invalid or unconstitutional. Section 6. Effective Date. This ordinance shall be in effect after its final passage, approval, and posting as provided by law. Potter declared the motion carried, and Ordinance No. 2000-2 3 7 , was read the first time and discussed and placed on record. On the 11 thday of October 2000, at-a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilpersoi$artels introduced Ordinance No. 20 00-2 and moved that it be given its second reading. Potter declared the motion carried, and Ordinance No. 2000-237 , was read the second time and discussed and placed on record. Absent: None. `Five members of the council being present and havin voted "Aye", Mayor Glenn R. Potter declared the motion carried, and Ordinance No. 2 U 00-237 0-2 3 7 , was then placed on its last reading and was read the last time. Thereupon, it was moved by Councilperson Ryan and seconded by Councilperson Bartels that Ordinance No. 20002337 be placed upon its final passage and adopted. Ayes: Bartels, Ryan, Walls, Dils and Gericke. Nays: None. Absent: None. Five members of the council being present and having voted "Aye", Mayor Glenn R.Potter declared the motion carried, and the ordinance was passed and adopted. Whereupon the mayor declared that Ordinance No. 200 0-2 37 be adopted and signified his approval of same by fixing his signature thereto.
