Sica at 6:00 P.M. on Thursday, June 12, 1997, Municipal Court / Police Facility, 230 Roosevelt Avenue, Carteret, New Jersey. Coughlin, Frank Raia, and F Leanza, Esq. Mailed to The Home News & Tribune, The Star Ledger and posted on the bulletin board on June 6, 1997. STATEMENT OF MEElING NOTICE To adopt a resolution to go into Closed Session to discuss RCA Agreement and any other business that may come up before the Council. pURPOSE RESOLUTION #97-190 was introduced by the Mayor and was referred to the Council for action. RESOLUTION #97-190 Closed Session Upon MMS&C, by Councilmembers Failace and Bialowarczuk RESOLUTION #97-190 "RESOLUTION TO GO INTO CLOSED SESSION was adopted. Upon individual roll call vote, Councilmembers Bialowarczuk, DuPont, Failace, Fazekas, Feingold and Gutowski voted in the affirmative. Mayor Sica asked Borough Attorney Coughlin about a memo? Borough Attorney Coughlin said it's fTom Special Counsel who is handling litigation regarding Manella. He would recommend that they go into Closed Session to discuss that memo and litigation. RESOLUTION #97-191 was introduced by the Mayor and referred to the Council for action. Upon MMS&C, by Councilmembers Failace and Fazekas RESOLUTION #97-191 RESOLUTION TO GO INTO CLOSED SESSION 1 was adopted. Upon individual roll call vote, Councilmembers Bialowarczuk, DuPont, Failace, Fazekas, Feingold and Gutowski voted in the aftìrmative. JUNE 12, 1997 SPECIAL MEElING ROLL CALL STATEMENT OF MEElING NOTICE PURPOSE DISCUSSION RESOLUTION #97-191 Closed Session Adopted JUNE 12, 1997 ¡,djounred Into Closed Session At approximately 6:52 P.M., the meeting was adjourned into Closed Session. tlEElING OPENED Upon MMS&C, by Councilmembers Failace and Fazekas and unanimous affirmative vote of the full Council present, the meeting was opened at approximately 7:07 P.M.. Borough Attorney Coughlin said they would amend the resolution to include the cancellation ofthe contract between the Borough and Dauman. Mayor Sica said to terminate the 10/1/95 Contract, amend the bid specs to reject all the addendum # 1 roll-oft's and award the contract to Dauman for one (l) year for Alternate #5 and proposal # 1. RESOLUTION #97-192 was introduced by the Mayor and was referred to the Council for action Upon MMS&C, by Councilmembers Failace and Fazekas RESOLUTION #97-192 "RESOLUTION AWARDING BlD-SCA VENGER SERVICES" Adopted was adopted Upon individual roll call vote, Councilmembers Bialowarczuk, DuPont, Failace, Fazekas, Feingold and Gutowski voted in the aftìrmative. Corrnents Borough Attorney Coughlin said, for the record, let it be reflected that they discussed the resolution and the bid specs in consideration of the on going litigation and steps that Special Counsel recommends with regards to the resolution and in addition, the potential for litigation with regard to these bid specs. Clerk's Note The following motions were incorporated in Resolution #97-192. tlotion - Terminate Contract of 10/1/95 ì\lith Dauman Mayor Sica made a motion to terminate the 10/1/95 Contract with Dauman Industries. CouncihnembtT Failace second the motIOn. 2 Upon individual roll call vote, Councilmembers Bialowarczuk, DuPont, Failace, Fazekas, Feingold and Gutowski voted in the affirmative to terminate the 10/1/95 Contract with Dauman Industries Borough Attorney Coughlin said in accordance with the terms of the Agreement dated 10/1/95. Mayor Sica said at this time he would entertain a resolution to award the Scavenger Contract to Dauman Recycling Company, Inc., 33-37 Salt Meadow Road, Carteret, New Jersey, to include Alternate #5, Proposal # 1, Schools #4 - 1 year and to delete Addendum # l-Roll-offs and reject that portion. Councilmember Gutowski said we are not including Proposal #1. We're including Proposal #4. Mayor Sica said we have to include Proposal # 1, although we never use it. Borough Attorney Coughlin said no. We are not considering those. Mayor Sica said he would rephrase it. He said he would entertain a resolution to award the bid to Dauman Recycling for Alternate #5 - 1 year; reject Proposal # 1. It will not be considered Include Schools #4-1 year and reject Addendum #1 - Roll-offs. He made the motion. Councilmember Failace also made the motion. Councilmember Fazekas second the motion. Upon individual roll call vote, Councilmembers Bialowarczuk, DuPont, Failace, Fazekas, Feingold and Gutowski voted in the affirmative. There being no further business or discussion, upon MMS&C, by Councilmembers Failace and Fazekas and unanimous affirmative vote of the full Council present, the meeting was adjourned at approximately 7: 12 PM.
