AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE,
FLORIDA, PROVIDING FOR AMENDMENT OF 1997-1998
FISCAL YEAR BUDGET BY THE TRANSFER OF VILLAGE
FUNDS FROM THE STORMWATER UTILITY FUND AND
FROM THE CAPITAL IMPROVEMENT FUND TO PROVIDE
FOR THE EAST ENID DRIVE IMPROVEMENT PROJECT;
AND PROVIDING FOR THE REPLACEMENT BY THE
GENERAL FUND OF SUCH TRANSFERRED FACILITIES
RESERVE FUNDS IN THE 1999-2000 AND 2000-20001 FISCAL
YEAR BUDGETS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR EFFECTIVE DATE.
WHEREAS, the East Enid Drive improvement program (the "Project") has been previously
approved by the Village Council; and
WHEREAS, the Project provides for much needed drainage, sidewalk, roadway, traffic
calming, and lighting improvements; and
WHEREAS, funds to finance the Project are to be provided from the Capital Improvement
Fund and from the Stormwater Utility Fund; and
WHEREAS, funds on hand in the General Fund are not presently sufficient to fully satisfy
the General Fund share of the Project, but additional funds are available in the Capital Improvements
Fund; and
WHEREAS, it is necessary and appropriate to utilize such additional funds from the Capital
Improvement Fund for the purpose of paying the General Funds' share of the Project cost, with
replacement of such funds back to the Facilities Reserve of the Capital Improvement Fund to be
provided by the General Fund in the 1999-2000 and 2000-2001 fiscal year budgets; and
WHEREAS, the Village Council finds that the adoption of this Ordinance is in the best
interest of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Recitals Adopted. The above stated recitals are hereby adopted by reference and
confirmed herein.
Section 2. Transfer Approved; Budget Amended. That there is hereby approved and
made a transfer of $ 430,000 from the Capital Improvement Fund, and the transfer of $ 330,000
from the Stormwater Utility Fund, for the Project and $ 58,000 from the Safe Neighborhood Act,
so as to fund the Project and enable the General Fund to be charged for providing its appropriate
share of the Project. The 1997-1998 budget adopted by Ordinance 97-24 is hereby accordingly
amended. Further, it is specified that a charge shall be placed and made against the General Fund
revenues, available in the 1999-2000 fiscal year and 2000-2001 fiscal year, for the purpose of
replacement to the Capital Improvement Fund transferred pursuant to this Ordinance.
Section 3. Implementation. That the Village Manager and the Finance Director are
authorized to take all action necessary to implement the provisions of this Ordinance.
Section 4. Severability. The provisions of this Ordinance are declared to be severable and
if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid
or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences,
clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent
that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 5. Effective Date. This Ordinance shall be effective immediately upon passage by
the Village Council on second reading.

will be considered on Second Reading by the Key Biscayne Village
Council at a meeting to be held on Tuesday, September 22, 1998, at
7:00 p.m., in the Council Chamber, located at 85 West McIntyre
Street, Second Floor, Key Biscayne, Florida:
