AN ORDINANCE REGULATING THE USE OF FIREARMS WITHIN THE
CITY OF TIFFIN.
WHEREAS, the City of Tiffin has determined that certain portions of the City are
essentially agricultural in nature or remain wooded and non-residential, and
WHEREAS, Iowa Code §724.4(4) (g) allows possession and use of a loaded firearm
within a city "while the person is lawfully engaged in target practice on a range designed for
that purpose or while actually engaged in lawful hunting."
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:
Section 1. Target Range: Any person or entity seeking to operate a target practice
range or gun club in the City shall notify the Clerk annually of the intent to operate such a
business or club. Zoning for such an operation shall be A-1 and shall be considered as a
recreational area within that zone. The operator of such an establishment shall abide by all
other federal, state, and city laws and regulations regulating the use of firearms.
Section 2. Hunting:_Hunting shall be allowed in areas zoned A-1 (Agricultural)
upon application by the landowner to allow hunting on the property. Permission shall be •
granted unless such activity would be expected to violate any federal or state law or
regulation governing the use of firearms or hunting, including, but not limited to, the
provisions of Iowa Code §481A.123 (1999). The landowner shall clearly mark those areas
upon which hunting is requested.
Section 3. Penalty Provision. The city may elect, at its sole discretion, to
prosecution any violation either as simple misdemeanor or a municipal infraction.
Section 4. Repealer. All ordinances or parts of ordinances in conflict with the
provisions of this Ordinance are hereby repealed.
Section 5. Severability. If any section, provision, or part of this ordinance shall be
adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of
the ordinance as a whole, or any section, provision, or part thereof not adjudged invalid or
unconstitutional.
Section 6. Effective Date. This ordinance shall be in effect after its final passage,
approval, and posting as provided by law.
On the 8th day of November 2000, at a regular meeting of the Tiffin City
Council, Tiffin, Iowa, Councilperson Ryan introduced Ordinance No.
2000-239 , and moved that it be given its first reading. The motion was seconded by
Councilperson Dils

Five members of the council being present and having voted "Aye", Mayor Glenn
R. Potter declared the motion carried, and Ordinance No. 2000-239 , was read the first
time and discussed and placed on record.
Thereupon, it was moved by Councilperson Ryan and seconded by
Councilperson Di 1 Di 1 s that the laws and rules providing
that ordinances be considered and voted on for passage at two council meetings prior to the
meeting at which ix is to be finally passed be suspended and dispensed with and that
Ordinance No. 0 0-
239 be placed on its last reading.
Ayes: Ryan, Bartels, Gericke, Dils and Walls.
Nays: None.
Five members of the council being present and having voted "Aye", Mayor Glenn
R. Potter declared the motion carried, and Ordinance No. 2 0 0 0-2 3 9 , was then placed
on its last reading and was read the last time.
Thereupon, it was moved by Councilperson Ryan and
seconded by Councilperson ckc that Ordinance No.
2000-239 be placed upon its fr inal passage and adopted.

Five members of the council being present and having voted "Aye", Mayor Glenn
R. Potter declared the motion carried, and the ordinance was passed and adopted.
Whereupon the mayor declared that Ordinance No. 2 0 0 0-2 3 9 be
adopted and signified his approval of it by fixing his signature thereto.
