AN ORDINANCE AMENDING SUBDIVISION ORDINANCE 1998-218,TO DEFINE
THE DEVELOPER'S RESPONSIBILITY OF COSTS IN THE INSTALLATION OF
WATER AND SEWER MAIN AND TO DEFINE WHAT IS ACCEPTABLE PARK AND
OPEN SPACE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TIFFIN, STATE OF IOWA:
Section 1: PURPOSE. The purpose of this ordinance is to amend the City's Subdivision
Ordinance to define the developer's responsibility of casts in the installation and size of water
and sewer main in areas of new development and to define what is acceptable park and open
space.
Section 2: AMENDMENT. City of Tiffin, Subdivision Ordinance, Article 3.03 Minimum
Improvements, Section D Water Main System in General, Subsection 3, is hereby repealed in
full and adopted to read as follows:
D) Water Main System in General:
3. Refer to the City of Tiffin, Iowa Design Standards.
• Section 3: AMENDMENT: City of Tiffin, Subdivision Ordinance, Article 3.03 Minimum
Improvements, Section B Sanitary Sewer System in General, Subsection 1, is hereby repealed in
full and adopted to read as follows:
B) Sanitary Sewer System in General:
1. Refer to the City of Tiffin, Iowa Design Standards.
Section 4: AMENDMENT: City of Tiffin SubdivisionlOrdinance, Article 4.08 Parks and Open
Space, Section A, Subsection 1, is hereby amended to include:
Land area below the detention basin 100 year wetted elevation plus three feet of
freeboard shall not be included in the calculation of the required 5% reservation for parks
and open space of the proposed development.
Section 5: REPEALER. All ordinances or parts of ordinances in conflict with the provisions of
this ordinance are hereby repealed.
Section 6: SEVERABILITY CLAUSE. If any section, provision or part of this ordinance shall
be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the
ordinance as a whole or any section, provision or part thereof not adjudged invalid or
unconstitutional.
Section 7: WHEN EFFECTIVE. This ordinance shall be in effect from and after it final
passage, approval and publication as provided by law.°'

On the 13th day of December , 2000 at a regular meeting of the Tiffin City
Council, Tiffin, Iowa, Councilperson Ra r t P l G introduced Ordinance No.
2 0 0 0-240 , and moved that it be given its first reading. The motion was seconded by
Councilperson OP r;rice •
Ayes: Bartels, Dils, GEricke, Ryan
Nayes: None. Absent: Walls
Four members of the council being present and having voted"Aye", Mayor Glenn Potter
declared Motion carried, and Ordinance No. 2000-24 vas read the first time and placed on
record.
Thereupon, it was moved by Councilperson Gericke and seconded by
Councilperson Ryan that the laws and rules providing that ordinances be
considered and voted on for passage at two council meetings prior to the meeting at which it is to
be finally passed be suspended and dispensed with and that Ordinance No2 0 0 0-2 4 0 be
placed on its last reading.
Ayes: Gericke, Bartels, Dils, Ryan
Nayes: None. Absent: Walls
Four members of the council being present and having voted"Aye", Mayor Glenn Potter
declared Motion to be carried, and Ordinance No.200-2 4 n was then placed upon its last
reading and was read the last time.
Thereupon, it was moved by Councilperson Gericke and seconded by
Councilperson Bartels that Ordinance No.2 0 0 0-240 be placed on its final
passage and adopted. Ayes: Bartels, Ryan, Dils, Gericke, . Absent: Walls
members of the council being present and having voted"Aye", Mayor Glenn Potter
declared the Motion carried, and Ordinance passed and adopted.
Whereupon the Mayor declared that Ordinance No.2 0 0 0-2 4 0 be adopted and signified his
approval of the same by fixing his signature thereto.

ORDINANCE AMENDING SUBDIVISION ORDINANCE 1998-218,TO DEFINE THE
DEVELOPER'S RESPONSIBILITY OF COSTS IN THE INSTALLATION OF WATER
AND SEWER MAIN AND TO DEFINE WHAT IS ACCEPTABLE PARK AND OPEN

and published on the 19th day of December , 2000 by posting copies thereof in three
public places within the limits of the City of Tiffin, Iowa.
