NO. 49964E4 (ZONING ORDINANCE) OF TI-IE MUNICIPAL CODE OF TIFFIN, IOWA, REGARDING SETBACK REQUIREMENTS FOR CERTAIN PROPERTIES ADJACENT TO U.S. HIGHWAY 6 REGARDLESS OF THEIR ZONING CLASSIFICATION A BE IT ENAC l'ED BY THE CITY COUNCIL OF TIFFIN, IOWA: 1. 1` 9682041 9 Section 1. Purpose. The purpose of this ordinance is to amend Ordinance No. , of the Municipal Code of Tiffin, Iowa, so as to increase the requirements of the minimum front yard setback requirements for certain properties abutting U.S. Highway 6 beginning at the east line of Main Street to a point 233 feet, more or less, west of the intersection with Roberts Ferry Road and Highway Six., Section 2. Amendment. City of Tiffin Ordinance.No. 1W"t�ie following language is repealed as it appears under each zoning classification wherein the minimum yard y requirements are stated: MINIMUM YARD REQUIREMENTS: "Any lot adjacent to U.S. Highway 6, in any way, shall be required to have a twenty foot setback in addition to the minimum yard requirement Y stated herein." , , t . The following language shall be inserted in lieu thereof: MINIMUM YARD REQUIREMENTS: "Any lot adjacent to U.S. Highway 6, in any way, shall be required to have a'twenty foot setback in addition to the minimum yard requirement' stated herein, except those properties that are located adjacent to Highway 6 beginning at the east line of Main Street to a point 233 feet, more or less, west of the intersection with Roberts Ferry Road and Highway Six,which shall be required to have a thirty-two foot setback,in • addition to the minimum yard requitement stated herein. Section 3. Repealer. All ordinances, or parts of ordinances in conflict with the z . provisions of this Ordinance are hereby repealed. Section 4. Severability. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision, or part thereof not adjudged invalid or unconstitutional. i Document7 Last printed 03/14/01 2:46 PM kd • • • Ordinance No. 2001 -243 Page 2 Section 5. Effective Date. This ordinance shall be in effect after its final passage, approval, and posting as provided by law. On the 14th day of March 2001, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Bar to l s introduced Ordinance No. 20 01 -24 3 , and moved that it be given its first reading. The motion was seconded by Councilperson Ryan Ayes: Ryan, Walls, Dils and Bartels Nayes: Gericke None. Absent: Gericke. Foumembers of the council being present and having oted "Aye",Mayor Glenn R.Potter 1 declared the motion carried, and Ordinance No. 2001 -243 , was read the first time and discussed and placed on record. At a regular meeting of the Tiffin City Council on June 13, 2001 it was moved by Councilperson Dils and seconded by Councilperson Bartels that the laws and rules providing that ordinances be considered and voted on for passage at two council meetings prior to the meeting at which it is to be finally passed be suspended and dispensed with and that Ordinance No. 2001-2 4 3 be placed on its last reading. -F Ayes: Bartels, Walls and Dils Nays:None. Absent: Ryan and Gericke Thrmbers of the council being present and having voted "Aye",Mayor Glenn R. Potter declared the motion carried, and Ordinance No. 2001 -243 ., was then placed on its last reading and was read the last time. Thereupon, it was moved by Councilperson Dils and seconded by Councilperson walls that Ordinance No. 2001-243 be placed upon its final passage and adopted. Ayes: Walls, Dils and Bartels. Nays: None. Absent: Gerickc and _Ryan Thrfmbers of the council being present and having voted "Aye",Mayor Glenn R. Potter declared the motion carried, and the ordinance was passed and adopted. Whereupon the mayor declared that Ordinance No. 2001 -24 3 be adopted and signified his approval of same by fixing his signature thereto.
