HomeMy Public PortalAboutResolution 83-2164RESOLUTION NO. 83 -2164 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING ITS INTENTION TO ORDER THE 1983 -84 FISCAL YEAR LEVY FOR THE CITY -WIDE LIGHT- ING DISTRICT, PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972; AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS THERETO WHEREAS, the City Council, by Resolution No. 79 -1825 formed an Assessment District pursuant to the provisions of the Landscaping and Lighting Act of 1972 (Part 2, Division 15 of the California Streets and Highways Code); and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience requires and it is the intention of the City Council of the City of Temple City to levy an assessment for fiscal year 1983 -84 for the City Lighting Dis- trict within which the following work is to be done; to wit: 1. Maintenance, replacement, and servicing of street lighting. 2. Any and all work and materials appurtenant thereto. In addition, said district is to be formed to levy and collect assess- ments for said work in accordance with the Act hereinafter designated. SECTION 2. The foregoing described work is to be located within streets and easements within said Assessment District, the boundary of which is more particularly described as the City boundary of the City Iof Temple City as the same is on file in the Office of the City Clerk of the City of Temple City, County of Los Angeles, State of California, at the date of-approval of this Resolution. SECTION- 3. That the contemplated work, in the opinion of said City Council is of benefit to and the said City Council hereby makes the expense of the said work chargeable upon the Temple City Lighting District, which said district is assessed to pay the costs and expenses thereof, and which district is described as follows: All that certain territory of the City of Temple City, exclusive of public streets within the corporate boundary of Temple City as the same exists on the date of adoption of this Resolution. SECTION 4. Reference hereby is made to the report of the Engineer on file with the City Clerk and open to inspection, for a full detailed description of the improvements, the boundaries of the Assessment Dis- trict and any zones therein and the proposed assessments upon assess- able lots and parcels of land within the district. SECTION 5. Notice is hereby given that on the 7th day of June, 1983, at the hour of 7:30 p.m. in the Council Chamber of the City Hall, Temple City, California, any and all persons having any objections to Ithe work or extent of the assessment district, may appear and show cause why said work should not be done or carried out or why said district should not be formed in accordance with this Resolution of Intention. Protests must be in writing and must be filed with the City Clerk prior to the conclusion of the hearing. Any such protest shall state all grounds of objection and if filed by a property owner shall contain a description sufficient to identify the property. SECTION 6. All the work herein proposed shall be done in accordance with the Landscaping and Lighting Act of 1972, being Part 2 of Division 15 of the Streets and Highways Code of the State of California. The City Clerk shall cause notice of the hearing to be given by causing the Resolution of Intention to be published and posted in the manner required by Part 2 of Division 15 of the Streets and Highways Code. APPROVED and ADOPTED this 17th day of May, 1983.
