A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LYNWOOD ESTABLISHING A BAIL SCHEDULE FOR
VIOLATIONS OF THE MUNICIPAL CODE
WHEREAS, the City Council of the City of Lynwood has
heretofore adopted an ordinance amending section 1-5 of the Code
of the City of Lynwood authorizing violations of the Municipal
Code to be charged as infractions; and
WHEREAS, it is necessary and desirable for the City to
establish a bail schedule for violations of the Municipal Code
charged as infractions for adoption pursuant to Penal Code
Section 1267b.
NOW, THEREFORE, The City Council of the City of
Lynwood does RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Lynwood
does hereby recommend that bail for each offense in violation of
the provisions of the Lynwood Municipal Code charged as an
infraction, be as follows:
a. $50.00, plus penalty assessment, for a first
violation;
b. $100.00, plus penalty assessment, for a second
violation of the same provision within twelve
(12) calendar months;
c. $250.00, plus penalty assessment, for each
additional violation of the same provision of the
Lynwood Municipal Code within twelve (12)
calendar months.
SECTION 2. In no event shall bail be less than the
amount designated by the judges of the court as appropriate for
all offenses not specifically listed in the country-wide bail
schedule provided for in Penal Code Section 1269b.
SECTION 3. The City Clerk shall certify to the
adoption of this resolution.
SECTION 4. Upon certification of the adoption of
this resolution by the City Clerk, this resolution shall be
submitted immediately to the Compton Municipal Court for
adoption.
