AN ORDINANCE AMENDING THE ORDINANCE NO. 1980-92 2(40-236
(WEEDS AND NOXIOUS GROWTHS) OF THE MUNICIPAL CODE
OF TIFFIN, IOWA:
BE IT ENACTED BY THE CITY COUNCIL OF '1114FIN, IOWA:
Section 1. Purpose. The purpose of this ordinance is to amend Ordinance
No. 1980-92 (Weeds and Noxious Growths) of the Municipal Code of Tiffin, Iowa, by
adding provisions for: 1) personal service of notices; 2) deadlines for compliance; and 3)
penalty provisions concerning weeds and noxious growths.
Section 2. Amendments. City of Tiffin Ordinance No. 1980-92, is hereby amended
as follows:
1. SECTION N. Method of Notice is hereby repealed and
the amended Section IV shall read as follows:
SECTION IV. Method of Notice. The notice to destroy
or cut shall be by personal service or certified mail.
2. SECTION V. Destruction or Cutting by Municipality is
hereby repealed and the amended Section V shall read as
follows:
SECTION V. Destruction or Cutting by Municipality.
Within three (3) days of service of notice to destroy or cut, if
the person so notified, neglects or fails to destroy or cut the
weeds and growths specified therein as directed,the Mayor or
other officers initiating the notice, may cause the weeds and
growths specified therein to be destroyed or cut, keeping an
accurate account of the expenses incurred. The expense
account shall be fully itemized, verified, and filed with the
City Clerk. Such expenses shall be paid by the municipality.
3. SECTION VII. Penalty is hereby repealed and the amended
Section VIII shall read as follows:
SECTION VIII. Penalty Provision. The City may elect, at
its sole discretion,to prosecution any violation either as simple
misdemeanor or a municipal infraction.

Section 3. Penalty Provision. The City may elect, at its sole discretion, to prosecute
any violation either as a simple misdemeanor or municipal infraction.
Section 4. Repealer. All ordinances or parts of ordinances in conflict with the
provisions of this Ordinance are hereby repealed.
Section 5. Severability. If any section, provision, or part of this ordinance shall be
adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of
the ordinance as a whole, or any section, provision, or part thereof not adjudged invalid or
unconstitutional.
Section 6. Effective Date. This ordinance shall be in effect after its final passage,
approval, and posting as provided by law.
On the 11t day of July 2001, at a regular meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson Bartels introduced Ordinance No2 poi -2 4 8 , and moved
that it be given its first reading. The motion was seconded by Councilperson

Ayes: Dils, Bartels, Walls.
Nays: None. Absent: Gericke - Ryan
Thrslembers of the council being present and having voted "Aye",Mayor Glenn R. Potter
declared the motion carried, and Ordinance No. 2001 -248 , was read the first time and
discussed and placed on record.

Thereupon, it was moved by Councilperson and seconded by
Councilperson Bartels that the laws and rules providing
that ordinances be considered and voted on for passage at two council meetings prior to the
meeting at which it is to be finally passed be suspended and dispensed with and that
Ordinance No. 2001 -248 be placed on its last reading.
Ayes: Walls, Dils and Bartels.
Nays: None. Absent: Gericke and Ryan
Three members of the council being present and having voted"Aye",Mayor Glenn R.Potter
declared the motion carried, and Ordinance No.2 0 01-2 4 8 , was then placed on its last
reading and was read the last time.
Thereupon, it was moved by Councilperson Dils and seconded by
Councilperson Walls that Ordinance No.
2001 -248 be placed upon its final passage and adopted.
Ayes: Bartels, Walls and Dils.
Nays: None. Absent: Gericke and Ryan.

Three members of the council being present and having voted "Aye",Mayor Glenn R.Potter
declared the motion carried, and the ordinance was passed and adopted.
Whereupon the mayor declared that Ordinance No. 2001 -2 4 8 be adopted and
signified his approval of same by fixing his signature thereto.
Passed by the council on the 11th day of July 2001 and approved by the mayor`on the 11th
day of July 2001.

I, Clerk of the City of Tiffin, Iowa, state that an 'ordinance entitled AN ORDINANCE
AMENDING THE ORDINANCE NO. 1980-92 (WEEDS AND NOXIOUS
GROWTHS) OF THE MUNICIPAL CODE OF TIFFIN, IOWA , and known as No.
2 0 01 -24 8 was duly passed by the council on the 11th day of July 2001, and signed by
the mayor on the 11th day of July 2001, and published on the 1 8 th day of
July 2001, by posting copies thereof in three public places within the limits
of the City of Tiffin,Iowa.
