A RESOLUTION OF THE CITY OF LYNWOOD APPROVING
REIMBURSEMENT TO M+D PROPERTIES FOR UTILITIES PAID
FOR THE LYNWOOD SHERIFF'S YOUTH ATHLETIC LEAGUE PROGRAM
WHEREAS, M+D Properties (Lynwood Marketplace) has allowed the
City of Lynwood to use the property at 3100 E. Imperial Highway,
known as the "Automotive Center" or Lynwood Sheriff's Youth
Athletic League Building, free of rent for a period of 48 months,
from April, 1990 through April, 1994, for the purpose of the
Lynwood Sheriff's Youth Activity League program; and
WHEREAS, M+D Properties has not agreed to pay for the
utilities used by the Lynwood Sheriff's Youth Athletic League
program; and
WHEREAS, M+D Properties has paid for utilities used by the
Lynwood Sheriff's Youth Athletic League program over the period of
April, 1990 through February, 1993; and
WHEREAS, M+D Properties requests reimbursement of utilities
paid;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. The City of Lynwood shall Reimburse M+D Properties for
utilities used by the Lynwood Sheriff's Youth Athletic League.
Section 2. The amount of utilities used by the Lynwood Sheriff's
Youth-Athletic League program has been determined by an accurate
method to the satisfaction of the City Manager.
Section 3. The dollar amount of the reimbursement must not exceed
$50,330 and may be paid in 6 equal monthly payments from the
General Fund Account with an additional $10,595 to be kept in
reserve in the event that M+D provides documentation to
substantiate a higher rate.
PASSED, APPROVED and ADOPTED this 17th day of August 1993.
