AN ORDINANCE AMENDING SUBDIVISION ORDINANCE NO. 1998-218
REGARDING NOTICE, TO PROPERTY OWNERS WITHIN 200 FEET OF
PROPERTY PROPOSED FOR SUBDIVISION.
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:
Section 1. Purpose. The purpose of this ordinance is to amend Ordinance No.
1998-218 (Subdivisions) Section 5.07(C) to require notification to owners of property within
200 feet of property proposed for subdivision.
Section 2. Amendment. City of Tiffin Ordinance No. 1998-218 (Subdivision),
Section 5.07(C) shall have the following language inserted at the end of Paragraph C:
Before any action is taken by the city council do any
subdivision application, the City Clerk shall set the
matter for public hearing with at least seven (7) days'
notice of the time and place of such hearing given
according to the requirements for public hearings in the
Iowa Code for cities the size of Tiffin. Further, written
notice of the public hearing shall be mailed by the City
Clerk at least seven (7) days prior to the hearing, to all
property owners within a radius of 200 feet from the
property proposed for subdivision. For purposes of
notification, ownership of the adjacent properties will be
verified with official records of Johnson County. A _

Section 5. Severability. If any section, provision, or part of this ordinance shall be
adjudged to be invalid or unconstitutional, such adjudication shall not affect'the validity of
the ordinance as a whole, or any section, provision, or part thereof not adjudged invalid or
unconstitutional.
Section 6. Effective Date. This ordinance shall be in effect after its final passage,
approval, and posting as provided by law.
On the 12th day of September 2001, at a regular meeting of the Tiffin City Council, Tiffin,
Iowa, Councilperson Bartels introduced Ordinance No. 2001 - 250 , and
moved that it be given its first reading. The motion was seconded by Councilperson
