AN ORDINANCE ESTABLISHING PROVISIONS FOR THE REMOVAL OF
SNOW AND ICE FROM THE CITY STREETS AND ESTABLISHING AN
EMERGENCY ROUTE AND PROHIBITING PARKING OF CARS ON
CERTAIN STREETS
BE IT ENACTED BY THE CITY OF TIFFIN, IOWA;
Section 1. Purpose. The purpose of this ordinance is: 1)to provide a procedure
for the efficient removal of snow from the city streets; 2)to establish an emergency snow
route; 3)to allow and prohibit the parking of vehicles on city streets and 4)to establish
the procedure for removal of vehicles in violation.
Section 2. Removal of Snow Procedure. The city will begin snow plowing or ice
removal immediately after it has stopped snowing or sleeting. However, at the discretion
of city officials,plowing of emergency routes may begin after sufficient notice has been
provided as outlined below. The priority of clearing city streets shall be as follows: 1)
the emergency route; 2) the streets and intersections; 3)the alleys; and 4) the parks.
The snow shall be pushed back as far as possible from the streets; edges to allow vehicles
to park as close to the property line as possible. The snow plowing may create a snow
pile in driveways that cannot be prevented and further, the city shall not be responsible
for the removal of this snow. Property owners should act responsibly as to the removal
of the snow piled in their driveways by the city plows and should not push the snow back
into the city streets where it will create a hazard as a compacted and frozen snow or ice
f patch. Sanding of icy streets will begin at the city's discretion and sanding also may
follow the plowing of snow from the streets.
Section 3. Declaration of Snow/Ice Emergency. A declaration of a snow or ice
emergency shall be determined by city officials'on the basis of falling,snow, sleet,
freezing rain or a forecast by the weather bureau or other weather conditions that make it
necessary that motor vehicle traffic, including emergency vehicles be expedited and that
parking on certain streets be prohibited or restricted for snow plowing or sanding
purposes. An emergency declaration shall take effect not earlier than four hours after it is
declared, except if it is declared after 8:00 PM in which case it shall not take effect until
at least nine o'clock AM the next day. City officials shall give a written declaration to
the city clerk which states the beginning and ending time for the emergency declaration.
It is provided however,the declaration may be cancelled or changed by the same
procedure. The city clerk shall inform area radio and television stations and local
newspapers as delineated by resolution of the city council and shall ask for a public
service announcement. The city officials shall post signs on all"emergency routes" so

designated by resolution of the city council. "Emergency routes" shall be posted at
approximately two block intervals as is possible along the emergency route: Public,
announcement method and "emergency routes"may be designated and changed by order
of the city council from time to time as deemed necessary.
Section 4. Parking of Vehicles on Streets During Ice/Snow Weather and
Provision for Violation. In order to provide an emergency routed during ice or snow
storms, certain streets shall be considered as"emergency routes"and shall be designated
by resolution of the city council. Designated"emergency routes" shall be the first streets
to be cleared. Parking of vehicles on any city streets shall be prohibited four hours after a
declaration of emergency, except if the declaration is after 8:00 PM in which case it shall
not take effect until at least nine o'clock AM the next day. On all streets where parking
is allowed on both sides, vehicles shall be parked on only the even street-numbered side
- of the street on even days of the month after 8:00 am. On streets where parking is
allowed on both sides, vehicles shall be parked only on the odd street-numbered side of
the street on odd days of the month after 8:00 AM All other parking regulations and
prohibitions shall remain in effect. Any vehicle found to be parked where not permitted
during a declaration of emergency may be towed to a place where parking is permitted or
to a designated place for storage as determined by city officials. Such towing costs shall
be assessed to the owner of the vehicle towed.
Section 5. Penalty Provision. The cit may elect, at its sole discretion,to
prosecute any violation either as simple misdemeanor or a municipal infraction.
Section 6. Repealer. All ordinances or parts of ordinances in conflict with the
provisions of this Ordinance are hereby repealed.
Section 7. Severability. If any section,provision, or part of this ordinance shall
be adjudged to be invalid or unconstitutional, such adjudication shall not affect the
validity of the ordinance as a whole, o'r any section,provision, or part therof not adjudged
invalid or unconstitutional.
Section 8. Effective Date. This ordinance shall be in effect after its final passage,
approval, and posting as provided by law.

On the 10th day o f April ,2002 at a regular meeting of[f the Tiffin City
Council,Tiffin,Iowa,Councilperson Shaffer introduced Ordinance No.
2002-251,and moved that it be given its first reading; The motion was seconded by
Councilperson Di l s

Four members of the council being presentand having voted"Aye",Mayor Glenn Potter
declared Motion carried,and Ordinance No?0 02-251 was read the first time and placed on
. record.
Thereupon,it was moved by Councilperson Di 1 s and seconded by
Councilperson s that the laws and rules providing that ordinances be
considered and voted on for passage at two council meetings prior to the meeting at which it is to
be finally passed be suspended and dispensed with and that Ordinance No.2 0 0 2-2.51 be
placed on its last reading.

declared Motion to be carried,and Ordinance Not 0 02-251 was then placed upon its last -
reading and was read the last time.
Thereupon, it was moved by Councilperson Gericke and seconded by .
Councilperson Bartels that Ordinance Not 0 0 2-2 51 be placed on its final
passage and adopted.
Four members of the council being present and having voted"Aye",Mayor Glenn Potter
declared the Motion,carried,and Ordinance passed and adopted.

Whereupon the Mayor declared that Ordinance Not 0 0 2-251 be adopted and signified his
approval of the same by fixing his signature thereto. .

I, Clerk of the City of Tiffin, Iowa, state that an ordinance entitled,AN ORDINANCE
ESTABLISHING PROVISIONS FOR THE REMOVAL OF SNOW AND ICE FROM
