HomeMy Public PortalAbout90-112 (07-03-90)RESOLUTION NO. 90-112 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING RESOLUTION # 90-75 WHICH AMENDS SECTION 1-5 AND ESTABLISHED A BAIL SCHEDULE FOR VIOLATIONS OF THE MUNICIPAL CODE WHEREAS, the City Council of the City of Lynwood has heretofore adopted an ordinance amending section 1-5 of the Code of the City of Lynwood authorizing violations of the Municipal Code to be charged as infractions; and WHEREAS, Resolution No. 90-75 establishing a bail schedule for violations of the Municipal Code charged as infractions was adopted on May 15, 1990 pursuant to Penal Code Section 1269b; and WHEREAS, the different classifications of Code violations have necessitate separate treatment pursuant to Penal Code Section 1464a. NOW, THEREFORE, The City Council of the City of Lynwood does RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Lynwood does hereby recommend that bail for each offense in violation of the provisions of the Lynwood Municipal Code charged as an infraction, with the exception set forth herein, be as follows: a. $50.00 for a first violation; b. $100.00 for a second violation of the same provision within twelve (12) calendar months; ~ c. $250.00 for each additional violation of the same provision of the Lynwood Municipal Code within twelve (12) calendar months. SECTION 2. The bail for violations of the street vending, peddling, and/or soliciting on the public streets is recommended to remain in the amounts previously fixed, $100.00 for each violation. SECTION 3. A penalty assessment shall be added to the bail amount for each violation with the exception of parking, pedestrian and bicycle violations pursuant to Penal Code Section 1464a. SECTION 4. In no event shall bail be less than the amount designated by the judges of the court as appropriate for all offenses not specifically listed in the county-wide bail schedule provided for in Penal Code Section 1269b. SECTION 4. The City Clerk shall certify to the adoption of this resolution. Upon certification of the adoption of this resolution by the City Clerk, this resolution shall be submitted immediately to the Compton Municipal Court for adoption.
