A Regular Meeting of the Mayor and Council of the Borough of
Carteret was called to order by Mayor Peter 1. Sica at 7:30 P.M.,
Municipal CourtlPolice Facility, 230 Roosevelt Avenue, Carteret,
New Jersey, on Thursday, November 18, 1997.

Mayor Sica commented on the School Crossing Guards, that they are
only doing this if they ratified their contract. If they don't ratify it they
will change it.
Georgia Barron, Crossing Guard commented that this was not
binding.
Mayor Sica said no, they put the money in there so we can take it
into this year's budget.

Councilmember Feingold said he had questions on this. He said they
are transferring $5000.00 to the Police for S&W (salary and wages)
and $30,000.00 to Fire. He said he is concerned about the Police.
We had $90,000.00 in there this year and now it appears that we need
another $45,000.00. He questioned what happened to the
$90,000.00. He asked Councilmember Failace if he could answer
that since he is the head of Finance. He asked if the money was
spent.
Councilmember Failace said they spent an extensive amount of
overtime both in Fire and Police, A portion of this is also because
they are running the payroll at the end of the year and two days of
next year will probably go into this year because of a holiday. That is
approximately $40,00000 of the total. The other transfers will
happen throughout the year.
Councilmember Feingold said it seems to him that there has been a
serious underestimation of what the Police would be costing this
year and if we don't have enough to pay the Police this year and an
arbitrator gives them, lets say 3%, we will have to make it up in next
year's budget, so it looks like there will be a big fat tax increase next
year.
Councilmember Failace said he didn't think there would be a tax
increase, but yes, if we do that we will have to make it up.
Mayor Sica said it is very disheartening because it looks like almost
every Salary and Wage Account has been underestimated some how.
Councilmember Failace said a good portion of it is because they are
moving those couple of days to 1998 in order to facilitate (inaudible).
Mayor Sica said he understood that but $2000.00 in Board of
Health, $12,000.00 in Buildings and Grounds , $2000.00 in
Inspection of Buildings, $2000.00 in the Garage, $8000,00 in Sr.
Citizen Transportation and $20,00000 he guesses in Parks. All of
them had a surplus built in them for salaries so the actual numbers
here that we are transferring are somewhat larger because of the
money that they spent that was in there for raises. He said we should
sit down next week and look at where we are at with this budget

going to be using up a lot of our surplus, what happens next year, if
in fact we have to give the raises. If we don't have enough surplus in
this years budget to do that then it will have to be raised by taxes
and the problem happens if an arbitrator gives a three percent raise
for this year and next year then you have a cumulative raise of six and
one quarter percent, so he is saying it is time that we sit down and
look at the budget and in if it is going to be tight 'we are going to
have to cut back on some of our expenses.
Councilmember Failace said he wants to speak to Patrick to put
everything together for us as soon as we can so we can sit down.
Mayor Sica said he thinks we should do it as early as next week
because what it means is that if we have to put off buying something
and put up with the bare necessities until January 1st when we get
back to a temporary budget, hopefully, to save some surplus to
overcome whatever raises that the employees are going to get. He
spoke again on what would happen if they should get, for instance,
a 3% raise. He said this could be a potential problem.

Mayor Sica said just for everyone's knowledge that means we are
looking at putting two (2) more pieces of property that has been
desolate and obsolete since Carteret was the Borough of Roosevelt
Nothing has ever been built on it. We are looking to put them into
zones where we can offer some kind of a tax incentive similar to what
we have done with the AMAX, White Rose, D.B. Brown, etc. The
reason we are doing this is we already have businesses that want to
locate in Carteret and will come here if we do this. For everyone's
knowledge a huge refiigerated rreeze{ warehouse that was built down
at AMAX Property. A hundred and sixty thousand square foot,
twenty million dollar building, was leased out today in its entirety.
He commented that another similar one may be built there rrom D.

Mayor Sica said the reason why they are trying to get that done
tonight is because the Etheridge Drive Pump Station is causing a
tremendous problem in the City ofCarteret It is probably costing the
city of Carteret in the past six (6) monthsm, thirty thousand dollars
or better, just to keep the pipe together and he told Attorney
CougWin that is imperative that we get the project underway, so we
have to get that easement from that company there in the works
because if we don't get that going this line will continue to faiL He
spoke on this shortly.

The Clerk stated that she was in receipt of a communication from the
Middlesex County Planning Board concerning the City of South

to include Playgrounds and Recreation Facilities. It was ordered to

BUILDINGS & GROUNDS: Committee Chairperson Bialowarczuk
reported Progress and she wished everyone a Happy Thanksgiving
for the following week.
FINANCE & ADMINISTRATION: Committee Chairperson Failace
said we had our tax sale yesterday and we sold everything. It totaled
about a quarter of one million dollars. He also commented that they
will be discussing the Budget.
FIRE: Committee Chairperson Fazekas said they had to hold up on
the truck because of the Chassis.They will be looking at that. Also it
seems the roof may be getting fixed and he feels really good about

Councilmember Fazekas said on December 13th they are going to
have an Open House from 11:00 a.m. to 2:00 p.m. and he hopes
everyone will show up. It is belated because of the problems they
have been having with people that have been sick and he wished the
people that have been sick welL He said with that they are moving
along.
PARKS & RECREATION: Committee Member Gutowski said the
Recreation Commission is sponsoring the Tree Lighting Ceremony
in the park on December 5th. He said Ms. Hedesh will be taking care
of the House Decoration Contest. He then commented that there are
three (3) Birthdays in the house, Councilmember Bialowarczuk,
Kathleen Barney and former Councilmember John Vbsey. All present
wished them a Happy Birthday
POLICE: Council Chairperson DuPont said they had an (inaudible)
meeting here last week and as usual equipment and personal
dominate the discussion. They also talked about the budget
PUBLIC WORKS: Committee Chairperson Failace said the Mayor
had already explained about the problem they had with the sewer
over the weekend and that is our first pri:¡rity for the new year, our
Sabo Pump Station, where we have problems. It is going to cost us
a lot more money as we go along. He then mentioned that last week
they had a meeting with Grant Writers that we hired and the
Department Heads and some Councilmembers. We are looking for
money that is out there. We asked them for a Wish List on anything
and everything that they want The Grant Writer is going to look for
it. He said God Willing we will make a few hundred thousand
dollars. He reported progress.
MUNICIPAL GARAGE SERVICES: Committee Chairperson
Feingold reported progress.

necessitates a world wide effort to increase communication

WHEREAS, UNAIDS estimates that 21.8 million people are
currently living with HlV / AIDS with children under the age of 15
years accounting for 830,000 of the cases; and
WHEREAS, the American Association for World Health is
encouraging a better understanding of the challenges ofHlV/AIDS
nationally as it recognizes that the number of people diagnosed with
HIV and AIDS in the United States continues to increase with
581,429 AIDS cases reported (as of December 31, 1996); and
WHEREAS, World AIDS Day provides an opportunity to focus on
HlV infection and AIDS, caring for people with HlV infection and
AIDS and learning about HlV/AIDS; and
WHEREAS, the 1997 World AIDS Day theme "Give Children Hope
in a World with AIDS" (a) urges the world to contemplate the long-
telID repercussions of the AIDS andemic (b) recognizes that everyone
can do something about the epidemic through prevention, education
and compassion and (c) er.¡phasizes the hope of finding the means to
prevent and cure HIV/AIDS in the ultimate prospect of minimizing
the impact of epidemic on children, their families and their
communities;
THEREFORE, I, Peter J Sica, Mayor of the City of the Borough of
Carteret do hereby declare
DECEMBER I, 1997, as WORLD AIDS DAY

and urge all citizens to take part in activities and observances
designed to increase awareness and understanding ofHIV/AIDS as
a global effort to prevent the further spread of HIV/AIDS.
Mayor Sica said he thinks it is a very worthy thing and that
everybody should be aware of the problems of this dreaded disease
for not only the person, but their family and society in general. It is
a terrible burden to carry when people get Aids. We have to support
those people and try to save them. That is the humanitarium thing to
do and he is not against that, but somewhere along the line we have
to take a stronger stand on the social problems that cause Aids. In
his report he drew everyone's attention to an article that was in the
News Tribune on Saturday, which was very well written. He said you
cannot not cure the ills of society if you shrugged your responsibility
to help the poor people, He also read on Monday about 1.5 billion
dollars in more aid for our schools, He said he didn't think throwing
money at education is an answer He agrees it is part of the answer
He said a kid who is born in any ghetto is not born stupid. His
problem stems from his environme~t and being there is always the
exception to the rule and and someone will come out of that
environment as a successful person, but, the majority will fail only
because society is failing them. He commented that if you read

showed where there is eight hundred million dollars out there that can
be used, that the court said should be used, to give people a decent
place to live. The reprecussions from this could help to eliminate
Aids, Welfare and crimes. He was saying he read the editorials and on
one vein I like the editorial and on the next vein he thought they were
fully you know what. It applauded his stance on trying to help those
people, but it said maybe suing is not the way. He 'commented that
the law has been passed tor twenty (20) years and the newspaper
didn't see fit for twenty (20) years to report that more than half the
towns in the State of New Jersey did not comply with the law. It
went on to say that C. O. A.H. doesn't have the ability to prosecute it
or to take it on to legal and there is no teeth in the law to force
anyone to do this except by virtue of the lawsuit, so what he is going
to ask tonight is he is going to ask any lawyer in Middlesex County
in the State of New Jersey that wanted to join a Legal Team to force
this issue to please contact his office. He said he talked to this
Gentleman yesterday and then he read a fax he got today from him
which referred to the Lawyer's Committee for Civil Rights under law
is an organization in Washington DC which acts as a Clearing House
for pro bono Civil Rights litigation. If they decide to take on an issue
they obtain and coordinate free pro bono legal services from top law
firms. The person to contact there is Katie Cox and he gives them the
telephone number, etc. You can see that you were given the name
by Steve Spits the former lead attorney for the committee. He
commented that he already had people in Washipgton that were
willing to look at this and he is going to push this. The newspaper
today said that he should Lobby our Legislature. He said he will be
down in Atlantic City tomorrow and he will be doing just that and he
also will be making an appearance on Comcast Newsmakers asking
the same thing he is asking here tonight, for the lawyers to help him
out. Aside ITom that he already had one (1) lawyer that called him
today that volunteered his time tree. He is going to ask for only what
it would cost him directly out of his pocket to institute these law
suits. So said he intends to bring it up to the Council at the next
Agenda Meeting to see if they want to assist in this endeavor and
again he intends to log into the legislature in Atlantic City tomorrow
and he also intends to send a letter asking for legislation to be passed
in Trenton giving C.O.A.H and anyone else the ability to force this
issue. He intends to send a letter to Mr. Wisniewski, our
Assemblyman, Ms. Friscia, our Assemblywoman, Mr. McGreevey
who is our Senator and Mr. Vitale who is our Senator-Elect and ask
them to provide the proper legislation to make this thing a reality so
people can then have a decent place to live to help stop the spread
of Aids.

At approximately 8:00 p.m., Mayor Sica was noted absent
Cindy DeCamp asked what the purpose was of moving a seventy
two (72) year old man out of the Police Department She questioned
what purpose this would serve
Councilmember DuPont asked her if she was referring to Traffic
Maintenance.
Cindy said she was.
Councilmember DuPont said Traffic Maintenance last year was under
the Police Department He said it is more logical to have it under the
Streets and Roads Department This move improved two (2)
departments
Cindy said this man has been in the building for ten (10) years and he
is a help. She commented that she doesn't see the point in going
between two (2) buildings..
Councilmember Failace said he is not out on the back of a truck,
etc., he is still doing his regular work.
Councilmember Bialowarczuk said that actually the Borough
Ordinance says they should be in the Municipal Garage, not Streets
and Roads, so there are problems there that have to be worked out
Cindy De Camp said he understood that and she knows that
ordinance was on the books a long time ago and then if somehow
they got here and whatever and she understood all that (inaudible).
Councilmember Bialowarczuk said she understood.
A man named Vincent Shultz then spoke saying his concern is about
the Senior Citizens on Noe Street, who still have remgerators they
have to defiost He spoke of one he knew that was ninety (90) years
old. He commented that aU the Senior Citizens in the Chrome has self
derrosting refiigerators. He questionetl what could be done with that.
He spoke with Mayor Sica's brother at the Housing Authority and he
was told that HUD took care of that and when he called HUD they
told him it was the Housing Authority.
Councilmember Gutowski told him that the Housing Authority
would have to take care of it but he would convey his concern to the
Mayor and he could talk to the Chairman of the Housing Authority
and maybe he cuuld do something.
Councilrnernber Fazekas told Mr. Shultz he would take his name and
they could look at it

John Sudia said the Housing Authority has a budget to replace certain
items, some specifically for Seniors. He suggested to put it in a letter
to the Housing Authority to put it in the budget He said HUD never
refuses.
Wanda Wehrhahn said she wanted to ask a question, He questioned
how come the Crossing Guard's salary came up even before they
voted on it
Councilmember Failace said he had thought the Mayor explained that
because this is something he would have to speak about privately
because it has to go through negotiations. He said be could explain
to her why they did it because one of the negotiations that was
approved, not a (inaudible) that has to be radified, it was agreed upon
Councilmember Gutowski said tenatively agreed upon.
Councilmember Failace repeated that statement
Attorney CougWin said one of the things that was tentatively agreed
upon was, would it impose upon the Borough an obligation to make
payment within a certain time, if, in fact it was ratified by both sides
in order to be in a position to comply. With that the Borough is
undertaking the action to put the money in place to make the
payments within a requisite time assuming that it is ratified by the
Borough. In the event that it wasn't then we would simply recind the
ordinance and the money could be returned to where it was. All this
does is put us in a place what we hope would be a settlement and
comply with all the terms of the (inaudible)
There being no further business or discussion, upon MMS&C, by
Councilmembers Failace and Fazekas and unanimous aftirmative vote
of the full membership present the meeting was adjourned at
approximately 8:10 p.m.
