HomeMy Public PortalAboutResolution 83-2178RESOLUTION NO. 83 -2178 A JOINT RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES AND THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING AND ACCEPTING NEGOTIATED EXCHANGE OF PROPERTY TAX REVENUES RESULTING FROM THE WITHDRAWAL OF CERTAIN INCORPORATED TERRITORY FROM COUNTY LIGHTING MAINTENANCE DISTRICT 1395 WHEREAS, pursuant to Section 99 of the Revenue and Taxation Code, prior to the effective date of any jurisdictional change the governing bodies of all agencies who service areas or service responsibilities would be altered by such change must determine the amount of property tax revenues to be exchanged between the affected agencies and approve and accept the negotiated exchange of property tax revenues by resolution; but if the affected agency is a special district, the Board of Supervisors must negotiate on behalf of the district; and WHEREAS, the Board of Supervisors of the County of Los Angeles and the City Council of the City of Temple City have determined that the amount of property tax revenues to be exchanged between their respective agencies as a result of the withdrawal of certain territory described in Temple City Resolution No. 83 -2141 from County Lighting Maintenance District 1395 is as set forth below. NOW, THEREFORE, BE IT RESOLVED as follows: SECTION 1. The negotiated exchange of property tax revenues between the County of Los Angeles and the City of Temple City resulting from the withdrawal of certain territory described in Temple City Resolution No. 83 -2141 from County Lighting Maintenance District 1395 is approved and accepted. SECTION 2. For fiscal years commencing on and after July 1, 1983, or after the effective date of this jurisdictional change, whichever is later, all property tax revenues received by County Lighting Maintenance District 1395 attributable to the territory described in Temple City Resolution 83 -2141 shall be transferred to the County of Los Angeles. SECTION 3. No other transfers of property tax revenues shall be made to the City of Temple City as a result of the proposal identified herein. SECTION 4. The foregoing resolution was adopted by the Board of Supervisors of the County of Los Angeles and by the City Council of the City of Temple City. SECTION 5.
