COUNCIL MINUTES
CITY OF TEMPLE CITY
JANUARY 20, 1970
INITIATION:
1. Mayor Harker called the regular meeting of the City Council
to order at 7:40 p.m.
2. The invocation was given by the Reverend Wesley Nunamaker,
Reorganized Church of Jesus Christ of Latter Day Saints.
3. The Pledge of Allegiance to the Flag was led by Mayor Harker.
4. ROLL CALL:

5. APPROVAL OF MINUTES:
Councilman Briggs moved to accept the minutes of the regular
meeting of January 6, 1970, as printed, seconded by Councilman
Beckley and unanimously carried.
UNFINISHED BUSINESS:
6. ORDINANCE No. 70 -302 2nd read. Re. Amendment to Temple City
Municipal Code Section 7100 to incorporate amendments to Highway
Permit Ordinance of Los Angeles County.
Assistant City Attorney Lieberman presented Ordinance No. 70 -302
AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING THE HIGHWAY
PERMIT ORDINANCE OF SAID CITY OF TEMPLE CITY, by title only, for
second reading. Councilman Tyrell moved to waive further reading
and adopt, seconded by Councilman Merritt and unanimously carried
7. ORDINANCE No. 70 -303: 1st read. Re. Amendment to Temple City
Municipal Code relating to rear yard setbacks in C -2 zone,
adjacent to Pedestrian Malls.
Assistant City Attorney Lieberman presented Ordinance No. 70 -303,
entitled AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY AMENDING SECTION 9391C (c) of the TEMPLE CITY MUNICIPAL
CODE RELATING TO REAR YARD SETBACKS IN THE C -2 ZONE, for first
reading. Councilman Tyrell moved to waive further reading,
seconded by Councilman Briggs and unanimously carried.
NEW BUSINESS:
8. ORDINANCE No. 70 -304: 1st read. Re. Increase charges for
subdivision maps per County recommendation.
City Attorney Lieberman presented urgency ORDINANCE No.
70 -304, entitled AN ORDINANCE OF THE CITY OF TEMPLE CITY AMEND-
ING SECTION 308 OF ORDINANCE 63 -107 OF THE TEMPLE CITY MUNICIPAL
CODE AND REPEALING ORDINANCE 67 -2.45 RELATING TO SUBDIVISION
FEES AND DECLARING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE
IMMEDIATELY, for first reading. Councilman Briggs moved to
waive further reading, seconded by Councilman Tyrell and
unanimously carried.

9. AUTHORIZATION TO LICENSE CITY HALL BASEMENT AS AN APPROVED
FALLOUT SHELTER
City Manager Koski advised that under the Civil Defense Program,
it was proposed that the basement of the City Hall be licensed
as a fallout shelter for up to 79 persons, and stocked with
appropriate supplies. It was moved by Councilman Merritt,
seconded by Councilman Tyrell and unanimously carried to approve
the licensing of the City Hall basement as an approved fallout
shelter as outlined by the City Manager, and that the City
Manager be authorized to sign the necessary documents.
10. RESOLUTION No. 70 -981: Calling for General Municipal Election
on April 14, 1970
City Manager Koski presented Resolution No. 70 -981 entitled
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY,
CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A
GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY,
THE 14th DAY OF APRIL, 1970, FOR THE ELECTION OF CERTAIN
OFFICERS OF SAID CITY AS REQUIRED BY THE PROVISIONS OF THE
LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW
CITIES. Councilman Tyrell moved to adopt, seconded by Council-
man Briggs and unanimously carried.
11A. RESOLUTION No. 70 -982: Requesting the Board of Supervisors
to permit the Registrar of Voters to render services to the
City for the General Municipal Election on April 14, 1970.
City Manager Koski presented Resolution No. 70 -982 entitled,
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS
ANGELES TO PERMIT THE REGISTRAR OF VOTERS OF SAID COUNTY TO
RENDER SPECIFIED SERVICES TO THE CITY OF TEMPLE CITY, RELATING
TO THE CONDUCT OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN
SAID CITY ON APRIL 14, 1970. Councilman Tyrell moved to adopt,
seconded by Councilman Merritt and unanimously carried.
11B. STATEMENT OF QUALIFICATIONS FOR CANDIDATES FOR GENERAL
MUNICIPAL ELECTION - APRIL 14, 1970
City Manager Koski advised that previously the City Council
had required the filing of a deposit to cover the cost of
printing of Statement of Qualifications of candidates. It
was moved by Councilman Merritt that if a nominee files a
statement of qualifications, he shall file a deposit in the
amount of $100 to be applied toward the cost of printing and
handling such statement. The motion was seconded by Mayor
Harker and unanimously carried.
12. RECOMMENDATIONS FROM PLANNING COMMISSION - Meeting of
January 13, 1970
A. TENTATIVE TRACT 28538: Re. Construction of a condominium
at 5004 -10 Farago Avenue by Euclid Land & Construction Co.
Planning Director Dragicevich presented background information
relative to the request of Euclid Land and Construction Company
to create a one -lot subdivision on which would be established
a 15 -unit condominium, to be located at 5004 -10 Farago, which
had been before the Planning Commission at their regular meeting.

Council . He advised that 38 park.ing. spaces •(2. 1/2. per
unit) are proposed; that the units would be sold individually
and that the owners of the units would each hold an equal
interest in the common area. He presented Exhibit A, describing
the location, and Exhibit B, a rendering of the proposed devel-
opment. A report from the Los Angeles County Regional Planning
Commission was provided for further reference. He advised that
if Tract 28538 were approved, the conditions outlined in report
of January 20, 1970, as staff proposals 1 through 16, would be
imposed.

Councilman Beckley moved to approve Tentative Tract Map
No. 28538, pursuant to Sections 305 and 306.°of.Subdivision
Regulations (Ordinance 63 -107) subject to the conditions as
outlined'in staff proposals dated January 20, 1970. Councilman
Tyrell seconded the motion, however advised that he wished to
add the stipulation that it be subject to the receipt of the
proposed agreement forming the Articles of Incorporation of the
Association covering required maintenance of the common areas,
to be submitted to the City Attorney for determination of future
enforcement. Councilman Beckley amended his motion to include
this requirement, the second to the motion was reaffirmed, and
the motion carried unanimously.
B. PUBLIC NUISANCE - 4935 DOREEN AVENUE - Report of Public
Hearing on complaint.
Planning Director Dragicevich reported that the Planning
Commission had adopted Resolution 70- 369PC, determining the
existence of a public nuisance at 4935 Doreen Avenue, however
that the property owner is entitled to appeal the Planning
Commission decision within 15 days, and that this time had
not yet elapsed. The report was submitted at this time because
of the interest in the matter by the City Council, however it
would be presented for action by the Council following the
termination of the appeal period.
13, RECOMMENDATIONS FROM TRAFFIC COMMISSION - Meeting of January 7, 1970.
A. ITEM 5. SANTA AANTA RACING SEASON - Post Patrol.
Director of Public Works Pizzorno advised that the Traffic
Commission recommended that traffic post requirements for Santa
Anita racing season be handled as routine administrative pro-
cedure each year, with recommendations made by the Sheriff's
Department. Councilman Tyrell moved to approve as recommended,
seconded by Councilman Briggs and carried unanimously.
B. ITEM 6. GRAND AVENUE AND FREER STREET - El Monte Avenue
to Santa Anita Avenue - Additional Regulations.
Director of Public Works Pizzorno advised that the Traffic
Commission recommended traffic controls for Grand Avenue include
the following: a) boulevard stop regulations on McClintock at
north and south approaches to Grand Avenue, with stop and stop
bar pavement markings, b) single skip centerline striping between
limits, and c) 25 mile per hour speed limit regulation between
limits with signs at the two major streets; and controls for
Freer Street to include a school crossing sign in conjunction
with pavement markings on Freer Street at the approaches to the
Cleminson School. Councilman Merritt moved to approve as
recommended, seconded by Councilman Beckley and unanimously carried
C. ITEM 7. LAS TUNAS DRIVE - Traffic Signal Modification.
Director of Public Works Pizzorno advised that the Traffic
Commission recommended upgrading and modification of traffic
signals on Las Tunas Drive with mast arm signals and 12 -inch
red lens as described at Cloverly, Sultana, Alessandro and
Loma Avenues, for which funds had been budgeted. Councilman
Beckley moved to approve, seconded by Councilman Merritt and
unanimously carried.
D. ITEM 8. ARDEN AND DAINES DRIVE - Additional Regulations.
Director of Public Works °izzorno advised that the Traffic
Commission recommended placement of a boulevard stop sign on
Arden Drive at the south approach to Daines Drive, wth stop and
stop bar pavement markings. Councilman Briggs moved to approve,
seconded by Councilman Merritt and unanimously carried.

E. ITEM 9. LOWER AZUSA ROAD; east of Eaton Wash - Additional
Regulations.
Director,of Public Works Pizzorno advised that the Traffic
Commission recommended placement of parking restrictions and
double centerline and single skip lane lines on Lower Azusa
Road, east of Eaton Wash, because of hazardous conditions
with trucks and other vehicles making left turns from Lower
Azusa Road into the United Lumber Company property, tying up
traffic. Councilman Tyrell suggested that the restriction
be limited to daytime hours so as not to inconvenience residen
Following discussion, Councilman Beckley moved to table the
matter in order to check further into the matter as to how the
restriction will affect the residents, seconded by Councilman
Briggs and unanimously carried.
F. ITEM 10. ENCINITA AVENUE: Southern Pacific Railroad to
Broadway - Plan Review.
Director of Public Works Pizzorno outlined Traffic Commission
recommendations for sidewalk construction for both sides of
Encinita for the total length of Encinita, from the Southern
Pacific Railroad tracks to Broadway, in connection with con-
struction project, estimated cost of sidewalks being $15,000.
Councilman Briggs moved to receive and hold the recommendation
until the project comes before the Council, seconded by
Councilman Merritt and unanimously carried.
14. RECOMMENDATIONS FROM PARKS &RECREATION COMMISSION - Meeting
of January 14, 1970.

A. REQUEST FROM STANDARD OIL CO. - Permit for core hole
drilling operation at Live Oak Park.
Recreation Director Kobett reported that the Parks & Recreation
Commission had reviewed the request for permit for core hole
drilling operation at Live Oak Park by Standard Oil Company, and
recommended that the request be approved subject to concern for
condition of park property, compatibility with development at
time drilling is terminated, and that a 90 -day time limit be
imposed. Following discussion, it was moved by Councilman
Briggs, seconded by Councilman Merritt and unanimously carried
to receive the report from the Parks and Recreation Commission,
and to refer to the Planning Commission for consideration at
Public Hearing set for Tuesday, January 27, 1970, with the added
recommendation that final cut -off date be stipulated (not just
90 days), and that thereafter a substantial penalty be imposed
if they have not vacated.
B. NEWLY ACQUIRED PARK PROPERTY - Recommenth tions re.
Development.
Recreation Director Kobett presented a._.sUmmary oft
recommendbtions from the Parks and Recreation Commission
relative to the development of newly acquired park property
at Live Oak Park. Because the items to consider were
numerous, it was moved by Councilman Briggs, seconded by
Councilman Merritt and unanimously carried to refer the
consideration of the suggestions for development of Live Oak
Park to a study session.

15. UNITED LUMBER CO. Report re. Petition - Public Nuisance
City Manager Koski reported that based on a petition received
by the City Council, from Mr. Charles Strand, 4815 N. Alessandro,
which was signed by 51 persons in the vicinity of United Lumber
Company, 9250 Lower Azusa Road, that an investigation had been
made by an inspector from the Air Pollution Control District
relative to dust emission in the area. He advised that the in-
spection revealed no sawdust, and that only normal amounts of
dust accumulation were observed. He advised that all equipment
was found to be operating properly. Also, that the company is
in the process of relocating a large portion of their operation
in Orange County so that complaints regarding noise and other
problems may no longer be critical. Council discussed the general
condition of the area, and whether dirt and dust is caused by
other sources, such as the railroad; and also whether Lower Azusa
Road is presently being swept as frequently as it should be in
order to alleviate road dust. It was moved by Councilman Tyrell,
seconded by Councilman Briggs and unanimously carried to refer
the matter to the regular meeting of the City Council to be held
on February 17, 1970, in order that the general conditions in
the area may be more fully observed.
16. SET PUBLIC HEARING - HALLOWELL, west side, Daines to Live Oak.
Curb, gutter and drive approach.
Councilman Tyrell moved to set Public Hearing for Tuesday,
February 3, 1970, for street improvements, curb, gutter and drive
approach, on Hallowell Avenue, west side, Daines Drive to Live
Oak, at 7:30 p.m. in the City Hall. The motion was seconded by
Councilman Beckley and unanimously carried.
RESOLUTION No. 70 -983: APPOINTMENT OF TEMPORARY PERSONNEL
City Manager Koski presented Resolution No. 70 -983, A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
APPOINTING TEMPORARY PERSONNEL. Councilman Tyrell moved to
adopt, seconded by Councilman Merritt and unanimously carried.
18, RESOLUTION No. 70 -984: WARRANTS & DEMANDS - Demand Nos. 1338
through 1411, in the amount of $25,635.14.
Councilman Briggs moved to adopt Resolution No. 70 -984,
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $25,635.14, DEMAND
NOS. 1338 THROUGH 1411. Councilman Merritt seconded the
motion which carried unanimously.
19. COMMUNICATIONS:
A. City Manager Koski presented a communication from Thomas
Conrow, Youth Commissioner, submitting his resignation from
the Commission because of a heavy schedule of activities.
Councilman Merritt moved to accept the resignation, with regret,
seconded by Councilman Briggs and unanimously carried.
Mayor Harker advised that in order to fill the vacancy on
the Youth Commission, he wished to appoint Robert Sorenson
for the unexpired term, subject to the conditions of
Resolution 69 -906, wherein members are required to be
between the ages of 14 and 20. Councilman Briggs moved that
the appointment be confirmed, seconded by Councilman Merritt
and unanimously carried.'

B. City Manager Koski presented a request from John M. Conover,
General Chairman, 26th Annual Camellia Festival, for
bleachers, use of light standards for advertising banners,
temporary street parking ban, and blue line to be painted
on Las Tunas Drive for Temple City Camellia Festival
Parade to be held on February 28, 1970. Councilman Merritt
moved; to approve the, request, seconded by Councilman Briggs
unanimously carried.
Councilman Tyrell moved that a formal request for additional
Sheriff personnel for the Camellia Festival Parade on
February 28, be forwarded to the Sheriff's Department,
seconded by Councilman Merritt and unanimously carried.
City Manager Koski presented a request from the Temple
City Kiwanis Club to conduct the Annual Line of Dimes event
on Friday, January 23, 1970, in lieu of the January 16 date
previously approved and which was not held because of the
general rainy condition on that date. Councilman Tyrell
moved to approve the request, as outlined, subject to the
same condition that the City of Temple City be additionally
insured, seconded by Councilman Briggs and unanimously
carried.

21, MATTERS FROM CITY OFFICIALS:

A, Mayor Harker advised that he would be attending the SCAG
General Assembly meeting on February 18, 1970, at which
time the increase of dues would be voted upon. He requested
views from the Council prior to his attendance at this
meeting.
Councilman Beckley announced his candidacy for reelection
to the City Council for the April 14, 1970, election, and
stated he would be filing nomination papers therefor.
C, Councilman Merritt advised that he too was officially
declaring himself a candidate for reelection to the City
Council.
D. City Manager Koski advised that a request had been received
from the Sister City Committee to provide necessary equip-
ment, grandstand, tables, chairs, etc., as may be necessary,
when hosting Sister City friends over the Camellia Festival
weekend. Staff was directed to provide the equipment as
requested, and to arrange details with Mrs. Clarkson who was
coordinating the arrangements for the Sister City Committee.
City Manager Koski advised that the terms of Commissioners
Adams and Maudlin on the Parks and Recreation Commission had
expired, and that both Commissioners had expressed willingness
to continue to serve in this capacity. Councilman Merritt
moved to reappoint Leonard Adams and Max Maudlin to two -year
terms on the Parks and Recreation Commission, to expire
January 5, 1972, seconded by Councilman Beckley and unanimousl
carried.
F. City Manager Koski advised that the matter of providing
travel accident insurance for Youth Commissioners had been
previously discussed, and that it was recommended that
$5,000 travel accident and $5,000 medical expense coverage
be provided. It was so moved by Councilman Beckley, seconded
by Councilman Merritt and unanimously carried.

G, City Manager Koski reported that a traffic safety proposal
was previously submitted by the Traffic Commission, and
that a communication had been received from the State of
California, Business and Transportation Agency, OFFICE OF
TRAFFIC SAFETY, stating that the original letter of intent
outlining the proposal had been favorably received. He
advised that we can now submit the final proposal, under
which plan funds would be provided over a two -year period
for the development of a pedestrian safety program. Council-
man Merritt moved that the necessary forms be completed and
the City Manager authorized to sign, in order to move ahead
with this project. Councilman Beckley seconded the motion
which carried unanimously.
H. City Manager Koski presented a request from Director of
Recreation Kobett to attend the 22nd Annual California
Parks and Recreation Conference to be held in the Anaheim.
Convention Center, March 1 -4, 1970, which conference would
not require hotel accommodations. It was moved by Council-
man Beckley, seconded by Councilman Briggs and unanimously
carried to approve the attendance of the Director of
Recreation at the 22nd Annual California Parks and Recreation
Conference, March 1 -4, as outlined.
22. ADJOURNMENT:
Councilman Tyrell moved to adjourn to the next regular meeting
of the City Council to be held on Tuesday, February 3, 1970,
at 7:30 p.m. in the Council Chambers of the City Hall. The
motion was seconded by Councilman Briggs and unanimously carried.
The meeting adjourned at 8 :50 p.m.
