HomeMy Public PortalAbout1998-10 Providing for the Creation of Fund and Budget Amendment for the Sanitary Sewer Improvement FundORDINANCE NO. 98-10 AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, PROVIDING FOR THE CREATION OF FUND AND BUDGET AMENDMENT FOR THE SANITARY SEWER IMPROVEMENT FUND AS A FUND WITHIN THE ENTERPRISE FUNDS PROVIDED BY THE ANNUAL BUDGETS OF THE VILLAGE OF KEY BISCAYNE; PROVIDING FOR SEVERABILITY; PROVIDING FOR EFFECTIVE DATE. WHEREAS, the Village Manager has requested authorization from the Village Council to create a Sanitary Sewer Improvement Fund within the Enterprise Funds and to provide a Budget Amendment for Fiscal year 1998; and WHEREAS, the Village Council desires to authorize the creation of such new fund and Budget Amendment. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS: Section 1. Fund Created. That the Sanitary Sewer Improvement Fund is hereby created as a fund within the Enterprise Funds of the Village. Section 2. Implementation. That the Village Manager or his designee is authorized to take all action necessary to establish and maintain the Sanitary Sewer Improvement Project Fund. Section 3. Budget. The Fiscal year 1998 Budget Amendment attached hereto is approved. Section 4. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 5. Effective Date. This Ordinance shall be effective immediately upon passage by the Village Council on second reading. PASSED AND ADOPTED on first reading this 13th day of October , 1998.
