The Agenda Meeting of the Mayor and Council of the Borough of
Carteret preceding the Regular Meeting February I, 1996, was held on
January 25, 1996, 7:00 P.M., Council Office, Munici¡n1Building, 61
Cooke Avenue, Carteret, New Jersey.
The following were noted present:

Also noted present was Borough Attorney Robert Hedesh.
Mailed to The Home News & Tribune, The Star Ledger and posted
on the bulletin board on January 18, 1996.

Sampling & Testing ofIndustrial Discharge.
John DiNicola. - He spoke saying he would like the Governing Body
to appeal the decision made by the Zoning Board.
Attorney Hedesh told him he has to file a formal objection to the
Council. He told him he cannot do it this way.
Mayor Sica told him to put in writing what the objections were, why
he feels it should be reversed and then they will grant him a hearing.
Attorney Hedesh told him he has to generate an appeal in order for the
Council to be able to act.

Attorney Hedesh said what is important is that this Council acts
properly so its not on the basis of an action against someone else. He
is not telling us we can't take the application now because you may
blow the deal, he is now telling us we can't make the application now
because it is improper to do so.
John Di Nicola told Attorney Hedesh that all he is asking now is if he
does make a formal application, the Council and the Mayor will hear
hi,s appeal.
Attorney Hedesh told him that nobody here can answer that question
right now
At approximately 7:07 p.m. Councilmember Fazekas was noted
present.

First Reading -
Amending Chapter 68 of the Code, Re: Alarm Systems.
Adoption -
#95-61 Vacating Borough Owned Property, Block 208, Lots 6:01 &

Public Hearing -
#96-1 Vacating Easement on Property, Block 208, Lots 6.
RESOLUTION:
Directing Issuance of Various Raffle Licenses.
Authorizing Bids - Wheel Loader.
Authorizing Mayor to Execute an Interlocal Service Agreement for
Dog Warden Services for 1996.
Authorizin.g Mayor to Execute 1996 Municipal Alliance Agreement..
Approving Payment of Liability Claim, $1000.00 - Rodriguez.
Directing Issuance of Amusement Game Distriutor's License.
Directing Issuance of Amusement Game Device License.
Amendment to Temporary Budget.
Mayor Sica asked ifany of the Councilmembers had any questions on
these Resolutions.

Councilmember Failace asked about the one for the Temporary
Budget.
Mayor Sica said they always do one on that.
Councilmember Failace asked about the one for the Wheel Loader.
Mayor Sica told him they had rented on but now they are going to
authorize for bids to buy one.
REPORTS:
Fire - December & Annual 1995.
Treasurer - Finance Report
COMMUNICATIONS:
Twp. of Piscataway & City of South Amboy - Resolutions opposing
proposed Land Use Regulatory Reform Act.
Borough of Metuchen - Resolution requesting State Legislature to
examine alternate method of funding schools that does not rely on
aggressive property tax.
Mayor Sica said on the one about the Twp. of Piscataway & City of
South Amboy, he thinks this is that they are trying to make a state
conformity in zoning. They are trying to formulate one zoning book
that every town should use. He thinks that is crazy. He thinks they
should join in and put a resolution on opposing this.
Councilmember Semenza agreed.
Attorney Hedesh said what they are trying to do is eliminate the
controls from Planning Boards given to the Department of
Community Affairs for certain building and zoning.
Mayor Sica said and for planning.
Attorney Hedesh told the Clerk to get him a copy of this.
Mayor Sica told Attorney Hedesh to look at this and then they will
draw up a resolution.

MATTERS FOR DISCUSSION:

Bid _ Comminutor. The Clerk asked Attorney Hedesh if he wanted to
adjust the bid on the comminutor.
Attorney Hedesh said he told people that on the bids on the
communitorthere is a problem. We opened one and there is another
one downstairs in the Purchasing Area. He said we only opened up
one publicly because that is all the Clerk was givel'..~ we have to
have a resolution rejecting the bids and rebidding it.
Mayor Sica asked who had the bid downstairs that wasn't turned over
to anybody.
The Clerk said it was in Purchasing.
Mayor Sica said he wants a report on why the bid wasn't turned over.
He said now it will cost us money to readvertise it plus we need the
comminutor.
Councilmember Semenza and the Clerk said Gloria said the bid was
received in Purchasing on time.
Tax Assessor
Tax Assessor - Requesting to give 2 senior citizens deductions.
Attorney Hedesh asked why this is being done with these two (2)
people.
Mayor Sica said he wants a report from the Tax Assessor why this
was done.
AIG Claim Services
AIG Claim Services - requesting payment ofliability claim, P Misko,
$13,000.00
Attorney Hedesh said he didn't know anything about this claim. He
sent a letter out asking what this claim was all about. This was held.
Counci1member
Failace
Councilmember Failace - Requesting appointment of Jim Mancuso to
the Zoning Board vacancy.
Mayor Sica said it is the Mayor's appointment with the advice and
consent of the Council. He told Councilmember Failace he would talk
to him later about this.
Historical Conmittee Historical Committee - Frank Tomczuk asking Mayor & Council to
select date for 90th anniversary parade.
Mayor Sica said they have to ta1k to the Recreation Commission and
see what they have planned first. He said maybe they could incompass
the two things in one day.

Local Assistance Board - Vacancy.
Mayor Sica said he will fill that next week. He told the Clerk to put a
resolution on.
Office on Aging Board - Three (3) Vacancies.
Mayor Sica said they will do the same on this if they find somebody
to take them.
Air Pollution Board - Vacancy. Ronald Pusillo declined appointment
Mayor Sica said the same thing will be done with this.
Recreation Commission - Name of Michael Bucsak submitted.
Mayor Sica said to put a resolution on
Jewish Federation of Greater Middlesex County - Requesting
Proclamation for Jerusalem 3000 Celebration and asking the
possibility of naming a street in honor of Jerusalem
Mayor Sica said they will do a proclamation, but, they don't have any
streets to name. He told the Clerk to send them a nice letter explaining
that the streets in Carteret are named after veterans.
NJ Department of Personnel - Specs for title of Chauffeur does not
require CDL License. Need to change title. Provisional - Richard
Maher.
William Kolibas said everybody had one already, so everyone coming
in shold have one
Attorney Hedesh told him that is to get someone the title of
Chauffeur. He said they will discuss this in Closed Session.
Deputy Chief Hack - a) Asking to hold PBA Fishing Derby on June
29, 1996. Mayor Sica said okay.
b) Requesting Proclamation for Buckle Up America Week, 2/5/ -
2/9/96. Mayor Sica said to put this on for the next meeting.
BUSINESS TO BE ADDED
Councilmember Failace questioned last week about AJV and
Wanskus. He said there is no contract on file. This is for the Marina.
Councilmember Bialowarczuk spoke about the Avenue of Fame. The
first six (6) are named and now they have to pick four (4) more. She
said you could tie all that in to that celebration at one time.

Councilmember Fazekas said if anyone submits any requisitions for
computer equipment he wants to look at them.
Mayor Sica told the Clerk to send a Memo out to every Department
saying no one buys anything in reference to computers unless
Councilmember Fazekas looks at it first.
Attorney Hedesh told Councilmember Fazekas, about the Internet he
might want to contact in North Brunswick. They are going on the
Internet and they are doing a complete type of thing on the town and
you might want to see what they are doing.
Councilmember Semenza said he would just like to comment on our
sewer emergency Angelo Valetutto who was brought in to do
Parmar's job during emergencies is doing a fine job. Along with our
Sewer Department everything is going pretty well over there. He said
he didn't see the final outlay.
Mayor Sica said he has that and they will go into Closed Session on
that because there is going to be some pending litigation.
Councilmember Semenza said he would like the Clerk to put out a
Directive to all Personnel, that before they give out Mayor or
Councilmembers phone numbers for everyday problems that come up
they should first be given the Department Superintendant's number
before forwarding them to the Mayor and Council.
Mayor Sica spoke on Germak Drive. He said it goes down a certain
distance and stops and comes in the other way a certain distance and
it stops and in between it is a mess. He said the people in that area
want us to vacate that and give the adjourning property owner that
piece of property. He said he sees no problem with that because it is
of no value to us He said it starts from behind Such's and it goes to
where the man cut his house in half.
Councilmember Semenza said he thought SIX (6) houses were
involved.
Mayor Sica said they should get rid of it because it is nothing but a
headache and it will make the neighborhood a whole lot nicer.
Attorney Hedesh said it doesn't call for anything more than to vacate
that street.
Mayor Sica said they have to get the parameters from Parmar and
Attorney Hedesh said to let him check on it.
Mayor Sica asked if anyone had any problem with that. He said this
would also put it on the tax role.
Mayor Sica said he is going to have Ted Surick start hauling mulch
from Dauman They are donating as much as we want for the top of
the Pop Warner Field. He said he will be donating the sand.

Mayor Sica said a young lady from the Hispanic Community from
lower Roosevelt Avenue was present and she'wants to speak. He said
in the area where she lives there is a Hispanic Club.
The young woman said the club has its own liquor license.
A gentleman from the Hispanic Community agreed saying that the
license would expire June 30, 1996 He said his problem is he was
renting from Simon's mother, who owns a 1iquor store right next to
the laundermat and she wanted to jack up the rent too high and they
couldn't afford it so they looked for another place, which they found
and then they submitted an application for a liquor license transfer to
that place in August and in December he got a call from De Felice
who told them they had a problem, someone was objecting. He
questioned why he was not told in the beginning so he would have
spent the money he did in the little building he wanted to take over.
He said he is here thirty-two (32) years
The young woman said the man objecting is doing it out of spite.
The gentleman said it is a private club. Only members go in there.
Mayor Sica said the problem with this is when they were selling liquor
in there Simon never said anything because they were renting his
building but now that they aren't renting his building he doesn't want
that done anymore. He is saying it is not within four hundred (400)
feet. He said we could pass an ordinance. .
Attorney Hedesh said there is an ordinance that this Council passed
that says the four hundred (400) feet would not apply to Club
Licenses. He said the Police Department had questions on this and the
Council never acted on those questions.
Mayor Sica told the gentleman to bring him a copy of his license and
if it is valid they will do it. He commented that these people have a
petition from the people down there with 227 signatures on it
supporting this.
RESOLUTION #96-29 was introduced by the Mayor and referred to
the Council for action.
Upon MMS&C, by Councilmembers Semenza and Fazekas
RESOLUTION #96-29
"RESOLUTION TO GO INTO CLOSED SESSION"
was adopted. Upon individual roll call vote, Councilmembers,
Bialowarczuk, Failace, Fazekas, Feingold, O'Brien and Semenza voted
in the affirmative.
