Second by Sarah Kemp. VOTE 4-0-0 16-01 Thomas + Jennifer Halloran, represented by Karen Kempton, 15 Grandfather's Lane, Map 79 Lot 61 (previously M 6 L 98), in the RM zoning district. The applicant seeps a Special Permit under MGL 40A-9 and Brewster Bylaw 179-51 to add a cupola to a new home that extends 33' 4" above grade. request for CONTINUANCE to February 9, 2016 MOTION by Leslie Erikson to CONTINUE this application (16-01) to February 9, 2016 as per request. The applicant seeks a Variance under MGL 40A and Brewster Bylaw 179-52 to 1 construct an attached garage to a single family dwelling that encroaches on required setbacks. Members hearing this application; Philip Jackson, Sarah Kemp. Bruce MacGregor and Leslie Erikson. Chairman Jackson explained to Mr. Thompson that we only have four (4) members present thus it must be a unanimous vote. Mr. Thompson was agreeable to this. Mr. Thompson gave a brief update as per request of Zoning Board from November. • Adding a 20 x 20 garage within side setbacks • steep sides • septic in the back • ZBA questioned front doors forward; would produce front setback issue • keeping plan as is is side setback ONLY • square footage is 172 • within 11.4 od property line • Mr.Thompson presented a Certified Plot Plan dated December 23, 2015 by Soule land Surveying as requested previously • Topography of hill noted on originally submitted plan Open to Public Input NO ONE SPOKE to this issue j MOTION by Sarah Kemp to Close to Public Input, Second by Leslie Erikson. VOTE: 4-0-0 Board Comments • Best alternative/ difficult topography • Meets all 4 criteria • Does not encroach on neighbor MOTION by Leslie Erikson to GRANT a Variance for case 15-28 as advertised to construct an attached garage within the side setbacks with the CONDITION to present an "as built" plan when applying for Building Permit. Second by Sarah Kemp.
