BE IT ENACTED BY-THE CITY COUNCIL OF TIFFIN, IOWA: Section 1. Purpose. The purpose of this ordinance is to amend the official zoning . map of the Municipal Code of Tiffin,Jowa, concerning•the following described property to- wit, located in Tiffin,Johnson County, Iowa. Section 2. Amendment.•The following legally described property: - SE % NE 1/4; NE 1/4 SE 1/4; except Lot 1 of Milkwood • t.___ (Plat Book 28, Page 40); SE 1/4 SE 1/4 and South 30 feet of ' x NW 1/4�SE 1/4 of Section 21-80-07 SW 1/4 NW 1/4 of Section 22-80-07 NE 1/4 NE 1/4 ; NW 1/4 NE 1/4 ; and NE 1/4 NW 1/4 lying East of Robert's Ferry Road (formerly known as Rollo Johnson Road, Irish Avenue and James Avenue) of 1 . Section 28-80-07 EXCEPT part of Lot 2 Gracehill Estates (Plat Book 44,,Page 135) and EXCEPT part of, Auditor's Parcel 2000 028 (Plat Book 41=Page 194) r shall be changed from zoning classification from A-1, Agricultural to R-1, Single Family .Residential, and further, that the official zoning map of the City be amended to reflect the change described herein. Section. 3. Penalty Provision. The city-may elect, at its sole discretion, to prpsecution any violation either as simple misdemeanor or a municipal infraction. Section 4. Repealer. All ordinances or parts of ordinances in conflict with the , . provisions of this Ordinance are hereby repealed. , . Section 5. Severability. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such-adjudication shall not affect the validity of the ordinance as a.whole, or any section, provision, or part thereof'not adjudged invalid or unconstitutional. Section 6. Effective Date. This ordinance shall be in effect after its final passage, approval, and posting as piovided by law.. Ordinance # "2004=267 Page 2 On the 12th day of May 2004, at a regular meeting of the Tiffin City,Council, Tiffin, Iowa, Councilperson , Bartels introduced Ordinance No. 2004-267, and moved that it be given its first reading. the motion was seconded by CouncilpersonHuedepohl . Ayes:Huedepohl, Bartels, and Dils. Nayes: None.- Absent: Petersen and Gericke. Threttembers of the council being present and.having voted "Aye", Mayor Glen R. Potter declared the motion carried,' and Ordinance"No. 2004-267, was read the first time and ' discussed and placed on record. • On the 9th day of June 2004, at a regular meeting of the-Tiffin City Council, Tiffin, , Iowa, Councilperson Gericke introduced Ordinance No. 2004-267, and moved that it be given its second reading. The motion was seconded by Councilperson Huedepohl. Whereupon Maybr Glenn R. Potter read the ordinance the second time by title only. Ayes: Gericke, Bartels, Dils,Huedepohl. Nayes: Motion carried. R. Thereupon it was moved-by Councilperson Bartels and seconded,by Councilperson Dils to read ORDINANCE NO. 2004-267 entitled AN ORDINANCE AMENDING THE ' OFFICIAL ZONING MAP-OF THE MUNICIPAL CODE OF TIFFIN, IOWA, FOR • CERTAIN PROPERTY LOCATED WITHIN THE CITY LIMITS ALONG IRELAND AVENUE (EXTENSION OF ROBERTS FERRY ROAD) (AS OWNED BY GRACE- .° BACULIS FARM PARTNERSHIP), a third time and that the rules.requiring a,second and third reading and reading on three separate dates be dispensed with and the ORDINANCE NO. 2004-267 was placed upon record. Ayes: Gericke,Dils, Bartels and Huedepohl - Nayes: None. , , Absent:• Petersen. . Motion carried.
