Mayor Harker called the regular meeting of the City Council to order at 7:35 p.m. 2. The invocation was given by the Reverend Father Ian Holland, St. Luke's Catholic Church, 9451 Broadway 3. The Pledge of Allegiance to the Flag was led by Mayor Harker. 4. ROLL CALL: PRESENT: Councilmen - Beckley, Merritt, Tyrell, Harker ABSENT: Councilmen - Briggs ALSO PRESENT: City Manager Koski, City Attorney Martin, Assistant City Manager Recupero, Planning Director Dragicevich, Recreation Director Kobett, Director of Public Works Pizzorno, Traffic Engineer Envall Councilman Beckley moved to excuse Councilman Briggs for business reasons, seconded by Councilman Tyrell and carried. APPROVAL OF MINUTES: Councilman Merritt moved to approve the minutes of the regular meeting of January 20, 1970, as printed, seconded by Councilman Beckley and carried. Mayor Harker introduced American Field Service Student, Olivia Molteni, of Como, Italy, who spoke briefly relative to her experiences as an exchange student, and her pleasure in being invited to attend a City Council meeting and to learn about our City government. UNFINISHED BUSINESS: 6. PUBLIC HEARING: 7:30 p.m. Re. Curb, gutter, sidewalk and drive approach, HALLOWELL, west side, Daines to Live Oak. Director of Public Works Pizzorno advised that the improvements of curb, gutter, sidewalk and drive approaches on Hallowell, from Daines to Live Oak, had been undertaken by 54.6% of the property owners, that the proposed improvement would complete the project at one time, and that proper notice relative to the Public Hearing had been given. Councilman Beckley moved to open the Public Hearing, seconded by Councilman Merritt and carried. Bernard Cook, 5736 Rowland, addressed the Council in behalf of Mrs. Blankenship, a widow and owner of property at the southwest corner of Hallowell and Live Oak, who would receive no particular benefit from sidewalks in the front of her home, but who would be heavily assessed for the improvement because of her corner locatign. Mr. Cook advised that while the other improvements (curb, gutter and drive approach) would also cause a financial burden for Mrs. Blankenship, that these improvements were acceptable to her. Councilmen Tyrell and Beckley noted that the sidewalks would not generally benefit Mrs. Blankenship, but more specifically the sanitarium in the area, and that the sidewalk improvement had been part of the requirement in approving request for tract development of the sanitarium. No one else came forward to speak, however Director of Public Works Pizzorno advised that the Kovacs' property at 5643 Hallowell was similarly affected, and that the owner had protested the burden of sidewalk assessment. Council Minutes, Page 2 - February 3, 1970 Councilman Beckley moved to close the Public Hearing, seconded by Councilman Tyrell and carried. Following discussion, Councilman Beckley moved to approve work as outlined for curb, gutter, sidewalk and driveway improvements, Hallowell, west side, Daines to Live Oak, with the exception of sidewalks for the properties at 10320 Live Oak and 5643 Hallowell as discussed, and to instruct the Superintendent of Streets to cause the work to be done. The motion was seconded by Councilman Tyrell and carried. 7. ORDINANCE No. 70 -303: 2nd read. Re. Amendment to Temple City Municipal Code relating to rear yard setbacks in C -2 zone, adjacent to Pedestrian Malls. City Attorney Martin presented Ordinance No. 70- 303,entitled, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMEND- ING SECTION 9391C (c) OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO REAR YARD SETBACKS IN THE C -2 ZONE, for second reading by title only. Councilman Tyrell moved to waive further reading and adopt, seconded by Councilman Merritt and carried. 8. ORDINANCE No. 70 -304. 2nd read. Re. Increase charges for Sub- division Maps per County Recommendation. City Attorney Martin p resented urgency Ordinance No. 70 -304, en- titled, AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTION 308 OF ORDINANCE 63 -107 OF THE TEMPLE CITY MUNICIPAL CODE AND REPEALING ORDINANCE 67 -245 RELATING TO SUBDIVISION FEES AND DECLARING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY, for second reading and adoption. Councilman Tyrell moved to waive further reading and adopt, seconded by Mayor Harker and carried. 9. RESOLUTION No. 70 -985: Public Nuisance, 4935 Doreen Avenue. City Attorney Martin presented Resolution No. 70 -985, A RESOL- UTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING CERTAIN PREMISES TO BE A PUBLIC NUISANCE AND ORDERING ABATEMENT THEREOF, advising that this Resolution would confirm action of the Planning Commission as stated in Resolution No. 70 -369PC requiring abatement of the conditions described, within a 60 -day period, and for which the 15 -day appeal period had expired. Francis Billie, owner of property at 4935 N. Doreen Avenue, was present in the audience and advised that he was proceeding with the requirements as outlined by the Planning Commission. Councilman Tyrell noted that items 1 and 2 of conditions stipul- ated by the Planning Commission dealt with specific requirements and were in order, however that item 3 relative to maintaining premises in good order was incumbent on all residents and should be deleted as a condition. He then moved adoption of Resolution No. 70 -985, with the deletion of item 3 of the abate- ment procedures, as outlined in Resolution No. 70- 369PC, seconded by Councilman Beckley and carried. 10. LOWER AZUSA ROAD, east of Eaton Wash - Parking Restrictions. Director of Public Works Pizzorno advised that this matter had been carried over from the previous meeting in order that residents in the area could be contacted relative to any inconvenience parking restrictions on Lower Azusa Road may cause. He advised that without total parking restriction, it was not recommended that Lower Azusa Road be striped to four lanes. Traffic Engineer Envall advised that he had contacted all of the residents in the area, except one he had not been able to reach, and that only one owner objected to the restriction. All of the other residents were in favor of it so that traffic would move more effectively. He outlined the restrictions as follows: Council Minutes, Page 3 - February 3, 1970 1. Placement of "No Stopping Any Time" signs on the north side of Lower Azusa Road from Cloverly Avenue to the Southern Pacific Railroad tracks. 2. Placement of "No Stopping Any Time!' signs on the south side of Lower Azusa Road from Miller Drive to the Southern Pacific Railroad tracks. 3. Placement of "Park Off Pavement11 signs on the south side of Lowe Azusa from Miller Drive to Cloverly Avenue. 4. Placement of double centerline and single skip lane lines on Lower Azusa Road from the Southern Pacific Railroad tracks and extending westerly to existing lines in the vicinity of Cloverly Avenue, to provide for four lanes of traveled traffic. Councilman Merritt moved to approve as recommended, seconded by Councilman Beckley and carried. Director of Public Works Pizzorno advised that in regard to the dust problem in the area, that the railroad bed consists of oiled ballast rock and should not create any dust, and that the granular soil in the parkway is heavier than silt or loam and rarely causes a dust problem. He advised that continued surveillance would be made re. effectiveness of sweeping and general cleanliness of the. area. 11. PARKS & RECREATION COMMISSION RECOMMENDATIONS - Meeting of January 21, 1970 Recreation Director Kobett advised that the Parks and Recreation Commission recommended re- cosponsorship of the following organizations for the 1970 season, or year: 1. Temple City Creative Arts 2. T. 0. P. S. (Take Off Pounds Sensibly) 3. Temple City Lacrosse Club 4. Temple City Youth Football Councilman Merritt moved to approve as recommended, seconded by Councilman Beckley and unanimously carried. 12. RESOLUTION No. 70 -986: Areawide T.O.P.I.C.S. Plan Report and Federal Aid Primary Type II System for City of Temple City Director of Public Works Pizzorno advised that the County Road Depart ment had prepared a report for unincorporated county territory and contract cities which qualifies the eligibility of the county and contract cities to receive TOPICS funds to increase capacity of existing streets, which funds must be matched on a 70/30 basis by those receiving this Federal Aid. He advised that TOPICS projects would be selected for detailed consideration on the combined basis of traffic congestion and accidents. Councilman Merritt moved the adoption of Resolution No. 70 -986, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AUTHORIZING THE MAYOR TO SIGN AND CITY CLERK TO ATTEST TO APPROVAL OF AREAWIDE TOPICS PLAN REPORT AND FEDERAL AID PRIMARY TYPE II SYSTEM FOR CITY OF TEMPLE CITY, CALIFORNIA, in order to establish our position if we should want to utilize these funds in the future. The motion was seconded b'y Mayor Harker and carried. 13. WARRANTS & DEMANDS: RESOLUTION No. 70 -987 - Demand Nos. 1412 through 1487 in the sum of $40,634.86 Councilman Tyrell moved to adopt Resolution No. 70 -987, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $40,634.86, DEMAND NOS. 1412 THROUGH 1487. Councilman Beckley seconded the motion and carried. 1 Council Minutes, Page 4 - February 3, 1970 14. COMMUNICATIONS: A. City Manager Koski presented a request from the San Gabriel Valley Council Boy Scouts of America to proclaim the week of February 7-13, 1970 . as BOY SCOUT WEEK. Councilman Tyrell moved that it be so proclaimed, seconded by Councilman Merritt and carried. Mayor Harker advised that he would take the signed proclamation with him to the Mayor's Breakfast to be held on February 6, at which time all of the San Gabriel Valley Mayors were meeting in behalf of the Boy Scout organization. B. City Manager Koski presented an appeal by the Standard Oil Company from Planning Commission decision on Conditional Use Permit 70 -309 (Resolution No. 70- 371PC) had been received within the required time. Councilman Tyrell moved to set Public Hearing for Tuesday, February 17, 1970, at 7:30 p.m. in the Council Chambers of the City Hall, seconded by Councilman Merritt and carried. Councilman Tyrell suggested that the Oil Company should consider use of private property rather than public property, and may wish to direct some attention to this consideration in their overall plans. C. City Manager Koski advised that a summons had been received relative to an injury sustained by Lawrence J. Wilson at the Temple City Sheriff Station, which had been forwarded to our insuring agency, as directed by the City Attorney. D. Councilman Beckley requested staff to prepare a report detailing the application of the concurrent improvement ordinance as it applies to curb, gutter, sidewalk, etc., under varying circumstances. 15. TIME FOR THOSE IN AUDIENCE WHO WISH TO SPEAK: J. W. Parkhurst, 9651 Olive, inquired as to use of City seal for identification badges that would be worn by Sister City visitors and others. The matter was referred to a Study Session to follow the meeting. 16. MATTERS FROM CITY OFFICIALS: City Manager Koski presented a request from California Contract Cities Association to submit registration for City Officials from Temple City who would be attending the Seminar in Palrn Springs, May 7 -10, 1970, and requested authorization to draw warrant for registrations for City representatives. Councilman Beckley moved to approve, seconded by Councilman Merritt and carried. 17. ADJOURNMENT: Councilman Tyrell moved to adjourn to a study session at 8:25 p.in. seconded by Councilman Beckley and carried.
