Sica on Thursday, April II, 1996 at 7:00 P.M., Council Office, Municipal Building, 61 Cooke Avenue, Carteret, New Jersey. Upon individual roll call, the following were noted present: Councilmember Deborah Bialowarczuk James Failace William Feingold James O'Brien " " " Noted absent were Councilmembers Jack Fazekas and Sam R. Semenza. Also noted present was Borough Attorney Robert A. Hedesh at 7:02 P.M. Mailed to The Home News & Tribune, The Star Ledger and posted on the bulletin board on April 4, 1996. At approximately 7:03 P.M., Councilmember Jack Fazekas was noted present. MINUTES FOR APPROVAL: March 21, 1996. PROCLAMATION: a) ChornobyllOth Anniversary Commemoration b) Why Me Week Mayor Sica asked if anyone saw this on television regarding Chornobyl. He is not against this proclamation, but it is obvious that these people have to do something for themselves. They are telling the world community they will shut the other two nuclear plants down when we give them the money because they need the electricity. They are holding the world hostage. 1 APRIL 11, 1996 AGENDA MEETING ROD... CAD... STATfltENT OF MEETING NOTICE COUNCILMEMBER FAZEKAS NOTED PRESENT tlINUTES FOR APPROVAL PROCLAMATIONS APRIL 11, 1996 TO ADDRESS GOVERNING BODY - Borough Engineer Se\Jer Repair - West Carteret TO ADDRESS GOVERNING BODY: Borough Engineer Borough Engineer Parmar said the sewer repair work in West Carteret is in progress. 30% of the work is done. They have come across some changes while working. Most of these changes are in lengths of the pipes to be replaced. In spite of all efforts sometimes the weak nearby sections give way and a longer lengths have to be replaced, especially on the larger sizes. A detail record is kept for every case and on a day to day basis as and when these occur These will be submitted along with the proper change order. No payment will be made before the proper paperwork and proper approval. So far it is plus 12% ofthe total pipe work items. Sports Facility Borough Engineer Parmar said the Sports site work and lighting work is awarded. Notice to Proceed is given from 4/15/96. A pre-construction meeting was held on 4/8/96 in the Mayoï's Office. The contractor informed them that the concrete poles for lighting has a nine to ten week delivery time. This has been followed and an alternative of galvanized poles is considered to take about three weeks delivery time. A change order will be submitted upon getting full details on this. Mayor Sica said the poles that were put in at the park on the two little league fields and Sullivan Field are special concrete wound poles. The delivery is nine weeks. They can change to galvanized pipe and get them in three weeks. He doesn't see any problem with that. The only difference is a base has to be designed for them. The concrete poles go straight into the ground and the galvanized poles don't. They will have to have a concrete base. As soon as we get a number on it and if it's in the ball park, he will issue an order to change it and do it right away. Borough Attorney Hedesh said if Mr. Parmar had an estimated cost, they could do a change order. Borough Engineer Parmar said PSE&G was contacted to shift the existing five light poles to have the proper size of the field. A pole relocator visited today and assured him they could get it done early. Mayor Sica said the poles were put on the sidelines and kids can run into the poles. There is not enough room to play soccer or football. The field is not regulation size. The stands will have to be moved and take out the walkway because the poles will come to the other side of the walkway. This will give us the regulation size field and some room so the kids don't crash into the poles. Public Service will move them at no cost to the Borough. Borough Engineer Parmar said the result of the Sport Complex bid is submitted. The contract can be awarded after other requirements are filled. Mayor Sica said they should award the bid to the low bidder. He said they could have it passed at the Council Meeting and he has ten days to sign it, but he will sign it right away. That is the other requirement. They can't do it until the money is there. They are going to pass a $275,000 Capital Improvement Ordinance. They are going to borrow a bond anticipation note. Any bank will give a city like Carteret a note. We only have to pay the interest on that note every year for five years We can sell the bond anytime between year number one and year number five. The reason it was done that way is because sometimes the interest rate is real high. ') ~ Mayor Sica said people pass bond anticipation notes until the interest drops down. We are not going to do that. We can pay the bond off anytime we want or any portion of the bond. Once Green Acres approves the sale of Leffert St., we can apply that money and whatever other money from Green Acres land to payoff that anticipation note and not have to bond it for a long period of time. We will pay down on it immediately. Borough Attorney Hedesh said he would review the bond. Borough Engineer Parmar said an emergency has come up on the Main Pump Station. Pump #3 is seized and requires repairing it on an emergency basis. Six years before, the same pump had to be repaired. He has called the same person and asked him to let him know if there is any manufacturing defect. However, we have to get this repaired, so any emergency repair work resolution is requested for an amount not to exceed $12,000.00. Mayor Sica said we have three identical pumps. About 11/2 years after we put the pump station on line, Number 3 pump went down. We had to have it repaired. It cost $8,000.00 at that time to repair it. The warranty was over. There is no reason if pumps #'s one and two are running and number three is the least used pump, then there is something wrong with the original building of or the original casting of the pump. We are going to get the same guy in that rebuilt it, but this time we want to know why it went again. The other two pumps don't have any problems and there is no reason that we are on our third pump on #3. Councilmember Fazekas asked how often do they do a spot check on the pumping stations. Mayor Sica said every day. Councilmember Fazekas asked ifthere was a log filled out. Mayor Sica said yes Councilmember Fazekas asked for a copy of the log. Mayor Sica said he could go down and look at the maintenance book. Borough Engineer Parmar said all the pumps are checked every day. Councilmember Fazekas asked if there were specific checks that are made? 3 Mayor Sica said Councilmember Fazekas would have to see it to understand what they are saying. He said sometimes number 3 pump doesn't go on for weeks. It goes on when we have a wet association. Each pump is able to pump so many hundreds of thousands gallons of water an hour. When we get a heavy rain and we go from a million and a half gallons a day to six million gallons a day for a certain period of time that third pump comes on. It is all automatic. He said he thinks that the problem came in when they cast the housing where the bearing goes in, a little bit off. That bearing may overheat and seize it up. Library Industrial Road - Phase II Parking Lot - Borough Hall Mayor Sica said they will see what it is when they take the pump out and they will determine ifthere is something mechanically built wrong with it, they will call an expert There is no such thing as a warranty on bad workmanship. Borough Attorney Hedesh said they would hold the discussion on Cartell in Closed Session. Borough Engineer Parmar said a set of drawings for the Library were received yesterday and this is being reviewed. Borough Engineer said he approached the Woodbridge Engineer to set up a meeting with him and the Woodbridge Mayor for the project of the Industrial Road extension Phase II. Borough Engineer Parmar said the necessary paperwork for the D.O.T. is done to make the Borough eligible to get 75% of the D.O.T. Grant money, as soon as D. O.T. project is awarded to the contractor. Mayor Sica said in the past when we got a grant from the state to fix the road and we gave out the contract, we would sometimes have to advance the contractor some of our own money to get the job done. The state would then reimburse us. Now, because of the way we have been submitting our paperwork, they will give us 75% of the money as soon as they approve the project. Councilmember Failace asked if they know how much the grant money is? Mayor Sica said it is whatever they approve as the estimated cost of construction. They approve 75% of the money immediately instead of having to wait for it. Mayor Sica said Mr. Parmar is setting a meeting up between the city of Woodbridge and the borough. They are going to take $50,000 out of our enterprise zone money. The Enterprise Zone Committee approved it. We are going to use it to engineer and design the second phase of the Industrial Road. We don't want to do it unless we are on board with Woodbridge that they are going to continue the project all the way across. If they aren't going to do it we would have to take a different approach and bring the road up behind the slaughterhouse. Woodbridge does not want us to do that. They want us to go all the way across. They cannot drag their tèet because it is imperative that we get that second part of the Industrial Road in there. Councilmember Failace asked if they had a date for that meeting. Mayor Sica said they are trying to set it up. He said he would let everyone know when it was set up. Councilmember O'Brien said Borough Engineer Paonar told him the requisition for the parking lot at Borough Hall is all set to go. He said Councilmember Semenza wanted to combine this job with the parking lot at the Borough Garage. 4 Mayor Sica said that can't be done. We will get this done and worry about the other at a later date. 1ß:. ORDINANCES Public Hearing #96-10 Providing for Recreation Facility, Appropriating $275,000.00 from the Capital Improvement Fund. RESOLUTIONS: 1. Directing Issuance of Various Raffle Licenses. 2. Amendment to 1996 Temporary Budget. Mayor Sica said they got their allotment from the State and they have been cutting it. Last year they gave us $400,000.00 and they gave us the same amount this year. They are preparing to finalize the Municipal Budget. There are some other avenues of what we anticipated as a ten cent raise, we should be able to bring it down to a more manageable four or five cent raise. They are always one year ahead in paying the pension funds, so they will turn around and not pay the pension fund this year because it is already paid. That is a $400,000.00 savings. We will take $100,000.00 of that money an put it into Capital Improvement for things like the parking lot and the new computers we are going to get. Then we don't have to bond for that. We will take $100,000.00 and put it into an unspecified salary account. Every once in a while we get hit with a retirement and that has to come out of the current year's budget unless it was budgeted for in prior years and put it into a trust. That is what we are going to attempt to do. We are going to put $100,000.00 in there and add to it every year until such time we have a comfortable cushion. He said he will speak later about settling with the first union and no raise was given. 3. Renewal of 1995/1996 Trailer Park License - Carteret Mobile Park. 4. MONROE TOWNSHIP - Requesting State Legislature Examine an Alternate Method of Funding Schools that does not rely on Regressive Property Tax. 2. BELL ATLANTIC - Public Hearing, April 23,1996 - New Brunswick and April 24, 1996 - Newark, New Jersey on options of introducing two additional area codes. MATTERS FOR DISCUSSION Sports Facility MATTERS FOR DISCUSSION: 1. AWARD OF BID - Sports Recreation Facility. Mayor Sica said if everything is okayed by the attorney they will award it. Police Recognition 2. CHIEF SICA a) Requesting recognition for actions ofLt. Auker's crew in assisting in arrest of murder suspect. Mayor Sica said to give them certificates and invite them to the Council Meeting. College Credits b) Requesting meeting concerning payment of college credits. Mayor Sica said they can set up a meeting, but it is not going to change. He went through the college credits and does not feel they should back off more than one inch. He doesn't care what they got in the past, they are not going to get it in the present or the future. Councilmember Failace said the letter in the mail stated that it was in violation of their contract, he said it wasn't. Mayor Sica said as far as he is concerned it is not. As far as this Council is concerned it is not. We are going to pay them for the college credits that are job related. He doesn't consider Beginner Tennis as job related. He said they will meet with them any time they want. Borough Attorney Hedesh asked who was requesting the meeting? Municipal Clerk Barney said the Chief. Mayor Sica said if the Chief wants the meeting, they are not giving them any meeting. He read part of the Chief's letter. He asked the attorney if they didn't have to file a grievance on this? He said to have the meeting with them. Borough Attorney Hedesh said the employees are not asking for the meeting, management is. 6 Mayor Sica told Chief Sica that the employees can file a grievance if they so wish and they will set up the grievance procedures at that time. "" 3. JOHN W ANSKUS - Request for payment. Borough Engineer has recommended $19,783.00. Mayor Sica said this is on the library design. Mr. Wanskus is requesting partial payment. Councilmember Failace said Mr. Wanskus was requesting a lot more. Mayor Sica said it didn't matter what Mr. Wanskus was requesting. He can put a determination that when he did the first set of drawings that he is 50% complete. That is his determination. That is not the Mayor's determination. The Mayor's determination is he is 13% complete and that is all he is getting. BUSINESS TO BE ADDED: COUNCILMEMBER F AILACE asked about the $275,000 for the Sports facility. The original bond was $500,000 and when up to $707,000. He asked why are they going $275,000 instead of the exact amount? Are they anticipating something else? Mayor Sica said no. He said they can float a bond anticipation note for anything. They only pay on what you take Ifwe only take $200,000, that is what we pay interest on. It's always better to put more down. It's just paperwork. Councilmember Failace said he had a question from some of the people involved with softball. They have the All-Star Games running all summer. Will they be able to use that field for games at the end of July. Mayor Sica said yes. That isn't a problem. The construction of the building will have no bearing on the fields. If they can get the light poles in three weeks, even the little league can get some benefit out of the lighted field this season. Councilmember Failace asked if they award the bid next week, when would the construction begin? Mayor Sica said probably 30 days before they start anything. 45 days before they start actual construction. The initial construction is tearing dowll those gas stations and he will do that on a Saturday. COUNCILMEMBER FAZEKAS wanted to know when they should turn the Internet on? It is ready. Mayor Sica said now. 7 Councilmember Fazekas said there is a spot on thp ",êernet for businesses if the want to post their address, phone number and information on their business. He said they should establish a fee for this service. Borough Attorney Hedesh said they should make it $] 0.00 per month. Sewers - Schools RESOLUTION #96-109 Closed Session Adopted Adjourned Into Closed Session MEETING OPENED ADJOURNED Mayor Sica said he is going to get a list of all the businesses in Carteret from Pat Holden and send them a letter asking them if they want to put something on the Internet. He said they will establish a fee and it will pay the $85.00 a month the borough has to pay to be on there. MAYOR SICA said they have to put a resolution on to refund the $2,300 to the contractors that is doing the schools. He said the contractor came in and paid for the fees to tie into the sewers and then we turned around and said the school didn't have to pay those fees. The problem is the contractor paid it already. Ifhe doesn't get his money back, he will charge the schools the fee. RESOLUTION #96-109 was introduced by the Mayor and was referred to the Council for action. Upon MMS&C, by Councilmembers Failace and Bialowarczuk RESOLUTION #96-109 "RESOLUTION TO GO INTO CLOSED SESSION" was adopted. Upon individual roll call vote, Councilmembers Bialowarczuk, Failace, Fazekas, Feingold and O'Brien voted in the affirmative. Couuncilmember Semenza was noted absent. Upon MMS&C, by Councilmembers Failace and Bialowarczuk and unanimous affirmative vote of the five (5) Councilmembers present, the meeting was adjourned into Closed Session. Upon MMS&C, by Councilmembers Feingold and Bialowarczuk and unanimous affirmative vote of the five (5) Councilmembers present the meeting was opened at 8:29 P.M.
