A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
ESTABLISHING "AB408 ADMINISTRATIVE MANUAL"
WHEREAS, Assembly Bill 408, Chapter 1244, mandates the
transfer of parking citation processing functions from the courts
to the cities between July 1, 1993, and January 1, 1994; and
WHEREAS, cities and/or their designated processing and/or
issuing agencies are required to esta blish an administrative review
procedure for those persons desiring to contest parking citations;
and
WHEREAS, in that regard, there has been prepared for the use
of California cities an "AB408 Administrative Manual" which should
be approved by the City Council subject to modification by any
written review procedure hereafter adopted by the City.
NOW, THEREFOR, the City Council of the City of Lynwood does
resolve as follows:
Section 1. That the City Council approves the written
procedures for the collection of said penalties and for
administrative review which said procedures when adopted shall
govern where inconsistent with the "AB408 Administrative Manual"
attached hereto as Attachment "A^, which is hereby approved.
Section 2. That the City Council authorize the City Manager
to appoint an interim Hearing Examiner to conduct the
administrative review requirement of AB408 for a period not to
exceed three months at a cost not to exceed $900.00.
Section 3. That the City Council authorize the City Manager
during the interim contract period to appoint a permanent qualified
independent contractor who is a Lynwood resident to conduct the
adjudicative program on a permanent basis.
Section 4. That the City Council approve the appropriation of
$5,000 from the unappropriated Fund Balance of the General Fund to
1-4117-4220.
Section S. The City Clerk shall certify to the adoption of
this Resolution and the same shall be effective on January 1, 1994.
