AN ORDINANCE AMENDING ORDINANCE NO. 1998-218 (SUBDIVISION
ORDINANCE) OF THE MUNICIPAL CODE OF TIFFIN, IOWA, REGARDING THE
DURATION OF MAINTENANCE BONDS
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:
Section 1: Purpose. The purpose of this ordinance is to amend Ordinance No. 1998-218,.of
the Municipal Code of Tiffin, Iowa, so as to increase the duration of maintenance bonds
Section 2. Amendment. City of Tiffin Ordinance No. 1998-218, Section 3.05 Maintenance
Bond Required is deleted and the following section inserted in lieu thereof:
3:05 MAINTENANCE BOND REQUIRED
The owner and subdivider of the land being platted shall be required to
provide to the City, proper maintenance bonds satisfactory to the City, so as
to insure that for a period of five (5) years from the date of acceptance of any
improvement, the owner and subdivider shall be responsible to maintain such
improvement in good repair. The City may, at its sole discretion, accept
alternative sureties to maintenance bonds to insure the workmanship of the
improvements accepted by the City. A performance bond will also be required
per Section 5.12.
Section 3. Penalty Provision. The city may elect, at its sole discretion, to prosecution any
violation either as simple misdemeanor or a municipal infraction.
Section 4. Repealer. All ordinances or parts of ordinances in conflict with the provisions of
this Ordinance are hereby repealed.
Section 5. Severability. If any section, provision, or part of this ordinance shall be adjudged
to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a
whole, or any section,provision, or part thereof not adjudged invalid or unconstitutional.
Section 6. Effective Date. This ordinance shall be in effect after its final passage, approval,
and posting as provided by law.

Tiffin, Iowa, Councilperson Petersen introduced Ordinance No. 2006-275 , and
moved that it be given its first reading. The motion was seconded by Councilperson
Wright

declared the motion carried, and Ordinance No.2 00 6-2 79 ,was read the first time and discussed
and placed on record.
On the 11 thday of January 2006, at a regular meeting of the Tiffin City Council,
Tiffin, Iowa, Councilperson Dils introduced Ordinance No. 2 0 0 6 2 7 5 , and
moved that it be given its second reading. The motion was seconded by Councilperson
Demuth
Ayes: Bartels, Wright, Dils, Petersen, and Demuth
NOne. Absent: None.
Nayes:
Five members of the council being present and having voted "Aye", Mayor Glenn R. Potter
declared the motion carried, and Ordinance No. 2 0 0 6-2 7 5 , was read the second time and
discussed and placed on record.
On the 1 1 th of January 2006, at a regular meeting of the Tiffin City Council,
Tiffin, Iowa, Councilperson Di 1 s introduced Ordinance No. 2006_275 , and
'moved that it be given its third and last reading. The motion was seconded by Councilperson
Petersen
Ayes: Petersen, Bartels, Wright, Dils and Demuth
Nayes:None. Absent: None.
Fivenembers of the council being present and having voted "Aye", Mayor Glenn R. Potter
declared the motion carried,,and Ordinance No. 2 0 0 6-2 7 5 , was then placed on its last reading
and was read the last time.
Thereupon, it was moved by CouncilpersorD i i s and seconded by
Councilperson Wright that Ordinance No. 7 n n 6-2 7 5 be
placed upon its final passage and adopted.
Ayes: Bartels, Demuth, Petersen, Dils and Wright
Nayes: None Absent: None
Fivemembers of the council being present and having voted "Aye", Mayor Glenn R. Potter
declared the motion carried,and the ordinance was passed and adopted.
'Whereupon the Mayor declared that Ordinance No. 2 0 0 6-2 7 5 be adopted and
signified his approval of same by fixing his signature thereto.
Passed by the council on the 1 d4 ho f uary 2006 and approved by the mayor on
the 1 1 th day of January 2006.
