The Agenda Meeting of the Mayor and Council of the Borough of
Carteret preceding the Regular Meeting June 20, 1996, was held on
Wednesday, June 12, 1996, 7:00 P.M, Council Office, Municipal
Building, 61 Cooke Avenue, Carteret, New Jersey.
The following were noted present:

Mailed to The Home News and Tribune, The Star Ledger and posted
on the bulletin board on June 7, 1996. Also, notice was published in
The Home News & Tribune on June 8, 1996.
MINUTES FOR APPROVAL: May 16, 1996.
BIDS: Yearly Catch Basin & Sewer Pipe Rehabilitation
TO ADDRESS GOVERNING BODY:
a) Borough Engineer
b) James Mancuso
Mr. Parmar reported that the sewer repair work in West Carteret is in
progress. The TV inspection work has started.
The agreement with the Middlesex County Road Department has been
executed and sent. The County is in the process of having the
agreement executed by the Freeholder Director.
Council President O'Brien stated that Ray Tobias said that someone
from the County already can down to look at the lot.
The matter of obtaining the permit from the Freehold Soil
Conservation District for the sport's center and the library is being
followed.
The remaining amount of the permit fee to be paid is:
$38.40 sports field project
$454.80 library
The sports field project is in progress.
a) Electrical poles with lights are installed.
b) Football field is topsoiled and graded.
c) Sod is being laid
d) Sprinklers will be required for watering the field. A quote is
obtained. This is requested to be approved as a change order.

The work in the Hill Section done by DeFino is being finalized. There
is a net increase of$21,785.16 in line items and additional work as:
Hi II Section
-Change in PVC from 10" to 12"
-Base for Manhole Change
-Additional Manhole

Approval of a final change order of $24,408.00 is required to finalize
the project.
Steps -
Borough Hall
The specs for renovating the steps of the Borough Hall are being
prepared. They are expected to be completed by next week
Councilmember Bialowarczuk asked if we are changing the steps.
Council President O'Brien said that Mr. Parmar is recommending a
cap over them. He said that the specs should be ready for the next
meeting so we will need a resolution to advertise for bids.
Catch Basins
Councilman Vesey asked the engineer what the status is on the catch
basins on Longfellow Street.
Mr. Parmar explained that he already told the contractor that if they
don't do the work by Friday, we will have it done and deduct it from
their payments.
Freehold Soil
Conservation
District
Councilman Failace asked ifthe Soil Conservation District is part of
the stop construction order.
Mr. Parmar said no. The law is that we should not do any work
unless the permit is. (inaudible).
Councilman Failace asked why the sod is being put down before we
have the sprinkler system put in.
Mr. Parmar spoke but was inaudible.
Blanchard
Street
Councilman Vesey asked about the status of the sewer work on
Blanchard Street.
Mr. Parmar said that it will be handled the same as the catch basins.
If they don't finish the job, we will have it done and deduct it from
their payments.
Councilman Vesey said that Ted Smick is getting a lot of calls on it.

Mr. Parmar said that he is also getting calls.
John Wanskus
Councilman O'Brien asked if part of the agreement with John
Wanskus was that he would have the specs and prints for them by
May 27th.
Mr. Parmar said that John Wanskus submitted everything on that last
day. He said that he recommended paying him $64,283.18 only after
receiving everything and finding that there are more things to be
attended to. That is why he reduced the amount from $88,864.00.
Mr. Wanskns didn't like it but to cover the Borough it had to be done.
Councilman Fazekas asked we got any date, a time period, for the
library.
Mr. Parmar said that John Wanskus has to give us a date and then we
have to decide whether we have to accept that date or not.
Councilman Fazekas asked Mr. Parmar ifhe will follow up on it if he
doesn't get back to us in a period of time.
Mr. Parmar said absolutely.
JAMES MANCUSO -
Mr. Mancuso showed the Council pictures of various tank cars and
spoke about the dangerous and extremely flammable materials that
they carry. He said that these tank cars have been at the back of
Jackson Avenue and Monroe Avenue for the last 6 weeks. Two years
ago they had a meeting with Conrail and they had agreed to keep
these things off of the back of their property. Six weeks ago,
Woodbridge had sued Conrail. Mayor McGreevey came over his
house about 2 weeks ago and they explained what was going on to
him. Mayor McGreevey said that they have an agreement with
Conrail to get the trains out of there.
Mr. Mancuso said that if you read the agreement, it doesn't say that
they are taking the trains out of there. They're going to leave the
trains. The aide to Mayor McGreevey said that it doesn't read like
that and that they are going to take out the trains.

Mr. Mancuso noted that if they read it, that is not what they will find.
He said that he had a meeting Monday with ..(inaudible)..and Mr.
Garafalo. Their attitude at first was a little obnoxious. He explained
to them that last year they told Woodbridge that if they would let
them go in the yards, they would put a fire suppression system, a
sprinkler system in and that there would be no trains back there.
Woodbridge had agreed to this and they went in. He said that he
showed them the pictures and noted that there are no fire hydrants
back there. The only access getting there from Carteret is off Jackson
Avenue. There is no sprinkler system. There is no fire retarding
system. If one of these tankers goes, you have to evacuate 1/2 mile
according to the hazmat book Anybody within a certain amount of
feet !Tom this is dead. He called Mr. Greenberg and asked him what
kind of plan Carteret has iflightning were to strike one of these cars.
There is no contingent plan. Emergency Management doesn't have
any real kind of plan for this because they don't have any equipment.
If one of these tankers goes, it'll be a chain reaction. Never mind a
quarter mile of Carteret, there's going to be no Carteret. He said that
he lives there. He knows what it is like. They had agreed to put a
marker where Port Reading ends and Carteret begins. That doesn't
solve the problem. We solved it a year and a half ago and we're
solving it now.

Mr. Mancuso stated that last year there was a bill that was going to be
introduced which would prohibit trains within 500 feet of anyone's
home. At the time, Randy Corman was going to present it but he lost
the election so the bill never went that far.
Mr. Mancuso asked the Council to come up with an ordinance that
prohibits the trains The reason they came to Carteret is because
about 2 years ago, Linden came out with an ordinance about where
they were storing trains. They came to Carteret. Woodbridge kicked
them out of the yard down there because they came up with an
ordinance making them spend almost a million dollars. We have
nothing on the books. The Council should write to other towns and
get a copy of the bill that was going to be passed and push for this
thing to be re-enacted. This town is surrounded by tracks and they
can put these trains anywhere they want. If one of these tanks went
up, you'd have a lot of dead people and children. If you inhale type 3
sulfuric acid, you die. This Council should get together on something
like this. There is one gentleman who has a house 15 feet !Tom the
tankers. These people are taxpayers in this town. He said that he is
getting as many names as he can on a petition.
Councilman Fazekas asked if Conrail was kicked out of Linden.
Mr. Mancuso said yes. They were kicked out of Linden and
Woodbridge wouldn't allow them to use the yard until they spent
almost a million dollars. They put in a fire suppression system, a
sprinkler system and fire hydrants and yet the same thing that is
sitting there is sitting in back of his house.
Councilman O'Brien asked Mr. Mancuso for a copy of the bill that
Randy Corman was going to submit. He told him to also give a copy
to Bobby Hedesh so that he can prepare an ordinance for next
Thursday.
Mr. Mancuso suggested that someone contact Linden for copies of
ordinances they drew up.
ORDINANCES: Public Hearing -

RESOLUTIONS

1. Directing Issuance of various Raffle Licenses.
2. Approval of ABC License Renewals for 1996/1997.
3. Approval of ABC License - Carteret Mall Liquors.
Councilman Failace asked why this renewal is being done separately.
The Clerk explained that there was a special ruling on the renewal that
was approved by the ABC. Now, we can approve it. They are
without a premise. They are Shop-Rite Liquors.
Council President O'Brien asked what the resolution for Tanaz Parmar
is about.
The Clerk explained that the Mayor put a resolution on to
congratulate Mr. Parmar's daughter for graduating !Tom Cornell.

COMMUNICATIONS:
I. Twp. of East Brunswick - Resolution opposing reform of OSHA as
proposed in S-1423.
MATTERS FOR DISCUSSION:
1. Ordinance #96-11, Tabled 5/16/96 - Re: Attorneys fees for
Professional Services.
Council President O'Brien said that the ordinance has to be changed
from per lot to per application.
The Clerk said that she doesn't know why the ordinance was tabled
[and not amended] at that meeting because she wasn't there.
Council President O'Brien asked the Clerk to check with the Borough
Attorney to make sure.
2. AFSCME Local #3850 - Requesting meeting to negotiate.
The Clerk said that she will set up a meeting with the negotiating
committee.
3. Scottsdale Insurance Co. - Requesting payment of claim,
$6824.00, Re: Mares

The Clerk explained that this was an assault, an alleged failure to
protect someone at a bus stop. They settled it. Resolution for
meeting.
4. Gov!. Finance Officers Association - Requesting resolution
opposing change in accounting system. Okay.

5. Mark Cholowski, Esq. - Requesting additional appropriation of
$410.00 for B&L Tires vs. Board of Adjustment.
The Clerk said that he sent a letter explaining why he went over his
original appropriation and requesting a resolution.
6. William Kolibas - a) Proposed Basketball Camp salary increase.
Director - !Tom $650.00 per week to $700.00
Supervisor - !Tom $250.00 per week to $350.00
Ordinance for meeting.
b) Status - abandoned house at 3 Sharot Street.
Mr. Kolibas said that the grass is so high that they have to cut it. The
house is abandoned.
The Clerk said that we have to find out who owns it.
Mr. Kolibas said that it belongs to the Borough.
The Clerk said that she will double check.
Council President O'Brien stated that we may have to demolish it.
The Clerk said that she will turn it over to Attorney Hedesh.
Councilmember Bialowarczuk said that it is overgrown with poison
IVy.
The Clerk said that then the Board of Health should be called.
Council President O'Brien said that we have to make sure that the
Borough owns it and then maybe we can demolish it.
7. Ordinance #96-19, Tax Abatements has to be amended to correct
% steps.
Council President O'Brien said that instead of ditto signs, the years
have to be put in.
8. ABC Licenses - (Informative)
a) 562 Roosevelt Avenue (Peek-a-Boo's) - Received Special Ruling
from ABC for 1995/1996 but the Borough did not take action. Has
filed for 1996/1997 Special Ruling.

b) V&C Entertainment, Inc. - has filed for a Special Ruling from
ABC.

The Clerk said that she will turn these ABC license matters over to the
Borough Attorney.

BUSINESS TO BE ADDED
Councilman Failace asked for a resolution to keep America's Most
Wanted on TV.

The Clerk said that she has a Bingo Amendment for St. Elizabeth's
Church Holy Name Society that came in late.

She noted that the Soap Box Derby will be July 13, 1996.

Councilmember Bialowarczuk asked for certificates for the Girl's
Softball Team.
Councilman Vesey said that the MDA wants to thank all of the people
involved with helping them out. They want to have another one next
year.

Councilman O'Brien asked for a resolution for Michael LaPree who
ran the fund drive.
Councilman Fazekas asked for certificates for the firemen who fought
the tank fire.

Councilmember Bialowarczuk said that the Mayor is at the tank fire
now and that is why he couldn't be here tonight.
There being no further discussion, upon MMS&C, by
Councilmembers O'Brien and Vesey and unanimous affirmative vote
of the full membership present, the meeting adjourned at
approximately 7:35 PM
