Sica on Thursday, July II, 1996 at 7:00 P.M., Council Office, Municipal Building, 61 Cooke Avenue, Carteret, New Jersey. Upon individual roll call, the following were noted present: Councilmember Deborah Bialowarczuk " James F ailace " Jack Fazekas " William Feingold " James O'Brien " John J. Vesey, Jr. Also noted present was Borough Attorney Robert A. Hedesh. Mailed to The Home News & Tribune, The Star Ledger and posted on the bulletin board on July 3,1996. MINUTES FOR APPROVAL: May 17,22, 30 & June 6, 1996. BIDS: a) Diesel b) Fuel Oil c) Gasoline d) Junk Vehicles TO ADDRESS GOVERNING BODY: Borough Engineer Pratap Parmar Borough Engineer Parmar stated they are T.V. inspecting and sealing cracks to stop the leaking in the pipes where ever problems are found, are in progress in West Carteret. Protruding pipes ITom the house connections create problems, as this does not allow either T. V. cameras or the repairing equipment to go through the pipe. A close record has been kept. More detailed reports with its impact and required change order will be reported after all inspection is done, before doing any more work in these areas. l Mayor Sica said after they get these projects finished they will have to decide what they are going to do with the protruding house connections. JULY 11, 1996 AGENDA MEETING PRESENT STATEMENT OF MEETING NOTICE MINUTES FOR APPROVAL BIDS TO ADDRESS mVERNING BODY Borough Engineer Pratap Parmar JULY ::.1., "996 ßoLt,u.gh Eng.;neer Con't. Borough Engineer Parmar stated that the approval of the soil conversation permit for the library has been obtained. The architect has submitted the revised floor plan of the library accommodating most of the suggestion of the Library Board and as per his verbal report he is working on finalizing the drawings. Mayor Sica said the Library Board came in at the last minute and wants to change other things. That means we have to change the drawings and that has all been done. Hopefully, within two weeks we will be able to go out for the bids on it. Some of the things he did not allow. Borough Attorney Hedesh said he has been playing referee on this for two weeks. He gave them seven days to get this in. Mayor Sica said they have had the drawings, the models are here and at the last possible minute they decide they want to put a wall and a private bathroom for the employees. The final plans should be ready and we will go out for the bids in a couple of weeks. Borough Engineer Parmar said the sports field project is practically complete The only remaining works are adjusting one light to the right direction and put a new ballast on another light. Mayor Sica said that the ballast was broken when they put it up. Borough Engineer Parmar said the contractor will be maintaining the sod until July 18, 1996, by then the sprinklers should be in. Mayor Sica said they got three prices on the sodding of the field and they ranged ITom $20,000 to $9,000. We went with the $9,000 price and they are going to put it in next week. Borough Engineer Parmar said the Middlesex County Road Department informed him that the Parking Lot resurfacing will be done the week of August 15, 1996, as there is no meeting of the Freeholders before this date. Mayor Sica said we are going to save a couple of thousand dollars on this, but we have probably generated about $2,000 in paperwork. He said he had to sign more papers to get this parking lot done then he had to sign to become the Mayor. Borough Engineer Parmar said the specifications for renovating the steps of the Borough Hall entrance are drawn. These will be typed up and the other contract conditions will be added. Copies will then be made out and given to the Purchasing Agent for inviting bids. This will be done before the next Council Meeting. Borough Engineer Parmar stated that the application for the D.O. T. grant for 1997 is being prepared. A resolution authorizing the Mayor to sign is required. The deadline for submittal is July 26, 1996. Mayor Sica directed the Clerk to put the resolution on for the Council Meeting. !! .l'I\t4¡>~"""I,!tt¡l1!r~~" Borough Attorney Hedesh requested a copy of the ITont page of the application. Borough Engineer Parmar said the application to approve 75% payment of the contract value for Leffert Street improvements has been submitted to D.O.T. Borough Engineer Parmar stated that survey work is required to be done for a) property at crossing ofIndustrial Highway and Roosevelt Avenue and b) Sabo Pump Station and adjacent area acquisition ITom Shalom. Authorization for both these surveys for the amount not to exceed $2,000.00 is requested for John Cilo. Mayor Sica said that is up in West Carteret where we want to change the Pump Station. We are going to have to require a piece of property from Shalom. We are not going to have any problem with it, but we still have to do a survey It's a green area that has to remain green from their factory to the houses back there. We should authorize this and get them both done. That's about ready to go out for bid and that will help out in West Carteret because it will relieve about 40% of all the sewerage that goes to Beverly Street. It will not go there anymore and will be gravity fed right to the main pump station. Borough Engineer Parmar stated that Beverly Street Storm Sewer Outlet aligmnent, drawings and specifications were discussed with the consultant on July 9, 1996. These are found to be very satisfactory and ready for bidding. However, the following permits are required prior to bidding: I) CAFRA Permit ITom N.1.D.E.P. because of wetland in Amoco area II) Railroad Crossing Permit from Conrail III) Freehold Soil Conservation District Permit IV) Subsoil investigation. These are being taken up. The progress on these will be reported. Mayor Sica said that will finish up the Beverly Street project. Borough Engineer said the drawings and specifications for the new Sabo Street Pump Station and elimination ofthe Etheridge Pump Station are ready for bidding. The only things required prior to bidding are: I) Subsoil investigation at the Pump Station. Authorization for this is requested for an amount not to exceed $2,000.00 by French and Parello. 3 II) Property Survey by L. S. III) Right of Way along force main. Mayor Sica said we better get French &Parello to do the soil survey because we are not going to put it in unless it is right. JULY 11, 1996 Borough Engineer Con't. Larry Aleksandrich Re: Youth Program - Volunteer Fire Department Borough Engineer Parmar stated that authorization for amount not to exceed $5,000.00 is requested for American Associates to review and advise for West Carteret work as they are the original designers. Councilmember Failace said he received calls on Germak that there was water up there. Mayor Sica told him that will always be like that because that is the lowest spot. Where is the water going to go? He said we got more rain and very few complaints. He said some people said they were having sewerage back up. If they are having sewerage they might be on the wrong line. We are looking at that right now. He sent Mr. Parmar up there to make a survey and give him a written report on it. We had some flooding, but it wasn't bad. Mayor Sica said Germak Drive ends and there aren't any houses back there so there are no sewers back there. We've offered to give that property to the people back there, then they have to pay taxes on it. Half of them want it and the other half doesn't. We can't do anything with it. There was another serious problem on the bottom of Clauss Street. There was a house that was built and there is no catch basin, so all the water runs down there. The water went over the other peoples yard into their swimming pool. He had Parmar go there and look at putting a sewer line from the end of Clauss Street along that piece of property and tie it into the D'Allessio Drive sewer, which then goes to the river. We think that will work and we are getting a price on it. It has to be put in. These are problems that have been there for years, but because of the amount of rain we had, even the ground couldn't take the water. LARRY ALEKSANDRICH, Volunteer Fire Departments #1 and #2 want to create a Youth Program. There are a lot of youths interested and they wait until they are 18 to become Volunteer Firemen. They would like to start a Youth Program for teenagers between the ages of 16 thru 18 to start learning the fire department skills. Mayor Sica said he didn't see any problem, but they will have to run it by the insurance company. He thinks it's a great idea. Ifthe insurance company say okay, we will pass an ordinance establishing it as permanent in both volunteer companies. That is the best way to do it. Borough Attorney Hedesh said it should probably be done by resolution. Mayor Sica said he thinks they should do it by ordinance so it can't be wiped out on somebody else's whim. Borough Attorney Hedesh asked if they wanted him to communicate, by letter, with the insurance companies. Mayor Sica said no. Harold Ferguson can do that. We have been more than fair with them. They are supposed to put a concrete pad under the trailers when they put new trailers in. He has been putting trailers in without the concrete pad. He gave the Building Department a hard time. We are going to hold off on renewing his license until we get a report ITom the Building Department that he is following the letter of the law. 3. COUNCILMEMBER FAILACE - a) Ordinance Re: Conrail. Mayor Sica said he is meeting with them. Councilmember Failace said last night at 2:00 AM. they were banging and clanging. They are not listening to anything. We should put something on that they have to put a fire suppressant system in there if they are going to be there more than 20 minutes. Borough Attorney Hedesh said you could write ordinances rrom now until the cows come home. Railroads have a traditional place in this country. F ederallaws are written for them. Mayor Sica said they got them out of Carteret, we made a deal with Conrail, that is why he is meeting with a representative rrom Conrail, that they would go into the Port Reading yard. When they tried to go in there the Port Reading Fire Department stopped them rrom doing it. They dragged their feet for two years because the Port Reading Fire Department wanted a Fire Suppressant System installed in those yards. They finally did that and the cars are supposed to be going in there. Councilmember Failace asked that the Mayor let him know the dates of the meeting. Borough Attorney Hedesh said any ordinance we would do would be preempted by federal. You could enforce your state statutes. Mayor Sica said there are two people at the bend where Tennyson meets Monroe, he asked them and then told him they don't have any problem with the railroad anymore. It must be happening more towards Port Reading. Councilmember Failace said it was more towards Port Reading. Mayor Sica said they are not parking where he asked them not to park. It's possible that McGreevey made them mad and they are doing it in Port Reading and we are hearing it in Carteret. He said he never sees any cars there. Councilmember Failace said last night they were there all the way down. Mayor Sica said they will have the meeting with them and take it rrom there. b) Naming Industrial Road after a veteran. Councilmember Failace said they talked about it last year and he wondered if they were going to take it any further. Mayor Sica said that was up to the veterans to give the Borough a list of the veterans that don't have streets named after them yet. We would put them in a hat and draw it. Councilmember Failace said last year they talked about namIng it Veteran's Highway. JULY 11, 1996 MATTERS FOR DISCUSSION Can't. Conrail Industrial Road JULY 11, 1996 Industrial Road Can't. Hill BO\ll Lanes, 562 Roosevelt Ave. V&C Entertainment Mayor Sica said they should ask the veteran groups if they would like to have it as Veteran's Highway or after a specific veteran drawn from the lottery. Borough Attorney Hedesh said they should hold this. He said he didn't think we owned the road. He was always under the impression that there was a resolution. Mayor Sica said there was a letter ITom the state asking us to accept the road and he told them no, not until they get the "as built" drawings that shows they conformed to what they said they were going to put there. We have never received the "as built" drawings. On the "as built" drawings it shows a holding pond on Beverly Street, which would have probably solved out water problem. They caused the water problem by the Borough Garage. There was always a sewer there and they decided to put new sewers and didn't connect that sewer to it and now he is arguing with the State because the State says it's wetlands and it is not wetlands and has never been wetlands. We're going to fill it in. Councilmember Failace asked where they were at with it now? Borough Attorney Hedesh said they will hold off on it. Mayor Sica said it didn't matter, they were going to put the library there. Borough Attorney Hedesh said before they even think about naming it we have to make sure we own it. Mayor Sica said they never got a description of the land that the State took over and wants to give back to us and how can he accept it if he doesn't know what it is. 9. ABC LICENSES - STATUS a) Hill Bowl Lanes, Inc. b) 562 Roosevelt Avenue Corp. c) V&C Entertaimnent, Inc. Borough Clerk Barney said this license was seized and they want to renew. Borough Attorney Hedesh said Hill Bowl and 562 Roosevelt are (Inaudible). On V &C Entertaimnent there was a communication problem in the Clerk's Office. The attorney called him and they are now making application. They are another issue. Hill Bowl and 562 are in another situation because last year 562 appealed to the State for a special ruling. Under the law you can only keep a license in your pocket for two years. Four years if it is by extenuating circumstances, i.e.fire. Both had to apply last year for special rulings. Hill Bowl never applied last year. 562 did apply and it came up a number oftimes last year. He gave the Council a letter asking them for a ruling and they took no action on it. Under the statute, if you take no action, it's deemed to be rejected after 45 days. In effect, 562 is looking for a special ruling this year The position is he blew his chance last year and he doesn't get another chance this year. If they will remember 562 is a problem license. They have had a number of restrictions. The Council was ] 0 minutes trom taking the property when the fire occurred. It's more than four years. Hi1l Bowl didn't apply last year, they are past their year to apply. o " Mayor Sica said the Borough made the mistake on V &C and they will go along with that. He doesn't think they should approve the Hill Bowl or 562 Roosevelt. They both were nothing but problems. Why should we bend over for them. We have enough taverns in town. Councilmember Failace asked if we were saying V&C was okay, but the other two are not. Mayor Sica said yes. 10. AFSCME LOCAL #3850 - Contract Proposals Closed Session 11. JOHN M. ZUBE - Local 8-397 Chemical & Atomic Workers Union - Sun Oil Company implemented "Pay for Performance: Bonus System which pushes drivers to drive faster and harder. Mayor Sica said they have no stand on this. 12. DONALD NELSON - Requesting reimbursement of expenses. Borough Attorney Hedesh said they charged the case and the kid was dead guilty. The Judge asked him to consent to a Borough Ordinance because the guy was (Inaudible) They he sends this. He will respond to this. 13. JOHN W. SPOGANETZ, ESQ. - Requesting that deposit money be returned to buyer of parcel at Borough land auction. Put Resolution on for Council Meeting. 14. W ALTER CHAMRA - asking for a reduced property assessment to be recorded. Mayor Sica said to record it properly and give him his money back. Put a Resolution on for Council Meeting. BUSINESS ADDED I I I I I -L PATRICIA HOLDEN said Mr. Deiner (owner of Sokler's Furniture Store) has problems with neighbors dropping construction debris. He went to the Health Department who tried to give a violation to the building's owner, but the building has been abandoned. They have no recourse. Is there any way the Borough can clean up the debris. Can we clean it up and put a lien on this guy's property. 9 Mayor Sica said yes, we can clean it up and put a lien on the property. He told Ms. Holden to tell Ted Surick to go in there and clean it up, make up a bill and we will put a lien on the property. Borough Attorney Hedesh said he will check on it first. Mayor Sica said it didn't matter. We will clean it up and then decide what we are going to do with the bill. JULY 11, 1996 ABC Licenses Can't. AFSQIE Local 3850 "Pay for Performance" D. Nelson Refund of Depos it Property Assessment BUSINESS ADDED Sokler's Furniture Store JULY 11, 1996 Sharot St. COUNCILMEMBER BIALOW ARCZUK - 3 Sharot Street is supposed to be demolished. Borough Attorney Hedesh said someone asked him to find out about 3 Sharot Street. He spoke to Patrick DeBlasio and found out that the Borough owns 3 Sharot Street. Mayor Sica said we can pass a resolution to demolish it and he will demolish it at no cost to the city. The city has to pay for the permit. Borough Attorney Hedesh said the question was if they could demolish it and that is when he spoke to Mr. DeBlasio and found out we own it. He asked them if they would rather demolish it or put it up for sale? Mayor Sica said it wasn't any good. Borough Attorney Hedesh said let the buyer demolish it. Mayor Sica said to put it up for sale immediately. If no one buys it, he will demolish it Ferry MAYOR SICA said he had a few things he wanted to go into in Closed Session. He said if they have been reading the newspaper about the ferry, he had a representative at that meeting yesterday and we are still in the running for the ferry service. The report that the Port Authority put out in reference to the ferry service makes Carteret even more advantageous. Every one of the reports shows Carteret in the most favorable position. Edison would be 25 miles away. Perth Amboy would be 22 miles away. South Amboy would be 22 miles away and Carteret is only 13 miles. It would take a ferry traveling from Edison a minimum of 50 minutes, Perth Amboy 46 minutes, South Amboy at least 48 minutes and Carteret 35 minutes. Every one of these things put us in the best position to get that ferry. tlayor Councilmember Failace asked if the Port Authority put out that report. Mayor Sica said yes. Everything is right in there for us. He is setting a meeting set up with the Port Authority people and the contractors we are talking to about putting the ferry in. That map doesn't really show the advantageous part of putting the ferry in Carteret. If they put the ferry in Edison, it has to come through two bridges, one is a railroad bridge and the other is the Victory Bridge which would have to open up for each ferry. It will never go in Edison unless they know of a way of jumping over the bridges. In South Amboy, it's fine, but how do you get to South Amboy. There is no way to get in and out of that place, in addition to that you have to cross the bay and in the winter that is not a nice ride. From Perth Amboy they could go across to Tottenville, but what good is that. People don't want to go to Tottenville to get on a train to go to New York. Carteret is probably the most favorable. One of the companies that he is talking to has looked at a 500 passenger boat. He can cut that time down by about 5 minutes. It is a joint venture between this person and two major automobile manufacturers that build engines that want to do this. He will be talking to them within the next couple of weeks. Basically, the Port Authority is saying Carteret is the best place to put the ferry. The ferry is pretty active, he is not sleeping on it, it takes a little longer than expected. 10 ~ /' .,' .' At approximately 7:48 P.M., Councilmember Fazekas was noted absent ITom the conference table. AMOCO _ Attorney Hedesh asked ifthey remembered when Amoco had that big ceremony and they gave us the parking lot? Mayor Sica said yes. He asked if they wanted it back? Borough Attorney Hedesh said no. We don't own it. Mayor Sica said he knew we didn't own it. They just let us use it. Borough Attorney Hedesh said Amoco wants to deed it to the Borough. The situation is that they have a DEP application going in. Their lawyer called trying to figure out what property Amoco owns and Amoco told him they don't own that piece that is paved. He told them he swore they had a dedication. He has been looking for a resolution. Mayor Sica said there wasn't one, he shook their hand. Borough Attorney Hedesh said they want to deed it to us and he will work it out with them. 1 At approximately 7:50 P.M., Councilmember Fazekas was noted present at the conference table. MR. McMICKLE -Borough Attorney Hedesh said he wants it on record that he is in conflict in here because he did the closing on this. When Mr. McMickle bought the house there was a chain link fence on it that runs further. It appear that he is paying taxes on that property, because the tax map has it all the way forward. He doesn't technically own that part of land He is asking that the Borough vacates the property because he is paying taxes on it now. Mayor Sica said it is a sliver of property that runs along Mr. McMickle's property. It is of no value to the Borough. We couldn't sell it to anybody. He said to put a resolution on se\1ing the property to Mr McMickle. NELSON _ Borough Attorney Hedesh said the matter with Nelson is over.
