The Town agrees with one and three. However, in 2 and in the event
that there would be proposed landscape alterations to the private
property that would require a permit, the landscaping may be required
to be brought into conformity. That determination would be made
through the Level II 'review process and in a public hearing. If
nothing happens to the existing landscape located beyond the ROW
line, the landscape non - conforming materials could remain. The
requirement for any permit, triggers the need for conformity to
the code(s).

Mr. Thrasher,
My client, Mr. O'Hare, requests additional clarification from you regarding your Nov 30th email before he
continues to consider purchasing the Anderson property at 960 Indigo in Gulf Stream. He has asked the
Anderson's to help him in this matter and was told by the Anderson's Realtor, Mr. Stele Treu of Keller Williams
Really, that he and the Andersons discussed these issues with you this past week. Mr. Steve Treu told Mr.
O'Hare on Saturday, November 151h that because of these discussions with you, he and the Andersons have
come to the following conclusions and assured Mr. O'Hare that:
• The Town considers the non - conforming hedge located on the town's right -of -way in front of this property
to be "grandfathered -in" because this plant material existed prior to 2004 and may therefore remain until
it dies or is removed, and any replacement plants must be located outside the Town's right -of -way;
• Other plants located on this property that are not listed in the Town's Design Manual, and the previously
mentioned hedge causing the property to not have an open front lawn, do not violate the Town's Codes
and therefore will not be required by you to be removed;
• The existing smooth faced garage doors can be replaced with new smooth faced garage doors because
this property is defined in the Town's Design Manual and the Gulf Stream Architectural Style
Analysis as "Other Various Style" and not Gulf Stream Bermuda Style.
Mr. O'Hare wishes to move forward with this property and requests that you confirm the accuracy of Mr.
Steve Treu's assertions regarding the Anderson Property.
