'Dear Mr. Thrasher, With regards to concerns manifested by several Place au Soleil homeowners with the landscaping work taking place at 2520 Av. Au Soleil, and after having consulted with the majority of the board members we have the following position: 1- We believe the requirement to previously obtain town approval prior to any material landscape or facade work on any property in Place au Soleil should be vigorously enforced. To the extent that that has not taken place, we believe the owners of the property in question should be formally notified by the Town of this infringement and the applicable penalties or consequences applied. 2- To the extent that the landscape work taking place infringes the town code or general principles of landscaping commonly adopted by the town of Gulfstream, we believe the owner should be advised and required to bring their current landscaping to code within a reasonable amount of time and expense. 3- As would be expected, opinions on the landscaping solution adopted vary among board members, but in general there seems to be more concern with the recent work on the East side of the property , due to the set backs and the interference with the existing driveway. It would be the preference of the board that that part of the work be redone in a way more in line with current standards of Place au Soleil. It is also the concern of this board to act objectively in this case, in strict observation of the city ordinances, and avoid selective application of the law, for which we would expect the Town to guide us as to what is the best approach that can be applied equally and consistently to any other property with similar characteristics. I agree that the job does not look up to the standards of the community, however I do think that the areca palms( ?) that were planted are better than the bare, discolored wooden fence that they hide. I believe that the Code requires a setback of 15 feet for the plantings, and he might have that. 1 do have a bit of a problem with the idea of "selective enforcement" of rules when you consider the mess that Herb Schafer's property presents. ( At least the O'Hare's are trying to beautify their property, in their opinion.) With Herb's ficus now partially down on Cardinal Circle, you can clearly see in to his black and unfenced pool. I thought that a black pool was against health code ordinances, and pools had to be fenced or enclosed as a protection for children or others from playing or falling into them. Since his pool is clearly unprotected (I think the term is "attractive nuisance') would our HOA have any liability for not enforcing correction? Do we have a legal responsibility to act? I spoke to a Gulf Stream police officer recently about my concerns about West Nile which is mosquito bome and the standing black water in his pool, but no remedial action has yet been taken that I can see. I knowthat I live next door to him so may be biased.... Specifically the alteration and trenching of the driveway area on the south/east corner of the property. As with any landscape plan we will be requiring a survey to verify the property lines. The O'Hare's have not gone thru the proper channels at Town Hall since this appears to be a full blown landscape change. Bill wants to know what the Board thinks of the landscaping. If we are happy with it in our community, then he is not going to force the issue with the O'Hares. If we are not happy, we are to advise him and he will take the appropriate action. With that in mind, I have already received a phone call from another resident complaining of the work done. Please take a look ASAP and send me back your thoughts - copying all - so we can all be on the same page. I can't believe the Landscape committee would authorize this sort of visual assault Do you know if they are ever going to put a roof on the house. Its been a long time since the old roof has been taken off! Pretty soon you won't be able to see the house at all.
