I flagged the marsh-upland boundary and instructed Mr. Paderewski that if he constructed his wall upland of that line then he would not need a revocable license from the State. If he wishes to construct his wall either on the line or slightly "seaward" of that line then it would require a revocable license from the State. EPD has determined that the proposed activity would be considered a minor land disturbance and therefore a variance will not be required. Please note the following conditions: 1). The pouring of concrete pads within the buffer would not be permissible. 2). A Notice of Intent for coverage under the State's General Permit GAR 100003 for the discharge of stormwater from a construction activity must be submitted to the local EPD district office at least fourteen (14) days prior to the start of construction activity if the total estimated land disturbance exceeds one (1) acre. 3). Best management practices (i.e.; silt fencing and/or other erosion control measures)must be implemented upon the start of the project and maintained for the project's duration in order to minimize impacts on the buffer and the adjoining marsh. 4). A pile driver, if used, should be maintained outside of the buffer as much as feasible. 5). There shall be no grading in the buffer. 6). Any gutters installed should drain outside of the buffer. 7). EPD suggests you mark the 25ft buffer to ensure awareness of its location during construction. 8). All of the undisturbed buffer should remain in its existing state until after construction activity has ceased and all disturbed areas have been properly stabilized. Mr. Richard D.
