Purpose. The purpose of this ordinance is to amend Subdivision Ordinance No. 1998-218, to establish fees for the hook-up of private lot owners to the City's public water and sewer service lines. Section 2. Amendment. The first paragraph of City of Tiffin . Subdivision Ordinance No. 1998-218, Article 3.03 MINIMUM IMPROVEMENTS D)Water Main System in General is hereby deleted and the following inserted in lieu thereof: Article 3.03 MINIMUM IMPROVEMENTS D.) Water Main System in General The subdivider of land being platted shall install and construct a water main systemto adequately serve all lots or parcels of land within the platted area, with due regard to the preseritt and reasonably rforeseeable needs of the entire,area, and,shall.-connectthe same to the City's existing water mains:- 7An yapplicant,for a building permit' shall°:pay a. connection: fee .for...the water line and sewer line connections. The.fee shall be paid at the time of application for a building permit. The following chart indicates;- the fees assessed according to the zoning classification. The Water Main System shall be constructed in compliance with the City of Tiffin DesignStandards. Section 3. Fees. The City Council of the City of Tiffin may increase or decrease the connection fees herein set from time to time as they shall see fit by resolution of the City. Section 4. Penalty Provision. The city may elect, at its sole discretion, to prosecution any violation either as simple misdemeanor or a municipal infraction. Section 5. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. Section 7. Effective Date. This ordinance shall be in effect after its final passage, approval, and posting as provided by law. On the 3rd day of April 2006, at a special meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Petersen introduced Ordinance No. 2006-279, and moved that if be given its first reading by title only. The motion was seconded by Councilperson Wright. Ayes: Wright, Bartels, Peteresen, Dils and demuth. Nays: None. Five members of the council being present and having voted "Aye", Mayor ' Glenn R. Potter declared the motion carried, and Ordinance No. 2006-279, AN ORDINANCE AMENDING THE SUBDIVISION ORDINANCE NO. 1998-218 AND ANY CONFLICTING ORDINANCES TO ESTABLISH FEES CHARGED TO LOT OWNERS FOR CONNECTION was read the first time by title only and discussed and placed on record. Five members of the Tiffin City Council being present and having voted "Aye', Mayor Glenn R. Potter declared the motion carried and Ordinance No. 2006-279, AN ORDINANCE AMENDING THE SUBDIVISION ORDINANCE NO. 1998-218 TO ESTABLISH FEES CHARGED TO LOT OWNERS FOR CONNECTION was read the first time and discussed and placed on record. On the 3rd day of April 2006, at a'special meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Dils,moved that the Ordinance No. 2006-279, AN ORDINANCE AMENDING THE SUBDIVISION ORDINANCE NO. 1998-218 TO ESTABLISH FEES CHARGED TO LOT OWNERS FOR CONNECTON be given its second and thid reading by title only and that the rule requiring a second and third reading and reading on two different dates be dispensed with and wavied. The motion was seconded by Councilpersori Demuth. Ayes: Bartels, Demuth, Dils, Peteresent and Wright. Nays: None. Motion carried. Thereupon, it was moved by Councilperson Demuth and seconded by Councilperson Wright that Ordinance No. 2006-279, AN ORDINANCE AMENDING THE SUBDIVISION ORDINANCE TO ESTABLISH -FEES CHARGED TO LOT OWNERS FOR CONNECTION, be placed upon its final passage and be adopted. Ayes: Wright, Dils, Demuth, Petersen and Bartels. Nays: None. Five members of the council being present and having voted "Aye:, Mayor Glenn R. Potter declared the motion carried, and the Ordinance No. 2006- 279, AN ORDINANCE AMENDING THE SUBDIVISION ORDINANCE TO ESTABLISH FEES CHARGED TO LOT OWNERS FOR CONNECTION, was passed and adopted. Whereupon Mayor Glenn R. Potter declared that Passed by the council on the 3rd day of April, 2006 and approved by Mayor Glenn R. Potter on the 3d day of April, 2oo6.nd having voted "Aye", Mayor Glenn R. Potter declared the motion carried, and the ordinance was passed and adopted.
