AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE
MUNICIAL CODE OF TIFFIN, IOWA, OF THE NED & ANN ALLEN
PROPERTY FROM COMMERCIAL TO RESIDENTIAL ZONE,
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:
Section 1. Purpose. The purpose of this ordinance is to amend the official zoning
map of Tiffin, Iowa, concerning the following legally described property located within Tiffin,
Johnson County, Iowa.
Section 2. Amendment. The following legally described properties:
E '/�, E '/z, SW 1/4, N of Hwy exce 206.25' and exc Lot 1
Brooks Add& exc 1.1 A Hwy 6 and exc w 90' of E
aka Parcel 0628301010
That part of W'/2,E 1/s, SW 1/4 lying N of Hwy#6
aka Parcel 0628301011
That part of SW NW & NW SW of Road Desc as
Auditor's Parcel A in survey Book 32, Page 79
aka 0628326001
shall be changed from zoning classifications C1B-C10 (Neighborhood Business and
Restricted Office) and C2B-C2O (Community Business and Office and Research) and R-2
(Two-Family shared wall) to R-1B (Single-Family) for property situated north of Highway
#6, and further, that the official zoning map of the City be amended to reflect the changes
described herein.
Section 3. .Penalty Provision.. The City may elect, at its sole discretion, to
prosecution any violation either as simple.misdemeanor or a municipal infraction.
Section 4. Repealer.. All ordinances or parts of ordinances in conflict with the
provisions of this Ordinance are hereby repealed.
Section 5. _Severability.. If any section, provision,or;,part of this ordinance shall be
adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of
the ordinance as a whole, or any section, 'provision, or part thereof not adjudged invalid or
unconstitutional.
Section 6: Effective Date.. This ordinance shal be in effect after its final passage,
approval, and posting as provided by law.
On the 12th day of April 2006, at a regular meeting of the Tiffin City Council,Tiffin, Iowa,
Councilperson Wright motioned to approve a first reading by title only of Ordinance

No. 2006-280, AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF
THE MUNICIAL CODE OF TIFFIN, IOWA, OF THE NED & ANN ALLEN-
PROPERTY FROM COMMERCIAL TO RESIDENTIAL ZONE, which was seconded
by Councilperson Demuth. Ayes: Petersen, Dils, Demuth, and Wright. Nays: None.
Abstain: Bartels. Motion carried.
Five members of the Tiffin City Council being present' and having voted "Aye",
Mayor Glenn R. Potter declared Ordinance No. 2006-280, AN ORDINANCE
AMENDING THE OFFICIAL ZONING MAP OF THE MUNICIAL CODE OF
TIFFIN, IOWA, OF THE NED &ANN ALLEN PROPERTY FROM COMMERCIAL
TO RESIDENTIAL ZONE, was read the first time by title only and discussed and placed
on record.
On the 12th day of April 2006, at a regular meeting of the Tiffin City Council,Tiffin, Iowa,
Councilperson Dils moved that the Ordinance No. 2006-280 be given its second and third
reading and that the rule requiring a first, second and third reading on three separate dates be
waived and dispensed. The motion was seconded by Councilperson Wright. Ayes:
Wright,Demuth, Dils and Petersen. Nays: Norte. Abstain: Bartels. Motion carried.
Five members of the Tiffin City Council being present arid four having voted "Aye", Mayor
Glenn R. Potter declared the motion carried, and Ordinance No..2006-280,was then placed
on its second and third reading bey title only,,and:was placed omthe record.
Thereupon, it was moved-by C'uncilperson Demuth,and seconded by Councilperson Dils
that Ordinance No. 2006-280, AN ORDINANCE AMENDING THE OFFICIAL
{ ZONING MAP OF THE MUNICIAL CODE OF TIFFIN, IOWA, OF THE NED &
ANN.ALLEN PROPERTY FROM COMMERCIAL`TO RESIDENTIAL ZONE,be read
for the last time and be placed upon its final passage and adopted. Ayes: Demuth, Wright,
Dils and Petersen. AbstainBartels.,Nays: None.

Five members of the Council being present and four having voted "Aye", Mayor Glenn R.
Potter declared the motion carried,and Ordinance No. 2006-280 was passed and adopted.
Whereupon Mayor Glenn R. Potter declared that Ordinance No. 2006-280 be adopted and
signified his approval of same by fixing his signature thereto.
Passed by the Council on the 12th day of April 2006 and approved by the Mayor on the 12th
day of April 2006.
