HomeMy Public PortalAboutOrdinances-2007-281 CITY OF TIFFIN ORDINANCE NO 2007— 281 AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF TIFFIN, IOWA, BY REZONING FROM R-1E TO R-2 AND R-4; APPROXIMATELY 5.66 ACRES LOCATED WEST OF THE 500 BLOCK. OF POTTER STREET, AND A PART OF LOT 6 OF THE JOHNSTON- POTTERFIELD SUBDIVISION, TIFFIN,'IOWA. BE IT ENACTED BY THE,CITY COUNCIL OF TIFFIN, IOWA: • Section 1. Purpose. The purpose of this ordinance is to amend the official zoning map of the City of Tiffin, Iowa, by rezoning approximately 5.66 acres accor ding to the Rezoning Exhibit, attached hereto and incorporated herein. Ya Section 2. Amendment. The approximate 5.66-acre tract, legally-described below, shall be changed from the zoning classification of R-1E, Estate-family (formerly known as A-1, Agricultural) to R-2 and R-4 as shown on the site diagram attached to this draft. The Official Zoning Map of the City of Tiffin is. amended to reflect this change. • R2 Zoning: Beginning at the Northeast corner of Lot #6 of the Amended Plat of Johnston-Potterfield Subdivision; thence S00°24'00"E along the East line of said Lot #6 a distance of 232.76,feet; thence N89°36'00"E along said East line a distance of 55.00 feet; thence S00°24'00"E along said East line a distance of 111.97 feet; thence S89°36'00"W a distance of 387.66 feet; thence N00°24'00"W a distance of 347.94 feet; thence S89°50'46"E a distance of 332.62 feet to the point of beginning containing 2.78 acres more or less. ` n R4 Zoning Commencing at the Northeast corner of Lot #6 of the Amended Plat of_Johnston-Potterfield Subdivision; thence S00°24'00"E along the East line of said Amended Plat a distance of 232.76 Meet; thence N89°36'00"E a distance of 55.00 feet; thence S00°24'00"E along the East line of said Amended Plat a distance of 111.97 feet to the point of beginning; thence"continuing S00°24'00"E along said East line a distance of 234.05 feet; thence S22°12'05"E a distance of 26.93 feet; thence S00°24'00"E a distance of 64.62 feet to a'point on the South line of said Lot #6; thence N89°41'34'W along said South line a distance of 397.69 feet; thence N00°24'00"W a distance of 318.89; thence N89°36'00"E a distance of 387.66 feet to the point of beginning containing 2.88 acres more or less. . The city may elect, at its sole discretion, to - prosecution•any violation either as simple misdemeanor or a municipal infraction. • Section 4: Repealer. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. - f Section 5. Severability. If any section, provision,.or part'of'this ordinance shall- be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision, or part thereof not adjudged invalid or unconstitutional. Section 6. Effective Date. This ordinance shall be in effect after its final' passage, approval, and posting as provided by law. • On the 9th day of May`2007, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Petersen motioned to approve a first reading by title only of Ordinance No. 2007- 281 , AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF TIFFIN, IOWA, BY REZONING FROM R-1E TO R-2 AND R-4, APPROXIMATELY 5.66 ACRES LOCATED WEST OF THE 500 BLOCK OF POTTER STREET, AND A PART . OF LOT 6 OF THE JOHNSTON-POTTERFIELD SUBDIVISION; which was seconded by Councilperson Dils Ayes:' Dils, Petersen, Demuth; and Bartels Abstain: None. Nays: None. Thereupon, it was moved by Councilperson Petersen , and seconded by Councilperson RA rfp 1 G that Ordinance No 2007- 281 , AN ORDINANCE AMENDING THE OFFICIAL}ZONING MAP OF THE:CITY OF TIFFIN, IOWA, BY REZONING FROM R-1E TO' R-2 AND .R-4, 4. APPROXIMATELY 5.66 ACRES LOCATED WEST OF THE-500 BLOCK.OF POTTER STREET, AND A PART OF LOT 6 OF THE JOHNSTON- POTTERFIELD SUBDIVISION, be read for the last time and be placed upon its final passage and adopted.
