HomeMy Public PortalAbout1996/09/26 The Agenda Meeting of the Mayor and Council of the Borough of Carteret preceding the Regular Meeting of October 3, 1996 was called to order by Mayor Peter J. Sica on Thursday, September 26, 1996 at 7:00 PM., Council Office, Municipal Building, 61 Cooke Avenue, Carteret, New Jersey. Upon individual roll ca\1 vote, the fo\1owing were noted present: Councilmember Deborah Bialowarczuk " Jack Fazekas " William Feingold " James O'Brien " John J. Vesey, Jr. Noted absent was Councilmembers James Failace. AJso noted present was Borough Attorney Robert A. Hedesh. Mailed to The Home News & Tribune, The Star Ledger and posted on the bu\1etin board on September 20, 1997. TO ADDRESS GOVERNING BODY: a) Borough Engineer In the absence of Borough Engineer Pratap Parmar, Mayor Sica read the fo\1owing Engineer's Report: Mayor Sica stated that the T.v. inspection work in West Carteret resumed after getting required parts for the unit. He said no further progress for starting the manhole repairs and sealing work in West Carteret. Mr.Parmar is pursing it with the contractor. C&L Irrigation Company has done nothing to prepare for meter installation for footba\1 field sprinklers. Their payment is withheld as a step to put pressure on them. Mayor Sica said we are trying to get the Water Company to put the lines in to get the sprinklers working and we are having nothing but problems. He wi\1 pursue that tomorrow. Borough Ha\1 Front Step Project bid date is postponed to 1017196 as no contractor has shown any interest. 1 T. V. inspection in the Chrome area is in progress. Inspection - Chrome Area _I SEPTEMBER 26, 1996 Sports Complex Shoreline Federal Blvd. MINUTES FOR APPROVAL ORDINANCES RESOLUTIONS Demolition work of Sports Complex is now completed. Mayor Sica said he met with the contractor that is going to donate the foundation and floor. He said he wi\1 dig the foundation one day next week. He told Patrick DeBlasio to set up an account from that bond money to start paying for whatever has to be done over there. We put a $1,000.00 limit on Baumgartner's. Part of our deal is the contractor will have to put in the concrete, but we have to bring the sewer lines from outside the building to inside the building. The general contractor will be there to layout where he wants the sewer lines, so he wi\1 put them in prior to pouring the walls and pouring the floor. This way that is all in there. In addition to that he was reviewing the bid specifications on the job and it shows that it's a fancy scored block all around the building There is a way that we can probably save ourselves $20,000 to $30,000 by just doing the scored block on the front of the building facing Pershing Avenue and not on the two sides and the back. We can use a colored block that would probably be a dollar or two cheaper per block. That's 9,700 blocks and if we save $2.00 that's $18,000.00. There may be another way to do it. He may eliminate the block work and get it done for $40,000 or $50,000 cheaper, he is working on this. Mayor Sica said Monday they will have another meeting with Shoreline that is in reference to Phase II of the Storm Sewer in the Hi\1 Section. Hopefully, we can get started on that They are supposed to have the final layout and drawings. Mayor Sica said we got a grant for repairs to Federal Boulevard and we are preparing to advertise for bids. Hopefu\1y, we can get it done before the winter sets in. He asked if anyone had any questions? MINUTES FOR APPROVAL: August 15 & 22, 1996. ORDINANCES: Public Hearing #96-23 Amending Code, Section 254-21, Re: No Parking Certain Hours. RESOLUTIONS: 1. Directing Issuance of Various Raffle Licenses. 2. Establishing Handicapped Parking Space - 91 Lowell St. and Virginia Avenue. 3. Approving ABC Transfer - New Cape II to ATMIYA, Inc. 4. Refund of Tax and/or Sewer Overpayments. 2 1 APPLICATIONS: 1. CARTERET VOLUNTEER FIRE DEPT. #2 - Approval of new members, Louis Muzyka, Kevin Gomm, Jr. and Bernard Grilletti. COMMUNICATIONS: 1. BA YSHORE CONFERENCE OF MAYORS - a) Resolution supporting No Early Release for Criminals. b) Resolution supporting proposal to close N.J. Diagnostic Facility in Avenel. 2. COMCAST CABLEVISION - Notification of new channels and rate change. 3. PSE&G - Application for Freshwater Wetlands Permit Natural Gas Distribution System - New Construction. REPORTS: I. Fire Department - August 1996. 1 MATTERS FOR DISCUSSION: 1. WELFARE DIRECTOR - Requesting appointment of Community Service Aide. Mayor Sica said Ms. Muhammad has recommended Lois Laraia. He said to put a resolution on for appointment. 2. BOROUGH ATTORNEY HEDESH - Schwalik property, Post Boulevard. Borough Attorney Hedesh said Mr. Schwalik lives across ITom Minue School. He is the last house on Post Boulevard. Virginia Street runs through there. He wants us to vacate Virginia Street. Mayor Sica asked how wide it was? Borough Attorney Hedesh said it was 30 feet. J The Clerk stated that she looked through a\1 the files and couldn't find anything on it. Mayor Sica said we wi\1 have to get some kind of description of it and see how wide it is. Ifit is too wide and it's a buildable lot, it would have to be put up for bid. If it's nonbuildable we can vacate it and the property owner gets it. He said they will have the Borough Engineer review it. If it's less than 50 feet, we can give it to the guy. Borough Attorney Hedesh said because it's adjoining property to the county park. He said he wi\1look to see ifthere is a way....but, if we vacate it, it has to go to the adjoining property owners. Mayor Sica said it goes to the adjoining taxpayer. He said the county doesn't pay anything. 3. N.J. DEPT. OF PERSONNEL - Promotional Exam for Omnibus Driver. Provisional is Richard Maher. Do Do Not .I want exam. 4. PROPERTY SALE - 3 Sharot Street. Borough Attorney Hedesh said we advertised it twice There was one bidder for $1.00. The provision is that it be torn down within 30 days. The Mayor told him to put it up for bid again. Mayor Sica said it has to be worth more than $1.00. He directed the Clerk to put a resolution on to re-advertise for another sale. BUSINESS ADDED: COUNCILMEMBER O'BRIEN said he had two things. One he will speak about in Closed Session. The other thing is about Frank Raia's letter regarding a Tax Abatement on Harrison Avenue.. He referred to the letter and asked if that was a one family house. Mayor Sica said yes. They were not going to grant an abatement for that. He said it was up to the Council, but he can't see the merit in doing it on that. COUNCILMEMBER FAZEKAS said the Youth Program for the Volunteer Fire Company was passed Borough Attorney Hedesh said we didn't get anything back ITom the insurance company. We have to see ifthere will be a rider. Mayor Sica said because it's additional insurance, but once that comes in they wi\1do it. MAYOR: Mayor Sica said he had a couple of things for Closed Session. - Mayor Sica said he will make an appointment to the Housing Authority, put a resolution on for the Council Meeting. 4 L BOROUGH ATTORNEY HEDESH: AFSCME - Borough Attorney Hedesh said the Council received a letter in regards to the AFSCME Contract and the language. We will wait on that. NIEVES - Borough Attorney Hedesh said we have this Yancy Nieves claim for $25,000.00. They have been asking for the deductible since last year. He asked them to send him details and it appears that it arbitrated al $37,500.00, the insurance company settled for $26,500.00. Mayor Sica said we didn't have a choice, we have to pay it. Resolution was put on for payment at Council Meeting. 1 JOHNSON - Borough Attorney Hedesh said Ihe insurance company asked him about the $18 or 19,000 they paid on the Johnson property and he told that the Council is more than willing to litigate this and if the insurance company wishes to pursue this on bad faith, we wi\1 do this. Johnson is the property where the kids were killed in the fire and the parents of the kids, who were on P. T.!., filed a claim and our insurance company paid them $18 or 19,000. Mayor Sica said they will have to sue us for that. Borough Attorney Hedesh said he told them that the Council was adamant about paying. Even if we lose and get a judgement order. MONTECALVO vs. BOROUGH OF CAR TERET - Borough Attorney Hedesh said he sent them a memo on this. A resolution is needed to approve it. It was discussed in Closed Session. He got this case a year ago, he tried to settle it and they wouldn't settle. We were ca\1ed there for trial on Tuesday. Between Thursday night and Tuesday it was settled Their claim was for $37,000, in his opinion they would never be able to approve some of that. We settled for $9,000.00 so we saved about $25,000. He thinks they got $&,500 from the Department of Transportation. He needs a resoluliol'. to approve the settlement. J Borough Attorney Hedesh said on Montecalvo they need a resolution rreeing up the money that they had for him. It was a Professional Service Resolution for $5,000.00. The total fee was $1,200.00 so they need to free up the remainder so it is unencumbered. JACOBS - Borough Attorney Hedesh said his motion was denied and he has to take depositions and go back. He put them on notice and we are still in the case. Upon MMS&C, by Councilmembers Fazekas and Vesey RESOLUTION #96-271 "RESOLUTION TO GO INTO CLOSED SESSION" was adopted. Upon individual ro\1 ca\1 vote, Councilmembers Bialowarczuk, Fazekas, Feingold, O'Brien and Vesey voted in the affirmative. Councilmember Failace was noted absent. At approximately 7: 1 5 P.M., the meeting was adjourned into Closed Session to discuss personnel matters and litigation. Upon MMS&C, by Councilmembers Fazekas and O'Brien and unanimous affirmative vote of the five (5) Councilmembers present, the meeting was opened. There being no further business or discussion, upon MMS&C, by Councilmembers Bialowarczuk and O'Brien and unanimous affirmative vote of the five (5) Councilmembers present, the meeting was adjourned at approximately 7:36 P.M..
