The Agenda Meeting of the Mayor and Council of the Borough of
Carteret preceding the Regular Meeting November 7, 1996, was held
on October 29,1996, 7:00 P.M., Council Office, Municipal Building,
61 Cooke Avenue, Carteret, New Jersey.
The following were noted present:

Noted absent was Councilmember Fazekas.
Also noted present was Borough Attorney Robert A. Hedesh.
Mailed to The Home News and Tribune, The Star Ledger and
posted on the Bulletin Board on October 24,1997.
a) Borough Engineer - The Clerk said that Parmar wouldn't be
there. The Mayor would have to read the report.
Mayor Sica asked if they had a copy of Parmar's report and if they
understood it or did they want him to explain.
Councilmember Vesey said he is just looking for one thing.
Councilmember Failace said Hermann Avenue.
The Mayor said it was right there. (Inaudible) the road, cross
Hermann Avenue and Whittier Road An inspection was made on 224
our sketches (inaudible). The sketch shows there is four (4) big pipes
coming in.. A 66 inch pipe going to a 72 inch pipe. There are four (4)
sinkholes in different spread out locations. On Middlesex Avenue at
the crossing it is unusually high. The railroad crossings on
Romanowski and Hermann Avenue are more or less high causing
different effects on traveling on the road. The houses have to be raised
and the road dropped.. He said there two (2) sixty six (66) inch
sewage pipes coming into two (2) seventy two (72) inch storm lines
at the crossing so it is likely that some of the pipes around Linden
Street might have settled. In the past the road service might have done
the following and then contour. The solution is to redo the crossings
and improve it.

Mayor Sica said now what we can do is let someone do some
engineering work on the thing. He said the first thing we have to do
is television all those big pipes coming in there and make sure we don't
have any leakage. Ifwe have leakage then if the water goes by it will
suck dirt in and as it sucks dirt in it undermines the road coming
down. He said so the first thing we have to do is make sure we have
no leaks in that particular area before we go waste our money. Then
get an engineering company to come in and shoot some elevations
and see if we could correct part of the dips by just raising them. Ifwe
can do that fine, if we can't do that then it means we have to cut down
the high spots and level it out which is easier (inaudible) cost.
Councilmernber Failace said we would cut that down and he asked the
Mayor if the other part would keep going down.
Mayor Sica said it probably won't go down anymore if there is no
leakage, but, ifthere is leakage then they have to dig the whole thing
up and fix the leaks before we do that and take the crown out ofthe
road. When you take the crown out of the road the water has to flow
so you take too much crown out of the road the water isn't going to
flow. He said it will take a lot of engineering work to figure it out and
if they want he will get Parmar to get some cost estimates to televise.
He said they just got this problem the other day. If we have a
problem there is no sense worrying about operation or docking the
elevation because we have to first fix the problem and if we have to
dig it all up then they don't have to worry about the elevation because
it will set al1lieu elevations. Elevations that will be in conjunction with
the water flow. He said he will tell Parmar to get some dollar costs on
televise and all those conjunctions where the transfer lines come in.
He thinks that is the first thing he is going to do. He then commented
that the rough plumbing is in the Sports Building and hopefully we
will get the block either the end of this week or next week and we
will start putting the block up right then and there Parmar is getting
their shop drawings this week on the truces so they could order the
truses. As soon as the block gets up they will have the truses to put
the roof on and get it closed in before it gets real cold. They could
work all winter on it and have that thing done in April or May and
that whole building can be completed.

Councilmember Failace asked Pat Holden to be here tonight so he
could talk to both of them about it. Pat Holden said she couldn't
because of a prior engagement of something with her daughter. He
then asked her if she would give him the file and she said that she had
given the Clerk bound by bound books on this and he called the Clerk
who said she had nothing on this. She called Pat and...........he
commented he didn't know who has it.
Mayor Sica said we had some books and everybody had it well
equipped what it actually does.
Councilmember Failace said he had asked her for specific information
and she said she had to put information together and bound it. He
commented that he wasn't sure what was happening.
Mayor Sica said he has some information on it.
Councilmember Failace commented that he had asked her for a copy
of something and she gave it to him and he said quite honestly he
didn't think that was enough information for us to be making a
decision on it. He said he had put together (inaudible) if what he
thinks we should be looking at that doesn't cost us anything when we
are negotiating with various companies or when the Mayor is
negotiating with various companies. He told the Mayor he should be
doing the negotiating. That too many cooks spoil the pie. He thinks
that when it comes down to the point that we are about to go into
some kind of contract or we are about to do something, this is the
kind of information that the Council should have and then be given a
couple of more weeks. He commented that he may know a lot of the
things but we don't. He said maybe they don't ask the right questions
but with the information they had here he doesn't think he is asking for
too much. He said this was not a certified........ this was just a typed
Balance Sheet.
Mayor Sica said this showed that they want outstanding debts. He
asked if he wanted date of account.
Councilmember Failace said you really can't get that from what they
gave him here.
Mayor Sica asked why they can't.
Councilmember Failace said you need a breakdown of current assets
and liabilities.
Mayor Sica said they have Cash and Receivables Inventory.
Councilmember Failace said this is a composite of their whole Balance
Sheet. He said he thought the Mayor should get a copy of their audit
and financials and Patrick should be able to look at it and answer
some of the questions that we might have. He is not saying that they
should be part of negotiating. He said the Mayor does the negotiating
and that is fine.

Mayor Sica said his only problem is that people are not going to give
us these kind of things. He spoke on the Urban Enterprise Zone for
a while.
Attorney Hedesh said once things like that are in our possession they
become public record so he said he didn't know if the companies
would turn over their financial records.
Councilmember Failace agreed.
Mayor Sica said he is going to ask him to give us whatever answers
he feels comfortable with.

Permit, Re: To authorize vegetation maintenance activities along
natural gas transmission right of ways in areas considered to be

MATTERS FOR DISCUSSION:
Councilman Failace - Equipco Company.
Ordinance #96-23, No Parking Certain Hours - Tabled 10/3/96. The
Clerk said she had invited the Chiefbut she didn't know if he could
make it tonight.

Mayor Sica said to hold it. He commented that he hoped no one got
killed over there. It is a bigger mess today then when they took it
down.

Attorney Hedesh suggested if he is concerned about the safety of it
maybe they are better off to pass it and then if there is a problem
you could always modifY it.
Mayor Sica said he thinks we should. He said put it on for Public
Hearing and pass it.
Pat Holden - Recovery Agreement, Re: Redevelopment Agency
Funds.
Councilmember Failace said we are going to get $28,000.00 and some
where along the line it will cost us $12,000.00. He asked if that was
basically it.
Mayor Sica said yes and then went on to say, what happened was that
somewhere along the line when Urban Redevelopment came in here
$28,000.00 was put aside somewhere for us. Either !Tom some
property that was sold or whatever it is. This company now says they
can get you that $28,000.00 but they have to get $12,000.00. We don't
have anything so we might as well give them $12,000.00. If we don't
get nothing they don't get nothing.
Attorney Hedesh asked to go into Closed Session this.
League of Municipalities Convention - Borough allotment. Mayor
Sica said $100.00.
American International Recovery, Inc. - Requesting payment -
$22,555.56, Re: PBA vs. Borough. Attorney Hedesh said they have
to pay it. This is the one they settled in Federal Court. It is the
infamous Civil Rights Case.
Holy Family R.C. Church - Requesting tax exempt status for acquired
property. Mayor Sica said if it is owned by the church it is automatic.
Attorney Hedesh said because it was on the Tax Roles once it has to
be accepted.
Mayor Sica said okay to put it on.
Bids _ Senior Bus. The Clerk said they only received one bid. She
asked if it should be readvertised.
Mayor Sica said yes. You can't just take it with one (I) bid.
Scottsdale Insurance Co. - Requesting payment of various claims,
Perez _ $\0,000.00, Sica - $10,000.00 & Materazzo - $10,000.00.
Attorney Hedesh said they have to pay them.

Frank Tomczuk - American Legion. Requesting amendment to Raffie
License because of date change. This was okay.
Sally Mesler - Requesting ordinance prohibiting blowing leaves into
street. Mayor Sica told Attorney Hedesh to check the ordinance rrom
other towns and lets see what they do. He told him that they have to
find out an ordinance.
Carteret Health Department - Salary ordinance pertaining to 8
additional vacation days given to union employees. Mayor Sica
answered no to this.
Police Chief Sica - Requesting commendations for members of the
Police Department. Mayor Sica said this is on the little boy that lost
his foot. He said to make out certificates for those guys.
BUSINESS TO BE ADDED:
Mayor Sica said the Middlesex County Block Grant has been
approved for Carteret and we are going to use $51,400.00 for
Housing Rehabilitation and $7200.00 for a van driver. $10,800.00 for
Housing Security . $13,600.00 for new apparatus for the Fire
Department and $5000.00 for Park improvements that have been
approved by the County. He said it looks like $85,000.00, give or
take a thousand. He said we also applied for a grant from the United
States Department of Justice, Police, and we were awarded
$16,289.00. He said to turn this over to the Chief.
Mayor Sica said he wants to put on an ordinance for First Reading.
"Peace and Good Order." Then what happens everytime there is a
disorderly person they can charge him under C2 and fine him, the state
gets the money. Mayor Sica then went on to talk about a disturbing
letter he received via Certified Mail from somebody named Chodosh.
It appears that she owns a house on Jersey Street near Fillmore. They
smashed their sidewalks when they were putting up the buildings up
there. They sent a letter to Panigrosso and Santoro and she got no
satisfaction at all. He read the letter. He suggested to turn this over
to the attorney and have him send a letter to the School Board telling
Attorney Hedesh suggested a Closed Session. now.
Mayor Sica said they would go into Closed Session. He said they are
going to get sued if somebody gets hurt over there.
Sal LoRicco (a citizen) spoke. He lives on 30 Whitman Street. He said
on the corner of Whitman and Lexington, the last storm that we had,
since he bought the house in 1985, every time there is a bad storm the
water comes in his sewer pipe. In his downstairs shower and toilet. He
said he has talked to the engineer, AI Biel.....everybody comes and
looks when the weather is fine. There is nothing there. Somewhere
when that street fills up it comes up in his and his neighbors house.

Mayor Sica told him there could be two (2) reasons for that. First of
all the house was probably built with a bathroom upstairs and no
bathroom in the cellar. He said when you are up high here (inaudible)
it is going to go down. Now when you get the sewer pipe that is full
and in bad weather conditions it can't go down it has to go back up.
It won't come downstairs into your house but it will come downstairs
into your wash sink or your bathroom commode or your shower. He
said the way you solve that problem, when the bathroom was put in
there, they should have put in a stop check valve.
Mr. Lo Ricco said he has that.
Mayor Sica then questioned how could it do that.
Mr. Lo Ricco said he wanted to know where the sewers were
separated.
Mayor Sica said maybe his stop check valve isn't working. Then
maybe the other problem is when they built that house they put him on
the wrong sewer line. He said there is no way the city of Carteret can
know what sewer line he is on until you have a problem. Then when
you have a problem the problem becomes your problem. Perhaps
when that house was built there was only one sewer line to put it in.
When the second sewer line was put in the storm line, anybody that
was in the storm line was supposed to take them selves off of that and
put themselves into a sanitary line, so it appears that if you are getting
it in severe storms then he is in wrong sewer line...... you are in the
storm sewer. If that is the case then you have to take it off of that and
put it into your sanitary line.
Mr. Lo Ricco commented that he would have to pay for it.
Mayor Sica said yes. Then he commented that they didn't know for
a fact that they were on the wrong line. He asked him if he would
allow them to come into his house and die check because he don't
want him to spend the money ifhe don't have to spend the money. He
said he will make an appointment the next day with Mr. Parmar for
the testing.
Mr. Lo Ricco complained about the engineer
Mayor Sica spoke on this for a while, speaking about the old sewer
plant and sewer separation project.
Attorney Hedesh told the Mayor that he has to instruct the Building
Office to issue a Demolition as per the Kings Wok, a Chinese
restaurant.
Mayor Sica said he had called him the other day personally... . . . and he
said to them issue.......then he mentioned to forget about him. He then
told Attorney Hedesh to send a notice to these people that they are
required to be at a hearing on November 15th on the demolition
(inaudible) and if they don't show up he will demolish it.

Kings Wok Continued Mayor Sica told the Building Department to send a notice to the
people in Brooklyn that own the restaurant, saying that he is giving
them a hearing to demolish their building. He sent them a Violation
Notice instead. He told Attorney Hedesh to send them the notice and
if they don't show up the next day he will knock it down.
Attorney Hedesh said he couldn't do it on the 16th.
Mayor Sica commented "whatever day." Then he said the next day
they will knock it down.
W. Kolibas said they have a building in the garage in back of Gruhins
that the Redevelopment Agency gave us. Inside is an old truck. Mr.
Gruhin wants to know if we can knock that building down.
Mayor Sica asked whose property it is.
W. Kolibas said it is the Boroughs.
Mayor Sica said to knock it down. Then he said he would go look at
it tomorrow.
Attorney Hedesh said to get the Lot and Block from Patrick.
