CITY OF TIFFIN ORDINANCE NO. 2006- -28 6

AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP FOR TIFFIN,.
IOWA, FOR DEERVIEW ESTATES SUBDIVISION
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN,.JOWA:
Section'1. Purpose.,The purpose of this ordinance is to amend the official zoning-
map of Tiffin, Iowa, concerning the following legally described property located within Tiffin,
Johnson County,Iowa.

' Section 2. Amendment. The following legally described property:,.
- Lots 2-35,37-56, 67-117; 120-139, Deer View Estates
r
shall be.changed from zoning classifications R-1E to R-1C and further, that the official •
zoning map of the City be amended to reflect the change described herein.
Lots 36,Lots 57-66, 118 & 119, Deer View Estates` ,
shall--be changed from zoning classifications R-1E to,R-4 and further, that the official
zoning niap of the City be amended to reflect the change described herein. f,
(For`clarification purposes only,
Lot 1 shall remain zoned as C-2B and Lot 140 shall remains R-1E)
,Section 3. Repealer. All ordinances or parts of ordinances in conflict with the
provisions of this Ordinance are hereby repealed.
Section 4. Severability. If any section, provision, or part of this-ordinance shall be
adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of
. the ordinance as a whole, or any section, provision, or part thereof not adjudged invalid or
unconstitutional.

. Section 5. Effective Date. This ordinance shall'be in effect after its final passage,
approval, and posting as provided by law.

On the 9th day of May 2007, at a regular meeting of the Tiffin City Council, Tiffin, ,
Iowa, Councilperson Petersen motioned to approve a first reading by title only
- of Ordinance No. 2007- 286 , AN ORDINANCE AMENDING THE OFFICIAL '
ZONING MAP FOR TIFFIN, IOWA, FOR DEERVIEW ESTATES SUBDIVISION,

• Mayor Glenn R. Potter declared' Ordinance No. 20072 286 AN ORDINANCE
. ' AMENDING THE OFFICIAL ZONING MAP FOR TIFFIN, IOWA, FOR
DEERVIEW ESTATES SUBDIVISION was read the first time by title only and discussed
and placed on record. .
On the 9th day of May 2007, at a regular meeting of the Tiffin City Council, Tiffin,
Iowa, Councilperson Dils "moved that the Ordinance No. 2007- 286 be given its second
and third reading and that the rule-requiring a first, second and third reading on three
separate dates be waived and dispensed. The.motion was seconded by Councilpersori
Bartels ' .
Ayes: Petersen', Demuth, Dils and Bartels ,
Abstain: None
Nays: ' None Absent: Wright
Motion carried.
Five members of the Tiffin City Council being present and four having voted "Aye",
Mayor Glenn R. Potter declared the motion carried, and Ordinance No. 2007- 2 8 6 - ;
was then placed on its second and third reading by title only, and was placed'on the record.
Thereupon,it was moved by Councilperson Bartels , and seconded by
Councilperson Petersen that Ordinance No. 2007- 286, AN ORDINANCE
-_ AMENDING THE OFFICIAL ZONING MAP FOR TIFFIN, IOWA, FOR
DEERVIEW ESTATES SUBDIVISION, be read for the last time and be placed upon its
final passage and adopted.
Ayes: Bartels, Dils, Demuth,- Petersen.
Abstain: None.

Five members of the Council being present and four having voted "Aye", Mayor s
Glenn•R. Potter declared the motion carried, and Ordinance No. 2007- 2 R h was passed
. and adopted. w
Whereupon Mayor Glenn R. Potter declared that Ordinance No. 2007-2 8 6 be
adopted and signified his approval of same by fixing his signafure thereto.

Passed by the Council on the 9th day of May 2007 and approved by the Mayor on
the 9th day of May 2007. .
