The Agenda Meeting of the Mayor and Council of the Borough of
Carteret preceding the Regular Meeting December 19, 1996 was held
on December 12,1996,7:00 P.M., Council Office, Municipal Building,
61 Cooke Avenue, Carteret, New Jersey.
The following were noted present:
Councilmember Bialowarczuk

Noted absent was Mayor Peter 1. Sica and Borough Attorney Robert
A. Hedesh.
Mailed to The Home News and Tribune, The Star Ledger and posted
on the bulletin board on December 6, 1996.
a) Borough Engineer -Mr. Parmar spoke saying the work in West
Carteret was temporarily suspended. He then gave a report, of which
most was inaudible.
At approximately 7·04 p.m., Attorney Hedesh was noted present.
Attorney Hedesh told Parmar he has asked him for two (2) years for
the specs for the paving and curbing of Beverly Street. He said a
percentage of papers and appraisals has to be done. They are going to
need it and on February 2nd someone will be looking for it so he
suggests that he put it together.

Reorganization Meeting - January I, 1987 at 12:00 Noon.
Bid - Passenger Bus. The Clerk said if somebody looks at it she will
put it on.

Attorney Hedesh said they better put it on and they could take it
off the Agenda.
Personnel Matter - G. Carpenter. The Clerk said that is for Closed
Session.
Richard Greenberg - a) Request that the members of the UEZ
COß1ßÚttee be appointed by resolution .The Clerk said to put that on.
Petition - Carteret Housing Authority Tenants. Iris Colon was
present to speak on this. She said she had spoke to the Council for a
year and there was no solution.
Another lady explained the problems with all the drug deals going on
in her neighborhood and that she alwa)S calls the police and she was
told only the Detective can work with the drugs problems, not the
Patrol.

Another lady asked where the police were at 3 :00 when the children
were let out of school, by Columbus School.. She said someone tried
to get her child to go into a van one day after school. She said they
should be there watching the children.
Councilmember Bialowarczuk said she was just trying to find out
what the question was between the Narcotics Division and Patrol
Division and exactly what they were told.
A lady said they were told if a Patrolman comes down and investigate
and they (inaudible) then they are going to be investigated by the
State about how they did.
Attorney Hedesh asked the woman if the Deputy Chiefs have told
her that.
The Lady said yes.
Attorney Hedesh said he was making the assumption that Deputy
Chief Hack wouldn't tell you something that was not true.
The Lady said he didn't think he was lying either.

Attorney Hedesh said what he is saying is what Councilwoman
Bialowarczuk is saying is that she needed to know the source and
when it comes from a Deputy Chief that is maybe what you have to
investigate. He then asked if the most of the problems, under the
letter here........now he is hearing those things ..........is the problem
centered around this situation.

One of the Ladies said that area.
Attorney Hedesh said that was not his answer and he repeated the
question again.
Another Lady asked why they took the light away from them....... the
light that goes between Pershing Avenue and Roosevelt Avenue.
Attorney Hedesh said because the state of New Jersey said it was an
illegal light.
The Lady said they are going to fight to get a light back because all
the drug addicts stand by that store and don't let them see and that is
why these car accidents always happen.
Councilwoman Bialowarczuk asked if she could quote what she is
saying here is that there is a specific problem in that particular corner)
that you .....
The Lady said inbetween Roosevelt, Pershing and all the way
straight down.
Council member Bialowarczuk asked if they had called Patrolmen
and Police.
One of the ladies said yes. She said a patrol car came the other day
when a man's windows were all busted up and they asked the man
why and he said he didn't know why.
Councilmember Bialowarczuk asked if they had made any arrests of
any drug dealers of criminals down there.
Iris Colon said they would not even go upstairs. She said the only
Patrolman that did something about it was Gary Guiliano and that
when he is out there, everybody knows him and they feel secure.
Another Lady said the police have not been down there for over a
month. They haven't not been put on in the area. They leave 1l:00 at
night but they haven't been down there in months.
Councilmember Bialowarczuk said the Housing Authority pays.
A lady said she lived in HI for years with her mother and after her
mother passed away and her brother went to school she has had to
fight when her sister passed away so she could live in her apartment
because she was scared to live down there because there was
shootings and everything.
Councilmember Bialowarczuk asked her if she had approached the
Narcotic Division.
The lady said she did and got nothing.

The lady went on to say that of the fifteen (15) signatures that they
have on the petition, everyone of those people tried to help with
things that she told some ofthe people present in private.
Attorney Hedesh suggested that this conversation may go into Closed
Session because the problem is they may have to investigate if there
is a County Prosecutor involved in this. He said if there is a County
investigation they may be hard pressed to find out something. He
asked Iris Colon if anyone has told her that the County is
investigating.
Iris Colon said the County called her on two (2) different occasions
and what they asked her is impossible.
Attorney Hedesh asked her if they told her there was an
investigation.
Iris said it is not an investigation. For them to start an investigation
they need another civilian camera.
Attorney Hedesh said he didn't care what they need. He said he is
trying to ascertain whether we can get an answer for her or not. He
said he knows if the County has it, it will be almost impossible to get
it because they are going to say there is a pending investigation and
they are going to present it...............
Iris Colon said it is not a pending investigation, they asked her if he
can have that camera there and she can't. She will not force the
people to do the same thing over again. They are tired and moving
out.
Attorney Hedesh then said he wanted to discuss this in Closed
Session.
A lady said that it was said that Housing pays for the Patrolman. She
then asked where they were, that she is comfortable where she is, but
she used to watch patrolman leave at 1l:00.
Attorney Hedesh said the shift ran until 1l:00 for the Housing people
that got paid.
Sergeants _ Swearing In Ceremony. It will be held at the next
Council Meeting,
Analytic Resources, Inc. - Request to do utility audit. The Clerk
said they get that all the time.
Attorney Hedesh said he would turn it over to Patrick.
Councilmember Bialowarczuk wants certificates put on for this
meeting for the city football team She said she would get the names

Councilmember O'Brien said Harold told him the Governor is going
to be in town tomorrow. One of her people spoke to Lou Panigrosso.
It will probably be over at the Middle School. Governor Whitman and
former Governor Kean. He said maybe Lou could give a call to the
Clerk earlier in the day to find out where they will be.
Attorney Hedesh said Mr. Swalik lives on the end of Post Boulevard.
The piece he gave to us is the piece in the middle between him and
his neighbor. He maintains it. What it is, is, Virginia Street that
would run into the fields. He doesn't know if this guy wants the
property but it is irrelevant to us. We would have to vacate it and
give it to both sides, which he thinks Mr. Swalik is going to have to
buy his piece. It is obviously of no use to the Borough.

Attorney Hedesh said Watkinson's, two resolutions, they put hourlys
on it. What happens is if you put on an hourly rate....... you can't do
it like that because when he does a master plan he will be doing cost.
It is like a contract. In other words he is going to pay a surveillance
say $65.00 an hour. He is going to pay it and cop additional costs to
the Borough. The same with the foreclosures, it is the same situation.
Tom told him today that there would be no way for him to pay
those He couldn't bill them to the Borough because that would be
illegal for him to bill at his hourly rate. They will amend the
resolutions from the last meeting.
At approximately 7:30 P.M., Councilmember Fazekas was noted
absent.
Attorney Hedesh then spoke on the closings to the property. He has
the title work. He got the title to the policy and it is absolutely clear.
The contract has been delivered to them. He didn't get a signed one
back but that is really irrellevent because we cannot decide it until we
pass that ordinance so we will have to redo it Monday. The contract
was contingent on the property being passed through the ordinance.
He said the title work is done, the survey is done, once the ordinance
is passed he is setting the closing at this point for Friday the 20th
probably at the Agenda Room or at his office. Because of the cash
deals (inaudible). He said he would get Resko's out to Patrick before
that do he will know what checks to cut prior to. He said he will talk
to Patrick and make sure the checks are cut. He then commented
that the rest of the discussion is Closed Session.
At approximately 7:35 p.m, Councilmember Fazekas was noted
present.

RESOLUTION #96-342 was introduced by the Mayor and referred
to the Council for action

Upon MMS&C, by Councilmembers Failace and Fazekas
RESOLUTION #96-342
"RESOLUTION TO GO INTO CLOSED SESSION"
was adopted. Upon individual roll call vote, Councilmembers
Bialowarczuk, Failace, Fazekas, Feingold, O'Brien and Vesey voted
in the affirmatve.
At approximately 7:35 p.m., a Closed Session was held.

At approximately 8:35 P.M., upon MMS&C by Councilmembers
Vesey and Failace and the unanimous affirmative vote of the full
membership present, this meeting was opened to the public.
A motion to adjourn was made by Councilmember Bialowarczuk and
second by Councilmember Vesey. After no further discussion this
meeting was adjourned.
