A RESOLUTION PROHIBITING THE EXTENSION OF CITY WATER AND SEWER
LINES BEYOND THE MOAB CITY LIMITS WITHIN THE MOAB VALLEY BEGINNING
FROM THE NORTH CITY BOUNDARY AT STATE HIGHWAY 191 PROCEEDING
NORTH TO THE COLORADO RIVER BRIDGE/STATE HIGHWAY 191 /STATE
HIGHWAY 128 JUNCTION
WHEREAS, the legislative body of the City of Moab, Utah (the "City") has determined
that development may provide a valued economic, cultural and social benefit to the
City and its inhabitants; and
WHEREAS, it has been agreed that project development can have an influence on
the character of the City and its inhabitants; and
WHEREAS, the City of Moab has a responsibility to ensure that appropriate and
fiscally sound urban development occurs within both the City boundaries and the one-half
mile sphere of influence pursuant to Section 10-2-418, Utah State Code Annotated; and
WHEREAS the unincorporated County area located adjacent to the State Highway 191
corridor from the Moab City Limits northward to the Colorado River Bridge and Junction
with State Highway 128 presently relies on City -provided culinary water and wastewater
infrastructure to develop at the levels that trigger the enactment of Section 10-2-418, Utah
State Code Annotated; and
WHEREAS the City has determined that development of this area and the physical
and fiscal impacts associated with commercial development anticipated within the one-
half mile zone requires additional, as yet uncompleted, studies to guarantee that all
development activities proposed for this area meets the City's requirements as stated in
this Ordinance; and
WHEREAS, the City Council hereby finds and determines that it is necessary for the
immediate preservation of the health, safety, and welfare of the City and the inhabitants
thereof that this ordinance take effect immediately upon passage and posting.
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF MOAB
CITY THAT:
1. The City of Moab shall not approve, authorize, fund and/or construct any
water or sewer lines beyond the present terminus of existing water and sewer line
infrastructure at the northern boundary of the Moab City Limits along the State Highway
191 corridor until adequate annexation, fiscal impact and planning studies are completed
to determine future development options.
2. This resolution shall take effect immediately upon passage.
PASSED AND APPROVED in open Council by a majority vote of the Governing Body of
Moab City Council this 25th day of --- July, A. D. ,1995.
