CITY OF TIFFIN, IOWA ORDINANCE NO. 2009-297
AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP ORDINANCE 2007-287 OF
THE CITY OF TIFFIN, IOWA BY RE-ZONING BIGELOW SUBDIVISION LOT#5 FROM R-E
RESIDENTIAL FAMILY ESTATES ZONING UNDEVELOPED LAND TO COMMERCIAL
C-2B COMMUNITY BUSINESS.
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:
Section 1. Purpose. The purpose of this amendment to Zoning Ordinance No 2007-287
to amend the official zoning map of Tiffin, Iowa concerning the
following legally described property located within Tiffin, Johnson
County, Iowa.
Section 2. Amendment. The following legally described property:
Bigelow Subdivision Lot No 5, east of Jasper Avenue NW, 20.36
acres, south of the Interstate Railroad. That part that is Auditor's aka
parcel 0627453001.
Southwest Quadrant of the Northeast Quarter of Section 27, in
Township 80 North, Range 7, West of the Fifth Principal meridian in
Johnson county, Iowa.
Shall`be changed from zoning`classification R-1E Residential Family Estates to C-2B
Commercial Community Business for property situated south of the Interstate Railroad and
Hwy 6, and further, that the official zoning map of the City of Tiffin, Iowa be amended to
reflect the changes described herein.
Section 3.. Penalty Provision. The City may elect, at its discretion, to prosecute any vio-
lation either as simple misdemeanor or a municipal infraction.
Section 4. Repealer. All ordinances or parts of ordinances in conflict with the provisions
Of this Ordinance are hereby repealed.
Section 5. Severability. If any section, provision, or part of this ordinance shall be
adjudged to be invalid or unconstitutional, such adjudication shall
not affect the validity of the ordinance as a whole, or any section,
provision, or part thereof not adjudged invalid or unconstitutional.
Section 6. Effective Date. This ordinance shall be in effect after its final passage,
Approval, and posting as provided by law.
On the 11th day of March 2009, at the regular meeting of the Tiffin, Iowa City Council,
Councilperson John Wright introduced Ordinance No. 2009-297, and moved that it be given
its first reading. The motion was seconded by Council Person Mike Gericke.
Ayes: Chris Ball, Mike Gericke, Mark Petersen, John Wright
Nayes: None
Absent: Jim Bartels

Four Members of the Council being present and having voted "Aye", Mayor Royce Phillips declared
the motion carried, and Ordinance No. 2009-297, was read the first time, discussed and placed on
record.
On the 11th day of March 2009, at the regular City Council meeting of the Tiffin, Iowa City Council,
Council person John Wright made a motion to suspend the second reading for Ordinance No.
2009-297, and moved that the third and final reading be made. The motion was seconded by Council
person Mark Petersen.
On the 11th day of March 2009, at a regular meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson John Wright introduced Ordinance No. 2009-297, and moved that it be given its third
and last reading. The motion was seconded by Councilperson Mark Petersen.
Ayes: Chris Ball, Mike Gericke, Mark Petersen, John Wright
Nays: None
Absent: Jim Bartels
Four Members of the Council being present and voted "Aye". Mayor Royce Phillips declared the
motion carried, and the ordinance was passed and adopted.
Whereupon the Mayor declared that Ordinance No. 2009-297 be adopted and signified his approval
of same by fixing his signature thereto. Passed by the City Council on the 11th day of March 2009.
