AN ORDINANCE AMENDING ZONING;ORDINANCE NO 2007-287 ALLOWING
CHURCHES TO BE ESTABLISHED IN`THE FOLLOWING ZONED AREAS, R-1 E AS
PRINCIPAL USES AND STRUCTURES PERMITTED, C-1B, C-2B, C-10,t-20,'and C-1S
AS PRINCIPAL USES AND STRUCTURES PERMITTED.
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:, •
Section 1. Purpose: The purpose of this amendment to Zoning Ordinance No 2007-287 is to
remove and replace the existing allowable uses in the following zoned areas with the amended
uses. It is in the intent of the City Council that all other regulations be followed as described for
each Zoning District:
Section 2. Amendment: Section R-1 E.02 is hereby amended and the following additional is
inserted in lieu thereof:

E. Churches and Temples
Section 3. Amendment: Section C-1 B, C-2B, C-1 B, C-2B, C-10, C-20, and C-1 S
Table C to be amended for Permitted Uses to allow Churches and Temples.

Section 11. Penalty Provision. The city,may elect at its sole discretion, to prosecute any violation
either as simple misdemeanor or a municipal infraction.
Section 12. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this
Ordinance are hereby repealed.
Section 13. Severability. If any section, provision, or part of this ordinance will be adjudged to be
invalid or unconstitutional, such adjudication will not affect the validity of the ordinance as a whole, or
any section, provision, or part thereof not adjudged invalid or unconstitutional.
Section 14. Effective Date. This ordinance will be in effect after its final passage, approval, and
postingas provided by law. ,.
On the 24TH DAY of JUNE 2009, at a special meeting of the Tiffin, Iowa City Council,
Council person John Wright introduced Ordinance No. 2009-298, and moved that it be given its
first reading by title only. ,The motion was seconded by Council person Mike Gericke.
Ayes: Jim Bartels, Mike Gericke, Mark Petersen, John Wright
Nays: Chris Ball
'Absent: None
Four Members of the Council being present and having voted "Aye", Mayor Royce Phillipstdeclared
the motion carried, and Ordinance No. 2009-298, was read the first time, discussed and on
record.

On the 24th day.of June 2009, at a special City Council meeting of the Tiffin, Iowa City Council,
Council person John Wright made a motion to waive the second reading for Ordinance No. 2009-
298, and moved that the third and final reading be made.,;The motion was seconded by Council
person Mike Gericke.
Ayes: Jim Bartels, Mike Gericke, Mark Petersen, John Wright
Nays: Chris Ball
Absent: None
Four Members of the Council being present and having voted "Aye", Mayor Royce Phillips declared
the motion carried, the waiving of reading Ordinance No 2009-298, for the second time was
approved.
On the 24th day of June 2009, at a special meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson John Wright introduced Ordinance No. 2009-298, and moved that it be given its third
and last reading. The motion was seconded by Councilperson Mike Gericke.

Absent: None
Five Members of the Council being present and voted "Aye". Mayor Royce Phillips declared the
motion carried, and the ordinance was passed and adopted.
Whereupon the Mayor declared that Ordinance No. 2009-298 be adopted and signified his approval
__of same by fixing his signature thereto: Passed by the City Council on the 24th day of June-2009.
