The Council of the City of Medina met in regular session on Tuesday, September 19, 1978 at 7:45 P.M. Members present: Mayor, Wayne Neddermeyer; Councilmembers, Nancy Laurent, William Reiser Arthur Theis, Thomas Crosby; Clerk, Donna Roehl; Chief of Police, Charles Hoover; public Works Director, Ron Duran; Planning and zoning Adm., Rob- ert Derus; Engineer, Lyle Swanson Minutes: Wayne Neddermeyer asked that addition be made to minutes of September 5, 1978, Item 10, Page 103 indicating that St. Anne's Church license was granted without charge. Thomas Crosby asked that addition be made to minutes of September 5, 1978, Item 9, Page 103 indicating that there could be no assurance that zoning would be changed to permit resident- ial use in an M-1 District. Motion by Reiser, seconded by Theis to accept the minutes of September 5, 1978 as corrected. Motion declared carried Motion by Laurent, seconded by Theis to accept minutes of September 12, 1978, as presented. Motion declared carried 1. POLICE DEPARTMENT Police Chief Hoover asked that he be allowed to attend a seminar regarding city grants, on October 20th and November 2nd., cost being $100. Motion by Theis, seconded by Reiser to authorize Charles Hoover to attend the 2 day seminar. Motion declared carried Police Chief Hoover stated that Police Officer LaFond's squad car had been backed into and it will cost approximately $99.00 to repair. Motion by Reiser, seconded by Laurent to authorize repairing the squad car. Motion declared carried 2. PUBLIC WORKS DEPARTMENT Hunter Farms Letter from Darrell Farr was read explaining delays in road construction. Council asked that Engineer contact Buffalo Bituminous to determine for himself when black - topping would be started. Hamel pump House Lyle Swanson reported that HOD had approved use of the Block Grant Funds for the pump house. Report by Donna Roehl on the use of bond funds to pay balance of costs and cost of land. Motion by Crosby, seconded by Laurent to authorize attorney to prepare a resolution allowing borrowing from the amel Improvement Bond Fund for an amount of money to cover the above project, not covered by Block Grant Funds, to be paid back to the fund withing 3 years at 8% interest, payback to be generated by an increase in water rates. Motion declared carried 3. D.M.E. PLAT, PUBLIC HEARING, UTILITIES EASEMENT VACATION, 8:05 P.M. Discussion of removing easement along southerly edge of property that Mr. Erickson has purchased, property that will be added to Mr. Erickson's present lot. Motion by Crosby, seconded by Theis to close the public hearing. Motion declared carried Public hearing deloared closed at 8:10 P.M. Motion by Crosby, seconded by Theis to approve Resolution 78-35, Vacating a Utility Easement on D.M.E. Plat. Motion declared carried 4. HENNEPIN COUNTY PARK RESERVE DISTRICT Shirley Bonine, Park Board member, appeared to report changes that she would like to make in park policies, such as meetings with city officials to discuss development or purchase of property. 1 0445. NORTHERN STATES POWER CO. otion by Theis, seconded by Laurent to approve Resolution 78-36 regarding cable burial on Lakeshore Ave., Independence Beach. Motion declared carried 6. NICHOLAS DINGMAN, VARIANCE Motion by Reiser, seconded by Theis to grant a side yard variance of 5 ft. and a rear yard set -back variance of 35 ft. to allow Mr. Dingman to construct a garage on Lots 20 and 21, Block 20, Independence Beach. Reason for the variance is the small odd -shaped lot. Motion declared carried Donna Roehl was asked to notify the adjacent property owner of the variance. 7. PIPER LAND DIVISION Leo Stern appeared to discuss a division of the Piper property to allow Jeff Peterson to purchase a 6.9 acre parcel from Addison Piper. Discussion of the necessity of a roadway agreement to indicate public access for the Peter- son's. Motion by Crosby, seconded by Laurent to authorize the attorney to prepare a driveway agree- ment to include the 6.9 acre parcel. Motion declared carried 8. WATER SUPPLY COMPANY Thomas Crosby reported that he had spent time researching the proposed rate increase request for the Medina Morningside area. Be stated that he would recommend an increase to $1.10 or $1.20 per 1000 gallons for 1979 and perhaps discuss it again during the coming year. He explained that suci an increase would allow establishment of reserves and a debt retirement program. Discussion with Marlon H ngen of the purchase of the system by the city and if rates were raised what effect that would have on the purchase of the system. Mr. Crosby suggested that 3 methods of valuation be discussed prior to the October 3rd. meeting and that Council discuss at that meeting. Mr. Haugen stated that he would have the fire hydrants checked on Wednesday, September 20th to determine that they were working properly. Also that they would not hold the city to the ordinance provision which states that rates may be raised automatically after 30 days unless Council denies the request. 9. GARY LINDGREN Richard Schieffer explained the prepared ordinance allowing for connection charges that will be paid per lot by Mr. Lindgren. Motion by Orosby, seconded by Theis to approve Ordinance 174, relating to a deferred sewer and water connection charge. Motion declared carried 10. DAVID ARNESON Discussion of the request to refund connection charges on the Arneson home because they no longer maintain a second apartment. Motion by Laurent, seconded by Crosby to deny the request for refunding of connection charges as the law does not provide for such refunds. Motion declared carried 11. HENNEPIN COUNTY ADVISORY COMMITTEE Appointment tabled until October 3rd meeting. 12. BILLS Robert Derus reported that the Planner states that they are on schedule with their contract and that there would be a difference of $3000 in the amount of the contract if the Zoning ordinance were to be prepared by another. Motion by Crosby, seconded by Reiser to pay the bills, including the Planners bill of $3650.00. Payroll Checks 053-5076 in the amount of $3559.19 and Order Checks # 7648-7649 in the amount of2250.4 . Motion declared carried 13. SPECIAL MEETING Motion by Theis, seconded by Crosby to hold a special meeting on Septembh26th at 7:30 p. 9 to discuss budget, who signs checks in abscense of the City Treasurer and the Piper Driveway agreement. Motion declared carried Regarding the budget, Thomas Crosby reported that the general fund deficits for the past 3 years were $45,009, 67,000, and estimated $15,000 for 1978. He reported the following wage increase: Minnetonka 6.5%, Orono 7%, Postal workers 21.3 over a 3 year pe±iod and 2 private businesses he had checked at 7%. Members present: Mayor, Wayne Neddermeyer; Councilmembers Arthur Theis, William Reiser, Thomas Crosby at 8s55 p.M.); Clerk, Donna Roehl; police Officers, Hoover, LaFond, Rouillard; Public Works Director, Ron Duran. Members absent: Nancy Laurent 1. CITY TREASURER Donna Roehl was asked to check with the Hamel Bank as to procedure regarding check signing in the abscence of City Treasurer. 2. SEALCOATING Ron Duran reported that a very poor job of sealcoating was done. City engineer will be asked to follow-up with the contractor and report at the October 3rd meeting. 3. HUN'1ER FARMS Donna Roehl was asked to check with buffalo Bituminous and secure a firm date for blaoktopping. Notifying them that another contractor will do the job with a 2 week notice. Also if streets are not accepted Mr. Farr will be responsible for snow -plowing during the 1978-79 winter season. 4. BUILDING INSPECTOR Donna Roehl reported that Loren Kohnen, inspector for Independenoe and Loretto had inquired about the inspecting for Medina and would like to discuss with Council. 5. ASSESSOR Discussion of securing names of newly certified assessors from the State, also with City Clerk of Hassan as they are seeking an assessor also. 6. HORSE BARNS ON SMALL ACREAGES William Reiser asked that this item be discussed on October 3rd as he can see problems with horses on small parcels. 7. Police DEPARTMENT Officer LaFond asked that Council discuss the purchase of a dog for the police Department at the October 17th meeting. 9.
