CITY OF TIFFIN, IOWA ORDINANCE NO 2010-302
AN ORDINANCE UPDATING THE CODE OF ORDINANCES OF THE CITY OF TIFFIN,
IOWA 2010, BY UPDATING PROVISIONS OF CHAPTER 111 ELECTRIC FRANCHISE
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA: -
Section 1. SECTION UPDATED. Chapter 111 Electric Franchise of the Code of Ordinanwces
for the Renewal of the twenty-five year non-exclusive franchise agreement to Interstate
Power and Light, also known as Alliant Energy upon expiration of Ordinance 1985-135.
Section 2. UPDATE: The City Council of the City of Tiffin, Iowa grants the renewal of the
twenty-five year Electric Franchise as requested by IES Utilities Inc. d/b/a Alliant Energy as
per mutual agreement made between the City of Tiffin, Iowa and Alliant Energy as per all
previous provisions detailed in Chapter 111, Sections 111.01 Franchise Granted, 111.02
Construction Standards, 111.03 Restoration of Public,Property, 111.04 Service Extension,
111.05 Rates, 111:06 Successors, and 111.07 City Held Harmless, passed and adopted on
September 11, 1985 and as approved by voters at an election held October 22, 1985.
Section 3. REPEALER. All ordinances or parts of ordinances in conflict with the provisions
Of this Ordinance are hereby repealed.
Section 4. SEVERABILITY CLAUSE. If any section, provision, or part of this ordinance
shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the
validity of the ordinance as a whole, or-any section, provision, or part thereof not adjudged
invalid or unconstitutional.
Section 5. EFFECTIVE DATE: This ordinance shall be in effect after its final passage,
Approval, and posting as provided by law. A complete detailed copy of Ordinance 2010-302
may be viewed at Tiffin City Hall at 201 Main St., Tiffin; Iowa.
On the 9th day of June, 2010, at the regular meeting of the Tiffin, Iowa City Council,
Couhcilperson Jim Bartels introduced Ordinance No. 2010-302 AN ORDINANCE
UPDATING THE CODE OF ORDINANCES OF THE CITY OF TIFFIN, IOWA 2010, BY
UPDATING PROVISIONS OF CHAPTER 111 ELECTRIC FRANCHISE, and moved that it
be given its first reading. The motion was seconded by Council Person Mike Gericke.
Ayes: Jim Bartels,Mike`Gericke, Travis Weipert

Absent: Mark Petersen and Chris Ball
Three Members of the Council being present and having voted "Aye", Mayor Royce Phillips declared
the motion carried, and Ordinance No. 2010-302, was read the first time, discussed and placed on
record.
On'the 11 day of August 2010,at the regular City Council meeting of the Tiffin, Iowa City Council,
Council person Mike Gericke made a motion to approve the second reading for Ordinance 2010-
302. The motion was seconded.by Council person Jim Bartels.
Ayes: Chris Ball, Jim Bartels, Mike Gericke, Mark Petersen, Travis Weipert.

Absent: None •
Five Members of the Council being present and having voted "Aye", Mayor Royce Phillips declared
the motion carried, and Ordinance No. 2010-302, was read and approved the second time. p
On the 11th day of August 2010, at a regular meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson Mike Gericke introduced Ordinance No. 2010-302, and moved that it be given its
third and last reading. The motion was seconded by Councilperson Mark Petersen. •
Ayes: Chris Ball, Jim Bartels, Mike Gericke, Mark Petersen, Travis Weipert
Nays:None
Absent: None
Five Members of the Council being present and voted "Aye". Mayor Royce Phillips declared the
imotion carried, and the ordinance was passed and adopted.
Whereupon the Mayor declared that Ordinance No. 2010-302 be adopted and signified his approval
of same by fixing his signature thereto.
Passed by the City Council on the 11th.day of August, 2010.
