CITY OF TIFFIN, IOWA ORDINANCE NO. 2010-303
AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP ORDINANCE 2007-287 OF
THE CITY OF TIFFIN, IOWA BY RE-ZONING TWO JOINING LOTS 316 COLLEGE ST
AND 221 W MARNEGO RD. FROM CURRENT ZONING TO C2-B ZONING DISTRICT.
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:
Section 1. Purpose. The purpose of this amendment to Zoning'Map Ordinance 2007-287 of
the City of Tiffin, Iowa to:
A. Re-zone 316 College St from R1-C Residential Single Family to C2-B Commercial
Community Business District.
B. Re-zone 221 W. Marengo Rd. from C1-B Commercial Neighborhood Business District
to C2-B Commercial Community Business District.
Section 2. Amendment. The following legally described property:
Legal Descriptions: 316 College St. Parcel #0628427010 Sadler Subdivision Lot#4 Except that
Part conveyed in Bk 1069 Page 488. Re-Zone from Residential R1-C to Commercial C2-B.
221 W Marengo Rd. Parcel#0628427003 Sadler Subdivision Lot#8. .1869 Acres, 8140 SqFt., and
Lot#9 Parcel #0628427004 .19 Acres, 8245 SF, Re-Zone from Commercial C1-B District to C2 7B
District.
Shall be changed from currentzoning classification R-1 C Residential Single Family to C-2B
Commercial Community Business for property situated at 316 College St.,
and from current classification C1-B Commercial-Neighborhood Business to C2-B
Commercial Community Business and further, that the official zoning map of the City of Tiffin,
Iowa be amended to reflect the changes described herein to provide for the development of
commercial business in an orderly and conducive manner.
Section 3. REPEALER. All ordinances or parts of ordinances in conflict with the provisions
Of this Ordinance are hereby repealed.
Section 4. SEVERABILITY CLAUSE. If any section, provision, or part of this ordinance
shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the
validity of the ordinance as a whole, or any section, provision, or part thereof not adjudged
invalid or unconstitutional.
Section 5. EFFECTIVE DATE: This ordinance shall be in effect after its final passage,
Approval, and posting as provided by law.
On the 9th day of June, 2010, at the regular meeting of the Tiffin, Iowa City Council,
Councilpersdn Mike Gericke introduced Ordinance No. 2010-303, AN ORDINANCE
AMENDING THE OFFICIAL ZONING MAP ORDINANCE 2007-287 OF THE CITY OF
TIFFIN, IOWA BY RE-ZONING TWO JOINING LOTS 316 COLLEGE ST AND 221 W
MARNEGO RD. FROM CURRENT ZONING TO C2-B ZONING DISTRICT, and moved that
it be given its first reading. The motion was seconded by Council Person Jim Bartels.
Ayes: Jim Bartels, Mike Gericke, Travis Weipert
Nays: None
Absent: Mark Petersen, Chris Ball
Three Members of the Council being present and having voted "Aye", Mayor Royce Phillips declared
the motion carried, and Ordinance No. 2010-303, was read the first time, discussed and placed on
record.
On the 14th day of July 2010, at a regular meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson Mike Gericke made a motion for approval for Ordinance No. 2010-303, and moved
that it be given its second reading. The motion was seconded by Councilperson Travis Weipert.
Ayes: Chris Ball, Jim Bartels, Mike Gericke, Mark Petersen, Travis Weipert
Nays: None
Absent: None
Five Members of the Council being present and having voted "Aye", Mayor Royce Phillips declared
the motion carried, and Ordinance No. 2010-303, was read the second time, discussed and placed
on record.
On the 14th day of July 2010, at a regular meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson Jim Bartels introduced Ordinance No. 2010-303, and moved that it be given its third
and last reading. The motion was seconded by Councilperson Mike Gericke. ,
Ayes: Chris Ball, Jim Bartels, Mike Gericke, Mark Petersen, Travis Weipert
Nays: None
Absent: None
Five Members of the Council being present and voted "Aye". Mayor Royce Phillips declared the
motion carried, and the ordinance was passed and adopted.
Whereupon the Mayor declared that Ordinance No. 2010-303 be adopted and signified his approval
of same by fixing his signature thereto.
Passed and adopted by the City Council on the 14th day of July, 2010.
