A RESOLUTION OF THE CITY COUNCIL' OF THE CITY OF
TEMPLE CITY DECLARING CERTAIN PREMISES TO BE A
PUBLIC NUISANCE, AND ORDERING ABATEMENT THEREOF
FOR THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE
AS FOLLOWS:
WHEREAS, the Planning Commission of the City of Temple City has,
by Resolution No. 83- 1095PC, determined that a public nuisance as
defined in the Municipal Code, exists on certain premises and recom-
mends abatement thereof; and
WHEREAS, no appeal has been taken from said determination with
respect to the time in which to abate the nuisance.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
DOES RESOLVE:
SECTION 1. That a public nuisance, as defined in the Municipal
Code of the City of Temple City, exists on the premises designated as
4952 El Monte Avenue, City of Temple City, California, and more par-
ticularly described as Lot 1, Block F, Tract 4902, MC 96, pp. 13 -14
of Maps in the Office of the County Recorder, County of Los Angeles,
State of California, in the following particulars:
A. Premises maintained so as to constitute a fire hazard
by reason of woods, rank overgrowth or accumulation of
debris. Section 4230(d)
Overgrown vegetation:
1. likely to harbor rats, vermin and other nuisances;
or
2. causing detriment to neighboring properties or
property values. Section 4230(h)
SECTION 2. The property owner is ordered to abate the nuisance
by the following methods:
A. Removal of all grass, ivy and miscellaneous growth from
the northern fence /wall to the property line within
thirty (30) days; and
B. Spraying of the then bare dirt within ten (10) days there-
after with chemicals rendering the ground sterile; and
C. Instituting a regular maintenance program which will include
spraying of the area on a semi annual basis to kill off any
growth; OR
D. Participate in public works improvement project for curb
and gutter installation along Grand Avenue to eliminate
the nuisance on a permanent basis.
SECTION 3. If said abatement is not accomplished by the expira-
tion of 30 days, the City Manager is hereby authorized and directed
to cause said public nuisance to be abated by City forces or private
contractor pursuant to the Municipal Code.
SECTION 4. The City Clerk is hereby directed to cause a copy
of this Resolution to be served on the owner of said premises pur-
suant to the Municipal Code.
SECTION 5. The City Clerk shall certify to the adoption of
this Resolution.
