RESOLUTION NO. 83 -2224
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TEMPLE CITY DENYING CUP #83 -692
AND VARIANCE #83 -694 FOR THE SANTA ANITA
CONVALESCENT HOSPITAL AND RETIREMENT CENTER
FOR THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES RESOLVE AS
FOLLOWS:
SECTION 1. Based upon a public hearing, the City Council finds
that Planning Commission Resolution No. 83- 1086PC has been appealed:
A. As to the variance:
1) There are no exceptional or extraordinary circumstances
or conditions applicable to the property involved or to
the intended use of such property, which do not generally
apply to other properties in the same zone, specifically,
this is an overuse of property in this area and repeated
surveys indicate unnecessary cumulative noise, congestion,
deprecitation and parking impact upon a residential
neighborhood.
2) Such variance is not necessary for the preservation and
enjoyment of a substantial property right possessed by
other property similarly situated but which is denied
to the property in question. If the variance is denied
the applicant is still able to make reasonable use of
the property.
3) The granting of the variance will be materially detri-
mental to the public welfare or injurious to the adjacent
property as to noise, traffic and cumulative impact.
4) There are no special circumstances as provided in Section
65906 of the California Government code.
B. As to the CUP:
1) The site for the proposed use is not adequate in size,
shape, topography and circumstances.
2) The site does not have sufficient access to streets
and highways, adequate in width and pavement type to
carry the quantity and quality of traffic generated
by the proposed use.
3) The proposed use will have an adverse effect upon the
use, enjoyment or valuation of adjacent property or
upon the public welfare.
SECTION 2. Accordingly, the requested variance and CUP are
denied.
SECTION 3. The City Clerk shall certify to the adoption of this
Resolution.
